4 RESOLUTION WHEREAS, a public hearing was held on November 3, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of the Colorado State Highway Department, c/o Leo O'Connor, 1845 Sherman Street, Denver, Colorado, requesting permission to locate a gravel pit operation (Borrow Extraction Site) on the following described property: A tract of parcel of land in the NE 4 of Section 35 and the SE 4 of Section 26, all in Township 3 North, Range 62 West of the 6th P.M. , Weld County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point on the South R.O.W. line of Interstate Highway I-76 from which the SE corner of Section 26, Township 3 North, Range 66 West of the 6th P.M. bears N 89°57' a dis- tance of 1908. 3 feet 1. Thence S 24°34' E 450 feet; 2. Thence S 65°26' W 800 feet; 3. Thence N 24°34' W 450 feet; 4. Thence N 65°26' E 800 feet more or less to the point of beginning. Said tract or parcel of land containing 8. 26 acres, more or less, and WHEREAS, the petitioner was present, being represented by Mr. Joe Intermill, Materials Engineer of the Colorado State Highway Depart- ment, and WHEREAS, there was no opposition to the request of the petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be author- ized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners, that the application of the Colorado State Highway Department, c/o Leo O'Connor, to locate a gravel pit operation (Borrow Extraction Site) on the premises indicated above be, and it hereby is granted under the condi- tions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. • /fi , a'' "PLVIr7 750452 4 $ 3. That when gravel extraction is completed said permittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit excava- tion and rehabilitation shall be limited to plans as submitted and in accord- ance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. SUBJECT: Lee Teegarden - Discussion Only Tape 61 = APPEARANCE: Lee Teegarden, Representing Clarence and Vivian Evers LOCATION: in Del Camino Vicinity (State Highway 119 and 1-25) DISCUSSION: This proerty was purchased in two difference parcels , each of them being five acres in 1966. Shortly after purch,:sinq the first five acres, the owners engaged contractors to build a liquor store. The contractors obtained building ermits f,'om the County. Shortly after the liquor store was opened the owners purchased the second five acres to the west. Owners approached the Weld Count , Planning Commission Office to find out how to proceed for a commercial z-r.inq . They were informed that it was already zoned commercial . In late 1974 Mr. Teegarden learned of the discrepancy after being engaged by the owners to market the property, either as a lease or sale. In January Mr. Teegarden met with Anne Moore and Tom Honn and they have been seek , ng a solution to the problem ever since. in February, John iuntunen wrote a letter which stated that the area had bcen erroneously sh,-..w . as a commercial area on County zoning maps. The existing situation. ' 'akes it impossible or promotion o; sale of the land. Mr. Teegarden fcls it would seem proper to designate the area as commercial by an adm nistrative act. He feels the owners nave been subjected to a hardship in this situation. Anne Moore said that it is the feeling of the Zoning staff that this is something that cannot be done administratively be :use of State Statutes . Staff is looking for any comments which t' .: Doard may have about this being a straight commercial area . The arr,a is shown on the official zoning maps as being zoned agricultural . Plats submitted for other zone changes in the area showed the area a, being zoned commercial and the Planning Commission staff did not catch the error at the time. MOTION: By J. The Weld County Planning staff recommends approval for the following reasons: 1 ) The proposed use complies with the Comprehensive Plan and H. E. F. Industries proposes to conduct such operations underground so it will minimize any noise or shock waves to the ground. There will be minimal changes to the existing bui l d;ngs, however a few storage buildings will be constructed in accordance with . .e Uniform Building Code. This storage area will be used for the storage of the metals, not the explosives. Existing underground work areas are detailed on the industrial floor plan. Existing structures were constructed for the eurpesr of supporting and storing the "Atlas D" missile. It is understood and agreed that, upon the letting of a contract by the Depart- ment to a contractor for the construction, improvement and maintenance of highways, the Department shall assign to the contractor all its right, title and interest under this instrument, insofar as the same shall be applicable to the projects let to the contractor, and the contractor may reassign such option to subcontractors working on said projects.
