SUBJECT: USR13-0048, Michael Boulter, do Jim Beauregard
(Equipment Parking)
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
CR 43 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant
shall delineate or dedicate a 40-foot of right-of-way on either side of the centerline of the roadway.
Our most recent traffic count reflects 1423 taken in 2007 on CR 43 between CR 52 & CR 54.
The plat should reflect a vehicle tracking control pad. This should consist of 50 feet of recycled asphalt, 24-foot
wide. Please find attached our typical option. This should be shown on the plat drawing.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
DEVELOPMENT STANDARDS:
Noxious Weeds:
Should noxious weeds exist on the property or become established as a result of the proposed development,
the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of
the Weld County Code.
There shall be no parking or staging of vehicles on County Roads. Utilize on-site parking.
The historical flow patterns and run-off amounts will be maintained on site.
Geotechnical Soil Report:
A geotechnical soils report is not required by Public Works at this time.
Traffic Study:
The applicant in the questionnaire is indicating that 15-20 employees will be employed from the site, but not
working on site. They will be picked up by a company vehicle not stored on site. Vehicles on site include four
tandem dump trucks, two tractor trailers, and pick-ups, that goes out two times daily. Not all of the equipment
leaves the site on a daily basis.

Grading Permit:
Please add the following conditions to the resolution:
1. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of
construction
The plat shall be amended to delineate the following:
Vehicle tracking control pad (see attached) will be installed and maintained throughout the life of the site to
prevent tracking of debris on to County roadway.
Show the approved access on the plat and label it with the approved access permit number (AP#).
A water quality capture feature (WQCF) is required on site. The area can be in an existing onsite low point that
will capture the storm water and hold contaminants. Contact the Public Works Department for sizing of your
feature.

Environmental Health Services has reviewed this proposal for excavation equipment
parking. There will be up to 20 employees who will access the site to pick up and drop
off equipment. No employees will be stationed at the site.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1 . Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The dust abatement plan stipulates that the access drive will be graveled (indicated on
site plan) and water will be used to mitigate onsite dust. The property has 2 existing
water taps from Central Weld County Water District (Tap Nos. 1112 and 1134).
The waste handling plan stipulates that Waste Management will provide refuse removal
and service the portable toilet.
We have no objections to the proposal; however, we recommend that the following
requirements be incorporated into the permit as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The facility shall operate in accordance with the
approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall operate in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the
Weld County Department of Public Health and Environment. Portable toilets
shall be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.

7. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV13-00064)was noted. This
violation was initiated due to the operation of a commercial business without first completing the
necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all commercial operations and storage of
commercial vehicles, materials and/or equipment shall be removed from the property within 30 (thirty)
days of denial or the violation will proceed in court accordingly.

Dear Ms. Aungst:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning
directors, this office will only perform a cursory review of the referral information and provide informal comments.
The comments do not address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot
be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical
availability of water.
The application seeks a site specific development plan and use by special review permit for the storage
and parking of agricultural and commercial equipment on a 1.89-acre parcel. The site will also be used for
parking of employee vehicles during work hours. On average, 15 to 20 people will use this site, but will not be
working on site. There will be a portable restroom on site available to employees.
The subject property has water service available via two taps from the Central Weld County Water District
("District")). The District most recently provided this office with information about their water supplies in
September of 2012. Based on this information, the District is considered to have adequate water supply.
The site plan depicts a"catch pan" on the site to collect storm water runoff. Any stormwater runoff
intercepted by this feature. that is not diverted or captured in priority, must be released to the stream system
within 72 hours. Otherwise, the applicant will be required to make replacements for evaporation.
Information available in this office indicates that the wells with permit nos. 124018-A and 124019 may be
located on the subject property. The well with permit no. 124018-A is permitted to be used for the irrigation of not
more than one acre of home gardens and lawns and the watering of livestock on a farm or ranch. The well with
permit no. 124019 is permitted for domestic use, including the irrigation of not over one acre of home gardens and
lawns. These wells may continue to be used in accordance with their permitted terms and conditions but may not
be used as a water supply for the proposed business.
