In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has/have been divided into separate parts or parcels of real estate without the written consent of the land owner or land owners thereof, except and unless where such tracts or parcels are already separated by a dedicated street, road, or other public way. 4. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising twenty (20) acres or more which, together with the buildings and improvements situated thereon have an assessed valuation in excess of$200,000 for ad valorem tax purposes for the year next preceding the filing of the written petition for annexation, has/have been included within the territory proposed to be annexed without the written consent of the land owner or land owners. 5. The territory proposed to be annexed does not include any area which is the same or substantially the same area in which an election for an annexation to the City of Greeley was held within the twelve months preceding the filing of this petition. 6. The territory proposed to be annexed is not presently a part of any incorporated city, city and county, or town. 8. The property owned by each petitioner is described on each separate signature sheet and, when needed, described more fully in the exhibits attached hereto and incorporated herein by reference. 9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land owners and owning more than fifty percent (50%) of the property, excluding public streets and alleys, and any land owned by the annexing municipality, and are, in fact, owners of one hundred percent (100%) of the property set forth in Exhibit A attached hereto and incorporated herein by reference. Accompanying this petition are the original and four copies of an annexation plat map containing the following information: A. Description of Intended Use and Development for the area of Proposed Adams Annexation The intended use of the property after Annexation would be as Commercial Property. The parcel size is presently± 22.47 AC and includes the 11`h Ave. ROW. At the present time, subdivision of the land is not planned and is dependent on obtaining an investor/buyer to develop the site. If the property is not sold to an investor/developer within a give time period, Mr. Adams plans on subdividing the parcel into 3 to 4 parcels that range in size from 3 to 5 acres in size. The lands of this Annexation are adjacent to 11`h Ave. and "O" St. The site is presently provided water by the North Weld Water Conservatory Water District(NWWCD). The existing water lines maintained by the City of Greeley consist of a 16" water line that is located west of 11`h St. ROW (South of Site) and in the "O" St. ROW(West of the Site). A City of Greeley"Origin Map"has been attached with this document, and shows the location of the existing x sting water lines. The City of Greeley Sanitary Sewer Lines are located in the N 11`h Ave. ROW, the existing Sanitary Sewer Line is a 10" line. The City of Greeley Sanitary Sewer Line located on the southern side of the "O" St. ROW is a 8" line. A City of Greeley"Origin Map" has been attached with this document, and shows the location of the existing Sanitary Sewer lines. Electricity and Telephone lines are present in the 11`h. There is a farm house and corral/livestock area located on the southern portion of the site. It is assumed that the farm house and corral/livestock area will be removed during the development phase and this area will be used as the storm water detention area. The proposed land use would be as commercial. The size and extent of the buildings is unknown at this time and will be dependent on the type and scope of the business developing the site or parcels. It is assumed that no school students will be generated by the proposed use of this site. No dwelling units are planned for this site. The one existing dwelling unit will likely be removed from the site. There are no existing gas and oil facilities on the site. The mineral rights to the property are owned by Car Body LLC, the mineral rights have been separated for the surface rights. It is assumed that no gas and oil facilities are planned for the site due to the location and configuration of the site and the close proximity to the section line. West Greeley Conservation District. The southern portion is in this district, the northern portion of the site is not assigned to this district, see attached District Map. RE-2 School District Eaton Fire Protection District High Plains Library District Aims District The site is not located in a Recreation District Adams Annexation and Establishment of Zoning-Project Narrative September 20, 2013 The Adams Proposed Annexation is a+19.15-acre project. This said acreage does not include the "O" Street and 11th Avenue ROW's. They are already within the city limits. The proposed zoning is C-H for anticipated commercial usage. The proposed project development is surrounded by the following land usages: on the west side there is farm agriculture, on the north side there is an existing farm house with Highway 85 extending vertical from the east, and on the east side-Highway 85 is adjacent to and runs parallel with the proposed project land. Further on the east side of Highway 85, there is an expansion of commercial and industrial land usages that are within in the county jurisdiction.There has been a large amount of industrial development in the past two years and remains on going in the land to the east.The land area to the south of the proposed project site is located in the City of Greeley boundaries. To the south is the Guadalupe Center Apartments and to the southwest is Weld County offices and facilities and other commercial businesses such as Star Tech and Federal Express. According to the 2060 City of Greeley's Comprehensive Plan(on page 7 - CLU), it has been determined that this proposed project site is located within the Long Range Expected Commercial Growth Area and within the US Hwy 85 Employment Corridor. It is "...near 'O'Street,"and, it is also adjacent to the "...east of the Hwy 85 Bypass." The annexation being proposed is C-H, and this said annexation request