MCCORMICK, 3606 S. HIBISCUS WAY, DENVER, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 20th day of April, 1978 at the hour of 2 :00 o 'clock p.m. , in the Chambers of the Board of County Commissioners, for the purpose of hearing the applica- tion of John A. McCormick, 3603 S. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Section 3. 3(E)(2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses , compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural. B. The Weld County Extension Agent has indicated he did not observe any problems with this proposed facility and the proposal should not create any detrimental effect on the environment . C. The Town of Lochbuie Planning Commission has indicated they have no objections to this proposal . D. The Soil Conservation Service, Brighton District , has indicated there should be no problems from soils or flooding and therefore have no objections to this request. E. The Weld County Health Department has indicated they see no reason why this request should be denied provided that the applicant complies with the stipulations as indicated in the Health Department' s letter dated February 21, 1978. (Those stipulations have been incorporated into the Development Standards ) . F. The State Engineer's Office, Division of Water Resources , has indicated that the existing domestic and livestock well is an adequate water supply for the dairy and they have no objections to the approval of this proposed dairy. G. The applicant has submitted a petition form signed by several of the surrounding owners in support of this request . In addition, the Planning Commission's recommendation for approval is subject to the following condition : No building permits for any structure shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been recorded in the Weld County Clerk and Recorder's Office. John McCormick - SUP - Dairy DEVELOPMENT STANDARDS 1. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 200 head of milking cows . 2 . The Special Use Permit area shall ' be maintained in such a manner so as to prevent soil erosion , fugitive dust , and the growth of noxious weeds . 3. Water shall be supplied by a livestock/domestic well which has been approved by the State Engineer. 4 . All sewage disposal facilities installed on the site shall conform with all applicable Weld County and State Health Regulations. Septic systems other than single family units will require an engineered design . All septic systems shall be 100 feet from the nearest well . A subsurface disposal permit shall he obtained from the Colorado Department of Health for the manure leach field. 5 . Access shall be limited to the one existing point as shown hereon . 6 . Construction of the dairy facilities shall begin within one year of approval by the Board of County Commissioners . All plans , specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to construction . 7. There shall be no discharge of wastes into any streams , other bodies of water, or adjacent drainage systems without obtaining a Waste- water Discharge Permit from the Colorado Department of Health. 8. All structures shall be set back a minimum of 80 feet from the centerline of the existing dirt road. (East line of Section 18, T1N, RG5W) . 9. The Special Use Permit shall be limited to the plans submitted and governed by the Development Standards stated above . McHugh explained to the members of the Planning Commission Colorado Interstate Gas Company' s purpose and the reason for the request being that they have been authorized by the Federal Energy Regulatory Commission , pursuant to its authority under the Natural Gas Act , to construct , install , and operate an additional pipe- line loop and main line gas compression facility in Wyoming and Colorado. The purpose of the new facility is to increase the winter day delivery capacity of CIG' s existing transmission pipeline which transports natural gas in interstate commerce for resale to public utilities serving consumers in Wyoming , Colorado, and elsewhere . The facilities must be placed in operation on or about October 1 , 1978. Mr. McHugh stated the Emission Permits have been obtained from the Colorado Department of Health, Air Pollution Control Division, for four natural gas engine/compressor units , and they will be complying with the State Highway Department ' s request to construct a deceleration zone along side Highway 85 at the point of access to the property. An incinerator has also been placed for the disposal of solid wastes. Some solid wastes also will be hauled away. Mr. Nix asked what source of power is involved to increase pressure in the line. Mr. McHugh responded that natural gas is used to operate the engines . Mr . Nix also asked if there would be additional noise as a result of this . Mr. McHugh responded the noise level would be below State standards . There being no questions , Chuck Cunliffe read the staff ' s recommendation for approval and the Development Standards . McCormick DISCUSSION : Mr. McCormick stated that he previously had a cattle operation on the property in question and now desires to contruct a dairy barn for a dairy operation . He proposed to start with 40-50 head of dairy cows with a maximum of 200 head. There are presently 20 head of heifers on the property. He responded to Mr. Suckla' s question about disposal of manure wastes in that he plans to use an underground separation tank for use on this property. An existing domestic well will be the source of water supply . There being no further questions by the members , Chuck Cunliffe read the staff ' s recommenation for approval and the Development Standards . No further questions . MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the staff ' s recommendation to the Board of County Commissioners . W : , Lot 1, SE* SE*, Section 9, T5N, R65W LOCATION: East of Greeley on East 18th Street (U.S . 