HomeMy WebLinkAbout20140470.tiff HEARING CERTIFICATION DOCKET NO. 2014-05 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0053, FOR A USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (STORAGE AREA FOR MODULAR UNITS) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT- PTI USA MANUFACTURING, LLC A public hearing was conducted on February 19, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: CI I hereby certify that pursuant to a notice dated January 16, 2014, and duly published January 21, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of PTI USA Manufacturing, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0053, for a use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (storage area for modular units) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. CI Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She informed the Board that the site is in the urban growth boundary of the Town of Johnstown, the property is eligible, and the Department of Planning Services is in support of, annexation, 1-25 borders the site to the east, with a dairy on the west, and the closest resident is 40 feet from the boundary line. The storage area will be located on the southwest corner of the site, and no correspondence from surrounding property owners has been received. She said screening and landscaping are proposed, there is no signage, a lighting plan is required, and up to 125 modulars will be stored, with access to the site from the main PTI facility. In response to Commissioner Kirkmeyer, Ms. Aungst confirmed that the Town CC: CAS PL PW Ft� 3-90t-1 2014-0470 PL2255 HEARING CERTIFICATION - PTI USA MANUFACTURING, LLC (USR13-0053) PAGE 2 of Johnstown did not request a review of the staff report, and an annexation is contingent on further expansion of the facility. CI Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He said that access is off of CR 48, which has been annexed by the Town of Johnstown. He noted that CDOT's referral referenced grandfathered agricultural accesses, which will remain the same, and they are not in a flood zone. O Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, indicated no concerns, and stated there should be no waste issues on the site. O Brett Koth, Project Manager for PTI USA Manufacturing, LLC, stated the plant currently produces 15 modular housing boxes a week that get assembled at remote sites all over North America, and they would like to increase their output to 20 units a week. The factory shipping can get backlogged, so the company's need for additional storage is urgent. O No public testimony was offered concerning this matter. O Commissioner Kirkmeyer asked about a possible annexation to the Town of Johnstown and their landscaping and screening requirements, and Mr. Koth confirmed these are acceptable. Commissioner Rademacher addressed hours of operation, and Mr. Koth indicated these are also adequate; however, Commissioner Kirkmeyer suggested the deletion of Development Standard #3 as unnecessary due to their isolated location. This was done by assent of the Board. O In response to Chair Rademacher, Mr. Koth indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. 0 Commissioner Garcia moved to approve the request of PTI USA Manufacturing, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0053, for a use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (storage area for modular units) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 11:35 a.m. O Commissioner Conway said he attended an open house at their facility two years ago, and the Board is pleased PTI USA chose to locate their business in Weld County. Commissioner Kirkmeyer concurred and complimented staff for a reduction to the number of Development Standards (from 32 to 21), thereby reducing regulatory barriers to business in Weld County. 2014-0470 PL2255 HEARING CERTIFICATION - PTI USA MANUFACTURING, LLC (USR13-0053) PAGE 3 This Certification was approved on the 24th day of February, 2014.
