MEMORANDUM TO: Kim Ogle, Planning Services DATE: October 17, 2013 FROM: Donald Carroll, Engineering Administrator Public Works Department SUBJECT: USR13-0050, Xarios, LLC and Greeley Land Fund (Monfort of Colorado Site) The Weld County Public Works Department reviewed the submitted application for critical items, including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not completed at this step in process. Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: CR 66, aka AA Street, is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 66 right-of- way for full build-out. REQUIREMENTS: Site Plan: The applicant shall delineate or dedicate an additional 40 feet of right-of-way parallel to CR 60 (AA Street) right-of-way for full build-out. Access Permit Application Form: Show the approved access on the plat and label it with the approved access permit number(AP13-00380). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Narrative: The Rain for Rent site will generate up to 55 round trips per day, 10 of which will be semi trucks. Drainage Report: The applicant submitted a Water Quality Feature Report from KBN Engineering dated August 20, 2013. Historic flow patterns and run-off amounts will be maintained on site. Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of construction. (Item #6 in the questionnaire; the site will be used in an "as is" condition.) Water and sewer service are provided by the City of Greeley. The access drives and circulation areas are covered in asphalt. The parking/staging areas are covered in asphalt, concrete and some areas are graveled. The waste handling plan stipulates that dumpsters will be provided and will be provided Redi Services of Frederick has been contracted for refuse removal. Any waste vehicle fluids generated from maintenance and repairs will be removed by Tri State Oil Reclaimers, and Anderson's Sales and Salvage will remove scrap metal. The applicant stated that they were unaware of any floor drains in the mechanics shop. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved "waste handling plan", at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 8. The facility shall utilize the existing municipal sewage treatment system (City of Greeley). 9. The facility shall utilize the existing public water supply. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. A landscape plan was not provided along with the site plan for City review. The principal concern of the City is the site's visibility from AA Street, the future North 17th Avenue, the adjacent church, and future development surrounding the site. It is recommended a perimeter treatment be installed along AA Street as well as the future North 17th Avenue pursuant to City standards: (3) Commercial or industrial uses adjacent to major collector or arterial streets shall include the following plantings for every one hundred (100) feet as part of the perimeter treatment(not including street trees): a. The property currently receives sanitary sewer service from the City of Greeley. If in the future water is extended to the property, then it will be a requirement to annex into the City of Greeley prior to the City of Greeley providing water service. ❑ Advisory. The City of Greeley and North Weld County Water District have adopted a Water Service Agreement for providing water in this area. Please note that if additional water service is requested then the City of Greeley will decide if water will be provided by the City of Greeley or North Weld Water District in accordance to the executed Water Service Agreement. ❑ Advisory. The conceptual plans for The Grainery indicate multiple improvements will be required that would impact this property upon development. Improvements include; o Dedication of additional right of way for AA Street(20'), which is proposed to be a minor arterial, and widening of AA Street to an acceptable cross section with sufficient capacity to serve the development. An acceptable cross section may include the widening of AA Street to a minimum three-lane paved 36' pavement section, turn lanes at the intersection of AA Street and l7th Avenue, possible deceleration and acceleration lanes along the property frontage, and adjacent curb, gutter, and 8' sidewalk. Page2 of 3 o Dedication of 90' of right of way for 17th Avenue along the western property boundary from AA Street to the southern property boundary. The entire street section would be required to be constructed. o 12" water in 17th Avenue. How is it anticipated that these improvements would be constructed, specifically if the subject property is under different ownership? Please understand, with future development to the south these offsite improvements may be required. It would be recommended that a private agreement be entered into addressing these future improvement requirements. ❑ Repeat from Previous Correspondence. Sanitary sewer plant investment fees have been paid for based on the equivalent of four(4) 34" water services. N '/z of Section 30, T6N, R65W Water Division 1, Water District 3 Dear Mr. Gathman: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application is for a site specific development plan and use by special review for a mineral resource development facility on a total of 224.5 acres. The site will initially be used as a drop/staging yard for empty storage tanks, pumps, hose/pipe, and trucks, loading of tanks/pipe, and maintenance of equipment. The applicant will renovate and use or demolish existing building as needed. The site will likely have 1-2 full-time mechanics, and be visited by 6-15 employees per day. Water service is currently provided to the property via a tap from the North Weld County Water District (NWCWD). The NWCWD most recently provided updated supply and demand information via the Tri-Districts on December 18, 2012. The document shows that the NWCWD's firm yield supply of 6,392 acre-feet exceeds its dry year planning demand of 4,702 acre-feet. Sewage disposal will be provided via existing sewer lines form the City of Greeley. There are several non-exempt wells located on the property and permitted for various uses. Well permit nos. 268-RN, 269-RN, 270-RN, 11000-R, 12009-R, 20110-F-R are all currently included in the Poudre Augmentation Plan. The Applicant has not proposed to use these wells for any purpose at the site. Should the Applicant choose to operate ant of the subject wells for any purpose at the site, the wells must be operated in accordance with their decreed water rights, permitted terms and conditions, and referenced plan for augmentation. There is also an existing retention pond located in the southeast corner of the property. Any stormwater runoff intercepted by this water quality feature that is not diverted or captured in priority must infiltrate into the ground or be released to the stream system within 72 hours. Depending on the traffic volume of the existing intersection they could actually trigger the need for a new access permit and possibly highway improvements so it's impossible to tell based upon the information they provided.