34) across from Linn Grove Cemetery and west Cherry Avenue SUBJECT: Change of Zone from "E" to "C-UD" APPEARANCE : Robert See and Ed Berliere DISCUSSION: Mr. See briefly again reviewed his request to locate his business , being See Farm Buildings , in this area. He definitely feels this is the appropriate area for his business and feels it would in no way be an eyesore. He also commented in regard to faulty zoning as indicated in the comments by the Planning staff. He feels the original zoning did not consider the fact that Highway 34 was needed as a commercial area. Mr. Hiatt asked if the plat had been changed since the last meeting. Ed Berliere , who prepared the plans , indicated there had been some slight changes on the plan . One being r Planing Commission nutes Page 3 March 7, 1978 that it now includes more detail regarding the drainage plan and one building that was previously shown on the southern line was re-located. There is also more detail in the retention area it- self. He also indicated there was some confusion from the surround- ing property owners in that the l'etter sent them did not indicate exactly where the property in question was located. Discussion followed regarding the location of the water line and proposed fire hydrants in the area. Western Hills Fire Protection District said that if there is one hydrant in the area that it would be adequate . Chuck Cunliffe then read the staff' s recommendation for approval and the Development Standards . Mr. See said he felt the Development Standards were strict , but this is the way he would like them to be . John Rogers , surrounding property owner, expressed his opposition to the proposal . He said he had checked with the Planning Department prior to purchasing his property and was advised that the County had a definite plan for this area. Also feels it will not enchance the value of the property. He also presented petitions to the Board of surrounding property owners in opposition to the change of zone . Elinor Rogers also expressed opposition and said that the submitted plan to the south extends 25 ' to 35 ' behind the Rogers ' property. Mr. See said that his buildings could go to at least 20 ' of the Rogers property , but would not create a visibility problem. Mr. Nix asked why he could not move his business elsewhere, but Mr. See responded that he did not want to go to an industrial zone as there would not be that much activity involved with his business . Surrounding property owners also expressing their opposition included Bette McWilliams and Lola Richardson primarily because of devaluation in their property value. Ed Berliere presented the Planning Commission with a copy of the Greeley Comprehensive Plan Future Land Use map for their review in this regard. This map was adopted in 1971 . MOTION: Be it therefore resolved to continue the meeting to March 21 , 1978, to allow the Planning Commission to conduct an on-site tour of the property with no further testimony regarding the application . Mr. Bird commented on the comments from the City of Greeley indicating there is already an obvious movement in large developments just recently. Mr. Bird said he does not expect to develop this property at least until this summer when he can devote his full time to the proper proceedings. Gilford Alexander expressed his approval of the proposed change of zone. Mr. Nix asked the Planning staff to comment on the City of Greeley' s comment regarding growth. Chuck Cunliffe responded by saying that the City of Greeley does not want to encourage development in that particular area because of the City ' s Comprehensive Plan and development for them they would like to see in the year 2010. The County Planning staff is saying that development has already occurred in this area to the south , east and west and they disagree with the City. Proposal for adoption of the 1978 edition of the National Electrical Code as part of the Weld County Building Code to replace the 1975 edition of the National Electrical Code . DISCUSSION: Joe Jarvis , Director of the Building Inspection Department , briefly reviewed the proposal . Jim Smith, Electrical Inspector, explained that the two major changes in the code is that it will require a GPI breaker service to garage plugs for safety reasons and stricter requirements with the use of ground rods and water pipe grounds so that units are grounded better. He said the only reason he could see for the ground rods is the use of plastic pipes that are added to a metal water pipe . They do not have a positive ground. This was added for extra insurance. Mrs . White questioned what the additional cost would be and Mr. Smith responded that probably about $20. The ground rod would be installed under the meter. Discussion followed regarding the breaker and its use . Kay Norton read into the record Section III of the National Elec- trical Code . Discussion followed again regarding cost and where the inspections are applicable. MOTION : Be it therefore resolved to recommend approval to the Board of County Commissioners . Planning Commissic-- Minutes Page 5 March 7, 1978 Proposed amendment to Section III .H. 