is consistent and in conformity with the City of Greeley's future community commercial site plans. The anticipated types of businesses using this site would include office space, food establishments and Hotel/Motel types of businesses. The current surrounding businesses included,but are not limited to: the Weld County Business Complex, Star Tech and The Island Grove Fairgrounds. The existing patrons and employees in this list must travel to the downtown area or other parts of the City of Greeley to obtain services that our proposed project site will most likely fulfill. Consequently, the proposed project site would fulfill more of the local growing neighborhood needs and facilitate the needs of out-of-the-area people who attend the Island Grove Fairground activities for example. At the present time, subdivision of the land is not planned and is dependent on obtaining an investor/buyer to develop the site. If the property is not sold to an investor/developer within a limited time period, Mr. Adams plans on subdividing the parcel into 3 to 4 parcels that range in size from 3 to 5 acres.Nevertheless, a community of interest would remain between the territory being proposed for annexation and the City of Greeley. The territory is expected to he urbanized in the future. The site is located on an existing mass transit route. Access to the site would be from North 116 Avenue. And,North 11th Avenue is one of the entry points into the City of Greeley on the Northeast side of the City. North 116 Avenue has been classified as a Major Arterial road and access will be limited from and onto 11th Avenue when the site is platted and developed. Cross access easements will be utilized to reduce the number of required access points. There are no gas and oil facilities located on this parcel. Gas and oil extraction is currently taking place on the site from well-heads that are located west of the site (west of 11th Avenue). Gas and oil processing equipment and tank batteries for the hydrocarbons collected from this site are located on the western side of North 11th Avenue, and do not impact this proposed project site. It is assumed that no gas and oil facilities are planned for the site due to the location and configuration of the site and the close proximity to the section line. The property mineral rights are owned by Car Body LLC. The mineral rights are separate from the surface rights. The site is presently supplied by potable water from the North Weld Water Conservatory District (NWWCD). If additional work is required to include the proposed project site in a sub-district of the Northern Colorado Water Conservancy District,it will be preformed as requested. When the development occurs,the project land will be converted to the City of Greeley Water. The existing water lines maintained by the City of Greeley consist of a 16" water line that is located west of 11th St. ROW (South of Site) and in the"O" St. ROW(West of the Site). The site is not located in an ecological hazard area as the research from the Websoil Survey for Weld County demonstrates. No dumps or landfills are known to exist on this site. The existing residence is presently served by a septic system. This residence will likely he removed from the site when development begins. All future sanitary sewer flows will use the existing sanitary sewer system operated by the City of Greeley. No wetlands exist on the site. The southern portion of the site is depressed from the surrounding area. This southern portion would be used for a regional storm water detention area. It presently experiences flooding during large storm events and during the irrigation season. Drainage design and accommodations to the existing drainage patterns will be required to correct the existing drainage problems that now exist on the southern and southwestern portions of the site. The existing land use and zoning is as Ag. There is a farmhouse and corral/livestock area located on the southern portion of the site. It is assumed that the farmhouse and corral/livestock area will be removed during the developmental phase. One-sixth (1/6) of the perimeter area proposed to be annexed is contiguous with the City of Greeley. It is 373.14 in length and is located on"0" street. The parcel size is presently± 22.47 AC and includes the 11th Ave. ROW. At the present time, subdivision of the land is not planned and is dependent on obtaining an investor/buyer to develop the site. If the property is not sold to an investor/developer within a give time period, Mr. Adams plans on subdividing the parcel into 3 to 4 parcels that range in size from 3 to 5 acres in size. The lands of this Annexation are adjacent to 11th Ave. and "O" St. The site is presently provided water by the North Weld Water Conservatory Water District(NWWCD). This said acreage does not include the"O" Street and 11th Avenue ROW's. They are already within the city limits. The proposed zoning is C-H for anticipated commercial usage. The proposed project development is surrounded by the following land usages: on the west side there is farm agriculture, on the north side there is an existing farm house with Highway 85 extending vertical from the east, and on the east side- Highway 85 is adjacent to and runs parallel with the proposed project land. Further on the east side of Highway 85,there is an expansion of commercial and industrial land usages that are within in the county jurisdiction.There has been a large amount of industrial development in the past two years and remains on going in the land to the east. The land area to the south of the proposed project site is located in the City of Greeley boundaries. To the south is the Guadalupe Center Apartments and to the southwest is Weld County offices and facilities and other commercial businesses such as Star Tech and Federal Express. According to the 2060 City of Greeley's Comprehensive Plan(on page 7 - CLU), it has been determined that this proposed project site is located within the Long Range Expected Commercial Growth Area and within the US Hwy 85 Employment Corridor. It is "...near `O'Street,"and, it is also adjacent