SUBJECT: PUDF14-0007, Ann Nash & Jonathan Scupin
Final COZ for a 1-Lot PUD
The Weld County Public Works Department has reviewed this proposal. This project falls under
the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4,
Section 23. Staff comments made during this phase of the Use by Special Review process may
not be all inclusive; as other issues may arise during the remaining application process.
COMMENTS:
Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011)
CR 1.5 is a local paved road (Elmore Rd.) and requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is
measured from the future right-of-way line.
No (ADT) traffic count number at this location.
REQUIREMENTS:
Rework the plat to show PUDF Requirements (Chapter 27 PUD Article VII-PUD Final Plan: Step
Three).
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Section 15-1-180 of the Weld County Code
Drainage:
The historical flow patterns and run-off amounts will be maintained on site.
Traffic:
No additional traffic is anticipated. Vehicular traffic circulation will continue to be provided by
Elmore Road which connects to State Highway 66.The CO RHS has no employees. One
volunteer visits the site two days during the week and two to four volunteers visit the site each
Saturday. Others may visit by appointment only.
Fence:
The fence next to Elmore Road needs to be relocated out of the County right-of-way. If in the
future Elmore Road is widened or upgraded, the fence will need to meet the existing or future
right-of-way line.

CASE NO.: PUDF14-0007 NAME: Nash & Scupin
Environmental Health Services has reviewed this proposal for a PUD (Planned Unit
Development) final plan application for one (1) residential lot with Estate zone uses.
The minimum lot size of 4.03 acres does meet current Department policy.
This PUD will allow the applicants to apply for a Use by Special Review (USR) permit
for a kennel. The Colorado Reptile Humane Society is currently operating from the
property.
Longs Peak Water District provides water and an individual sewage disposal system
provides sewer (G19732314).
Once an USR application is submitted, this department will require specific items such
as; dust abatement plan, waste handling plan and adequacy of septic system for kennel
usage.
The Department recommends approval with the following notes which should appear
on the change of zone and final plats:
1. Water service shall be obtained from Longs Peak Water District.
2. This subdivision is in rural Weld County and is not served by a municipal
sanitary sewer system. Sewage disposal shall be by septic systems designed
in accordance with the regulations of the Colorado Department of Public
Health and Environment, Water Quality Control Division and the Weld County
Code in effect at the time of construction, repair, replacement, or modification
of the system.
3. Language for the preservation and/or protection of the absorption field shall
be placed on the plat. The note shall state that activities such as permanent
landscaping, structures, dirt mounds or other items are expressly prohibited in
the absorption field site.
4. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.

After reviewing the application and documents submitted the Building Department has the following
comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures.
A building permit application must be completed and two complete sets of engineered plans.
Weld County Building Department records do not indicate a building permit was pulled for the existing
shop, the Assessors records show the structure was built in 2004. A change of use building permit will be
required for the existing shop; an Agreement Concerning Existing As-Built Construction can be used to
show compliance with structural, electrical and mechanical requirements.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1
Accessibility Code and Chapter 29 of the Weld County Code.

Subject: PUDF14-0007 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV12-00040)was noted. This
violation was initiated due to the operation of a kennel (or more than 4 household pets of one species)
without first completing the necessary Weld County Zoning Permits. This case has not been presented to
the Weld County Court Magistrate through the Violation Hearing process. Since this application was
submitted prior to an actual court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, the number of household pets shall be
reduced to 4(four)or a combination of 2 or more species totaling no more than 7 within 30(thirty)days of
denial or the violation will proceed in court accordingly.
