HomeMy WebLinkAbout20143539.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 10, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 10, 2014, at the hour of 9:00 a.m. F ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly F MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of November 5, 2014, as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. IR CERTIFICATION OF HEARINGS: Commissioner Garcia moved to approve the Certification of Hearings conducted on November 5, 2014, as follows: 1) USR14-0059— Joseph and Linda Baker, 2) USR14-0051 — Circle B Land Company, LLC, c/o Bill Barrett Corporation, and 3) USR14-0034 — Diamond Valley Energy Park, LLC do Extraction Oil and Gas, LLC. Commissioner Conway seconded the motion, which carried unanimously. ID AMENDMENTS TO AGENDA: There were no amendments to the agenda. F CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. BIDS: F 1) PRESENT BID #61400178, BRIDGE 42/29A CONCRETE WINGWALLS - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, stated three bids were received and staff will bring a recommendation for approval to the Board on November 24, 2014. Minutes, November 10, 2014 2014-3539 Page 1 BC0016 i►12,0 OLD BUSINESS: El 1) CONSIDER REQUEST TO WAIVE LATE FEE, APPROVE RENEWAL APPLICATION FOR TAVERN LIQUOR LICENSE FROM VIPER 2, INC., DBA BORDERLINE AND AUTHORIZE CHAIR TO SIGN (CON'T FROM 11/3/2014): Bob Choate, Assistant County Attorney, explained there are two remaining issues: appropriate food available to operate under a tavern license, and a waiver of the late fee. Kim Chavez, representing Viper 2, Inc., stated the application was lost in the mail, and noted they have not been late in their 10 years of operation. In regard to the food requirements, she said they normally serve frozen pizza and burritos, which can be heated in a microwave, but on the day of the inspection they were running low, but there was soup available. In response to Commissioner Conway, Deputy Lisa Carpenter, Sheriff's Office, said at the time of her inspection she was told that only the vending machines were available with candy and chips. Commissioner Conway moved to waive said late fee, approve renewal application, and authorize Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. NEW BUSINESS: 1) CONSIDER VETERANS SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION OF PAY FOR SEPTEMBER, 2014, AND AUTHORIZE CHAIR TO SIGN: Toby Taylor, Veteran's Services Officer, recommended approval of the monthly report sent to the Colorado Veteran's Office. Commissioner Freeman moved to approve said report and certification of pay and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. Commissioner Conway also reviewed the Veteran's Day celebrations tomorrow. 2) CONSIDER TEMPORARY CLOSURE OF CR 34 BETWEEN CRS 17 AND 19: Janet Lundquist, Department of Public Works, reviewed the temporary road closure of 16 days for flood repairs to be done by DeFalco Construction. Commissioner Freeman moved to approve said temporary road closure. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. I] 3) CONSIDER CONTRACT AMENDMENT FOR CDOT 1-25 MANAGED LANES TIGER GRANT AND AUTHORIZE CHAIR TO SIGN: Elizabeth Relford, Department of Public Works, stated there is no monetary affect on the County in this amendment. This regards the contribution of additional funding from the City of Thornton for the construction of a stone sound wall. Commissioner Kirkmeyer moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. 11) 4) CONSIDER ACCEPTANCE OF DEED OF DEDICATION AND AUTHORIZE CHAIR TO SIGN - SADLER FAMILY PARTNERSHIP, C/O MARGY POLLOCK: Michelle Martin, Department of Planning Services, and Leon Sievers, Department of Public Works, explained this was right-of-way needed for the eastern portion of CR 29, between CR 2 and CR 2.5, discovered via surveying for an application for a recorded exemption. The road has been maintained by the County for a century, and the landowner volunteered to remedy the situation at no cost to the County. The surveyor pre-recorded this document by mistake, so it will be re-recorded. Commissioner Freeman moved to approve acceptance of said deed and authorize the Chair to sign. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. 5) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S28, T4N, R66W-0.172 ACRES) - PDC ENERGY, INC.: Esther Gesick, Clerk to the Board, reviewed the location of this small track lease (Town of Gilcrest), acreage and bonus amounts. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. E— 6) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S28, T4N, R66W - 0.075 ACRES) - PDC ENERGY, INC.: Ms. Gesick reviewed the location of this small track lease, acreage and bonus amounts. Commissioner Freeman moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. ID 7) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S28, T4N, R66W - 0.075 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the location of this small track lease, acreage and bonus amounts, and noted these three are all first time leases discovered via title search and first-time nomination. Clerk to the Board asked the landman to provide documentation that indicates how they determined the parcel was County owned. Commissioner Conway moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. E 8) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S6, T7N, R67W - 1.82 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount. Commissioner Kirkmeyer moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. IR 9) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S6, T7N, R67W- 1.47 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount. Commissioner Garcia moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. F 10) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S18, T7N, R67W - 0.50 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount. Commissioner Freeman moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. ID 11) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S8, T7N, R67W - 1.82 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount of another right-of-way strip. Commissioner Conway moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. Minutes, November 10, 2014 2014-3539 Page 3 BC0016 El 12) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S8, T6N, R67W- 0.95 ACRES) - LAND ENERGY, INC.: Ms. Gesick stated this one is unusual as she has not heard back from the landman regarding the location, which is not on a section line, and requested a continuance. Commissioner Conway moved to continue this item until Monday, November 17, 2014. The motion, which was seconded by Commissioner Garcia, carried unanimously. El 13) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S26, T7N, R67W- 0.18 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount. Commissioner Freeman moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. e 14) CONSIDER REQUEST TO WAIVE BID PROCEDURE CONCERNING SMALL TRACT OIL AND GAS LEASE, ACCEPT OFFER TO LEASE MINERAL ACRE, AND AUTHORIZE CHAIR TO SIGN (S11, T7N, R66W - 1.0 ACRES) - LAND ENERGY, INC.: Ms. Gesick reviewed the acreage, location and bonus amount, noting the County owns 50 percent of this two-acre parcel. Commissioner Conway moved to waive said bid procedure, accept offer to lease, and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