to the "...east of the Hwy 85 Bypass." The annexation being proposed is C-H, and this said annexation request is consistent and in conformity with the City of Greeley's future community commercial site plans. The anticipated types of businesses using this site would include office space, food establishments and Hotel/Motel types of businesses. The current surrounding businesses included,but are not limited to: the Weld County Business Complex, Star Tech and The Island Grove Fairgrounds. The existing patrons and employees in this list must travel to the downtown area or other parts of the City of Greeley to obtain services that our proposed project site will most likely fulfill. Consequently, the proposed project site would fulfill more of the local growing neighborhood needs and facilitate the needs of out-of-the-area people who attend the Island Grove Fairground activities for example. At the present time, subdivision of the land is not planned and is dependent on obtaining an investor/buyer to develop the site. If the property is not sold to an investor/developer within a limited time period, Mr.Adams plans on subdividing the parcel into 3 to 4 parcels that range in size from 3 to 5 acres. Nevertheless, a community of interest would remain between the territory being proposed for annexation and the City of Greeley. The territory is expected to be urbanized in the future. The site is located on an existing mass transit route. Access to the site would be from North 11th Avenue. And,North 11th Avenue is one of the entry points into the City of Greeley on the Northeast side of the City. North 11 m Avenue has been classified as a Major Arterial road and access will be limited from and onto 11th Avenue when the site is platted and developed. Cross access easements will be utilized to reduce the number of required access points. There are no gas and oil facilities located on this parcel. Gas and oil extraction is currently taking place on the site from well-heads that are located west of the site (west of 1 I`h Avenue). Gas and oil processing equipment and tank batteries for the hydrocarbons collected from this site are located on the western side of North 11`s Avenue, and do not impact this proposed project site. It is assumed that no gas and oil facilities are planned for the site due to the location and configuration of the site and the close proximity to the section line. The property mineral rights are owned by Car Body LLC. The mineral rights are separate from the surface rights. The site is presently supplied by potable water from the North Weld Water Conservatory District(NWWCD). If additional work is required to include the proposed project site in a sub-district of the Northern Colorado Water Conservancy District, it will be preformed as requested. When the development occurs, the project land will be converted to the City of Greeley Water. The existing water lines maintained by the City of Greeley consist of a 16" water line that is located west of I l rh St. ROW (South of Site) and in the"O" St. ROW (West of the Site). The site is not located in an ecological hazard area as the research from the Websoil Survey for Weld County demonstrates. No dumps or landfills are known to exist on this site. The existing residence is presently served by a septic system. This residence will likely be removed from the site when development begins. All future sanitary sewer flows will use the existing sanitary sewer system operated by the City of Greeley. No wetlands exist on the site. The southern portion of the site is depressed from the surrounding area. This southern portion would be used for a regional storm water detention area. It presently experiences flooding during large storm events and during the irrigation season. Drainage design and accommodations to the existing drainage patterns will be required to correct the existing drainage problems that now exist on the southern and southwestern portions of the site. The existing land use and zoning is as Ag. There is a farmhouse and corral/livestock area located on the southern portion of the site. It is assumed that the farmhouse and corral/livestock area will be removed during the developmental phase. One-sixth (1/6)of the perimeter area proposed to be annexed is contiguous with the City of Greeley. It is 373.14 in length and is located on"0"street. Mr. Kenneth Adams' request to annex his parcel of land within the City of Greeley boundary is consistent and in conformity with the City of Greeley's future commercial growth goals and is believed to meet the established codes. The subject site is located within an area identified in the 2060 Comprehensive Plan (Land Use Guidance Map) as the US 85 Employment Corridor. It is anticipated that the corridor will be developed with commercial uses. ANALYSIS Due to the state contiguity requirements, the applications are a combination of two stand-alone annexations. The first Annexation derives its contiguity from the North Poudre 3`d Annexation (Reception No.1893288) to the south. The first Annexation, if approved, would then provide contiguity for the second Annexation. The First Annexation is located directly north of O Street and consists of 3.91 acres. The Second Annexation is located directly north of the l" Annexation and east of 1 1d' Avenue. This annexation contains the remaining properties within the overall annexation and consists of 15.24 acres. When future development is proposed for the site, City water and sanitary sewer service will be extended to serve the site. The property is proposed to be withdrawn from the Eaton Fire Protection District and receive fire services from the Greeley Fire Department. The annexation will extend the external boundary of the City to the northeast. The annexation of this property into the City would be consistent with present growth patterns and Comprehensive Plan policies. There is evidence that this site shares a common interest with the City's future. The requirements of State Statutes and City of Greeley Comprehensive Plan Policies for annexation appear to have been met by these requested annexations.
