RE: RECORDED EXEMPTION NO. 219 - RAY C. PETERSON AND VIOLET
L. PETERSON.
WHEREAS , it has been determined by the Board of County
Commissioners, Weld County, Colorado, at a public meeting held
on the 27th day of September, 1976, in the Chambers of the Board
of County Commissioners, Weld County, Colorado, that a certain
parcel of land, being the property of Ray C. Peterson and Violet
L. Peterson, Orchard, Colorado, described as that portion of
Section 29 , Township 4 North, Range 61 West of the 6th P.M. , in
Weld County, Colorado, more particularly described as follows :
Description of the whole parcel
A parcel of land described as the E 5/8 of the NEQ Sec. 29 T4N R61W
6PM, subject to easements for Hwy. No. 34 and the Bijou Canal, more
particularly described as Cannencing at the Ea corner of said Sec. 29;
thence N 0002'W 2650 feet along the east side of said NE1/4Sec.29 to the
NE corner of said Sec.29; thence assumed West along the north side of
said NF'% Sec.29 and the centerline of said Hwy. No. 34 1668 feet to a point
north of an established fence; thence S0°35'E 2656 feet along said
established fence to a point on the south side of said NEa Sec. 29; thence
N89°48'E 1642.5 feet to the point of beginning containing in all 100.81
acres.

A parcel of land described as that part of the E 5/8 of the NE4
Sec. 29 T4N R61W 6PM lying south of the south R.O.W. line of the Bijou Canal
(assured to be 50 feet south of the centerline of said Bijou Canal) more
particularly described as Commencing at the E% corner of said Sec. 29; thence
NO°02'W along the east side of said NE/ Sec.29 333 feet to a point 50 feet
south of the centerline of said Bijou Canal; thence N84°53'W 1652.5 feet
parallel to and 50 feet south of the centerline of said Bijou Canal to
an intersection of a established north south fence prolonged south; thence
S 0°35'E along said fence prolonged south 486 feet to the south side of
said NE, Sec. 29; thence N89°48'E 1642.5 feet along the south side of said
NEaSec.29 to the point of beginning, containing in all 15.43 acres.

A parcel of land described as that part of the E 5/8 of the NEaSec.
29 T41 R61W 6PM lying north of the south R.O.W. line of the Bijou Canal
(assured to be 50 feet south of the centerline of said Bijou Canal) , subject
to easements for Highway No. 34 and the Bijou Canal, more particularly
described as Canmencing at a point on the east side of said NE4 Sec. 29
333 feet north of the E4 corner of said Sec. 29; thence N 0002'W along
the east side of said NEa Sec.29 2317 feet to the centerline of said Hwy.
34 and the NE corner of said Sec.29; thence on assumed West bearing along
the north side of said NEa Sec.29 and the centerline of said Hwy.34 1668 feet to
a point north of a long established north south fence; thence SO°35'E
2170 feet along said fence line to a point 50 feet south of the centerline
of said Bijou Canal; thence 584°53'E 1652.5 feet parallel to and 50 feet south

101 (10) , C.R.S. 1973, as amended, and,
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land from

the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , C.R.S. 1973, as
amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Ray C. Peterson and Violet L.
Peterson be exempt from the definition of the terms , "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , C.R.S. 1973, as amended, and Section 2-1A (3) of
the Weld County Subdivision Regulations, subject to the following
conditions. The above described parcel A and the parcel A of
Recorded Exemption No. 220, being further described as:
Description Parcel A
A parcel of land being the W 3/8 of the NE3 and the E' of the N% Sec.29
T4N R61W 6PM lying south of the south R.O.W. line of the Bijou Canal (assumed
to be 50 feet south of the centerline of said Bijou Canal) more particularly
described as Commencing at a point on the south side of said NEY Sec. 29
1642.5 feet west of the Ea corner of said Sec.29; thence N 0°35'W along an
established fence line prolonged south of the Bijou Canal 486 feet to a point
on the south R.O.W. line of said Bijou Canal; thence N86°54'W 1666.4 feet
parallel to and 50 feet south of the centerline of said Bijou Canal to the
intersection with a north south fence prolonged south across the Bijou Canal;
thence S 0°15'E 582 feet along the prolonged fence line to the south side
of said NW1/4 Sec.29 which point is 23 feet north of the centerline of U.S.B.R.
power line; thence N89°48'E 1666.4 feet along the south side of said NWa and

1652.5 feet parallel to and 50 feet South of the centerline of said Bijou
Canal to an intersection of an established North-South fence prolonged

of the centerline of said Bijou Canal to the intersection with a North-

The Board of Directors of The Bijou Irrigation Company of Fort
Morgan, Colorado and owner of an irrigation canal located in Morgan
and Weld Counties of Colorado, at their meeting on the 5th day of
August, 1976, did give permission and right-of-way for a bridge
crossing of the Company's canal at a point approximately 2317'
South of the Northeast corner and 5' West of the East Section line
of Section 29, Township 4 North, Range 61 West of the 6th P. M. in
Weld County, Colorado, to LeRoy D. Peterson and Patty S. Peterson
as an access to their property.
This access bridge and easement is not to be construed as public
access.
The size and type of construction to be to the satisfaction of