5. a of the Weld County Building Code which would reduce the fee for a building permit for a mobile home from $45 to $35 . DISCUSSION : Gary Fortner explained to the Board that in December the Mobile Home Regulations established the standard fee of $45 for a building permit . Subsequent to that time there have been questions raised by various people about the high fee . The original fee was established to cover the overall cost of inspections and includes inspections when the inspectors have to go back for corrections when people do not have things ready the first time. Joe Jarvis reviewed this and discussed it with the Board of County Commissioners and it was decided a change of fee from $45 to $35 would cover the inspections that have to be made when a mobile home is placed in the county. This fee will cover three inspections . The Building Code provides for extra charges if more than the above inspections are required. He also explained that previously all that was charged was $10 for an electrical inspection and $10 for a gas inspection. Under the new Mobile Home Regulations , the inspections are now for setbacks , blocking, tie-downs , skirting, gas inspection, electrical inspection and plumbing hook-ups . The State increased the electrical inspections fee from $10 to $12 which regulates what Weld County charges . Inspectors can make all the inspections as indicated except the electrical and skirting at one time which means an extra trip for skirting which usually takes anywhere from 30-50 days . Discussion followed regarding how difficult it is to collect extra money for extra inspections if they are required. Mr. Jarvis said he feels most people will pay for it . The inspectors are making an average now of five trips for trailers that are moved into the county. O. W. Smith , mobile home park owner, expressed his concern in that he feels it is up to the park owner to make sure everything is in order before the inspector comes out so that extra trips are not needed. He indicated he feels $45 is too high to charge. Dwight Thompson, also a mobile home park owner, presented the Planning Commission with a copy of a Building Permit which indicates what inspections are made on the back of the form. He also commended the Building Inspection Department for their cooperation . He presented some figures which indicates how much the average mobile home owner must spend to move his mobile home . The figures average approximately $500 ; thus , he feels it is an additional hardship to charge $45 for inspections--$35 should be sufficient . The wasted emitted by a single cow in a 30 day period is 1,05011:3 and for a herd of 200 cows the wastes in that same period is 210,000 lbs or 105 tons of waste that would be rotting and emitting odors each month as well as attracting flies and other insects. 2. ;fie presently have the Anschutz cattle feed lot in that same vicinity and have the odors from that bperation. 3. The winds are generally from the Northerly direction and the Vantage Acres Subdivision is just south of the proposed dairy operation; hence a strong stenchat all times but even worse when the wind is blowing. 4. The flies attracted by these operations are such that they are harmful to human health and we have plenty of the flies with just the Anschutz operation. Another Dairy operation would only add to the health hazard. 5. The proposed 1-76 reconstruction will be putting plenty of particulant polutaj':t.d in the air and constant grazing of the dairy cattle would only add greater dust and sand problems to an area that is trying to stabilize the sand as well as a danger to the dairy cattle themselves. 6. As a result of all the above reasons we would all suffer a declining value on our property and personal loss on our lands and homes when trying to sell the properties. Noting the above reasons, we would hope that you would consider our petition favorably. Included in this unit are some leveled areas. Also included are some soils with loamy substratums and some soils that are noncalcareous to depths of 60 inches. . . . Typically the surface layer is a grayish brown loamy sand about 6 inches thick. The subsoil is a brown to light yellowish brown fine sandy loam about 22 inches thick. The substratum, to a depth of 60 inches, is a sandy loam or loamy sand. C -. Permeability is moderately rapid. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops .in the area. However, perennial grasses and alfalfa or close grown crops • should be grown at leapt 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows, contour furrows and cross slope furrows will work on row crops. Sprin- kler irrigation is also recommended. . Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important. Crops grown on these soils respond kt` to fertilizer applications of phosphorus and nitrogen. In nonirrigated areas this soil is suited to winter wheat, barley and sorghum. Most of the area is devoted to winter wheat which is alter- nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terr- acing may also be needed to control water erosion. � Y The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch— grass, sideoats grama and western wheatgrass are also prominent. Po— tential production ranges from 2200 g pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass, switch- .•grass, sideoats grama, blue grama,, pubescent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. 'For successful seeding, a clean, firm, sorghum Stubble-prepared seedbed and grass drill should be used.
