RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO
SIGN - REALITIES FOR CHILDREN CHARITIES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and Realities
for Children Charities, commencing January 1, 2015, and ending December 31, 2015, with
further terms and conditions being as stated in said Memorandum of Understanding, and
WHEREAS, after review, the Board deems it advisable to approve said Memorandum of
Understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding between the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the Department of Human Services and Realities for Children Charities be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Memorandum of Understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of December, A.D., 2014.

RE: Memorandum of Understanding bet eri the Weld
County Department of Human Services and Realities for
Children Charities (RFCC)
Enclosed for Board approval is a Memorandum of Understanding between the Department and
Realities for Children Charities (RFCC). This MOU was reviewed under the Board's Pass-
Around Memorandum dated December 12, 2014, and approved for placement on the Board's
Agenda.
This MOU allows the Department to access emergency funds that have been donated to RFCC
and as specifically designated for Weld County. Additionally, it includes Special Youth
Opportunities which are local activities entirely sponsored by RFCC, periodically throughout the
year for our children. The Department would share and display information regarding
fundraising activities by RFCC and submit one (1) letter annually that speaks to the value of
having ongoing support through RFCC.
We have no financial obligations under this agreement. The term of this MOU will be January 1,
2015 through December 31, 2015.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE WELD COUNTY DEPARTMENT OF HUMAN SERVICES
AND REALITIES FOR CHILDREN CHARITIES
THIS MEMORANDUM OF UNDERSTANDING is entered into this day
of Ce Yi{,)&Y ,2014, by and between the County of Weld, a political subdivision of the State of
Colorado, by and through the Board of County Commissioners of the County of Weld, on behalf of the
Weld County Department of Human Services, hereinafter referred to as "Human Services"; and Realities
for Children Charities, a 501(c)(3) charitable organization. hereinafter referred to as `RFCC".
WITNESSETH
WHEREAS, Realities for Children Charities(RFCC) has received donated funds to serve the
unmet needs of abused and neglected children in Weld County; and
WHEREAS,the intent of RFCC is to provide Special Youth Opportunities and Emergency
Funding in Weld County when there are no other resources available; and
WI IEREAS, Human Services has children who have unmet needs, safety concerns and/or the
need for protection; and
WHEREAS, Human Services, on behalf of Weld County children, appreciates the care and
generosity of RFCC and its donors.
NOW TIIEREFORE, the undersigned organizations, in good faith, are resolved to execute this
Memorandum of Understanding. In consideration of the premises and mutual promises and covenants
herein contained, the Parties agree as follows:
Term of this Memorandum of Understanding
This Memorandum of Understanding(also known as "MOU" or"Agreement") shall be effective
beginning January 1,2015, and shall end December 31.2015.

Special Youth Opportunities
These are programs funded by RFCC for at-risk youth that would generally not be made available
otherwise. These activities are designed to help normalize their childhood and in some cases provide
cathartic healing opportunities.
Emergency Funding
Emergency funding is available upon request through the RFCC Fund on a case-by-case basis and
intended to serve as a safety net for children who would otherwise go without these services. Funding is
obtained through annual fundraising events.
RFCC Funding Requirements
I. Human Services must demonstrate that it is a tax-exempt human services organization.
2. The child for whom the funds are requested must be abused, neglected or at risk of being abused
and/or neglected.
3. The child for whom the funds are requested must reside or receive assistance in Weld County.
4. Human Services must demonstrate that all other funding resources such as Medicaid, Victims
Compensation, etc., have been exhausted and no other funding is available.
5. The funds request must come from Human Services and must be approved by a designated agent
of Human Services.
Responsibilities of Realities for Children Charities (RFCC)
I. Notify Human Services, upon request, of available funding for use by Weld County children.
2. Provide a funds request form for Human Services to request funding. (A copy of the funds
request form is attached hereto and made a part hereof as Exhibit A.)
3. Receive via c-mail, fax or hard copy, completed funds request forms approved by the designated
agent of Human Services.
4. Screen all funds requests prior to disbursement to determine if request meets funding
requirements.
5. If said request meets funding requirements, notify I Iuman Services of approval and submit
immediately for payment.

6. If said request does not meet funding requirements, notify Human Services within eight(8) hours
of receipt of funding request.
7. Mail or allow a Human Services designated agent to pick up distributed funds directly from
RFCC and/or allow Human Services to directly pay for approved emergency needs and submit
for reimbursement on a monthly basis.
8. Track each funded request and maintain a running balance of available funds.
9. Respond promptly to requests for additional information as they pertain to funding requests
and/or this Memorandum of Understanding.
10. Meet with Human Services staff to discuss needs, problems and other items in order to ensure a
positive outcome.
Responsibilities of the Weld County Department of Human Services(Human Services)
1. Demonstrate the principles of RFCC toward collaborative and cooperative efforts with RFCC
and other area agencies that serve abused and at-risk children locally.
2. Announce RFCC fundraising events and invite potential supporters.
3. Negotiate the best available rate for requested services.
4. Display evidence of partnership with RFCC (agency sticker, plaque, website, etc.).
5. Provide at least one letter to RFCC stating the importance of ongoing support.
6. Designate an agent of Human Services to receive, review, approve and submit funding requests
directly to RFCC.
7. Receive and disburse funds as intended per the approved funding request.
8. Submit monthly invoices to RFCC for reimbursement of approved emergency expenditures if
funds are not disbursed at the time of request.
9. Respond promptly to requests for additional information as they pertain to funding requests
and/or this Memorandum of Understanding.
10. Meet with RFCC staff to discuss needs, problems and other items in order to ensure a positive
outcome.

Modifications. This Agreement may be modified in whole or in part upon approval of the signers.
Termination. This Agreement may be terminated by any of the signers upon thirty(30)days written
notice.
Entire Agreement/No Third Party Beneficiary. This Memorandum of Understanding contains the
entire agreement and understanding between the parties to this Memorandum of Understanding and
supersedes any other agreements concerning the subject matter of this transaction,whether oral or written.
It is the express intention of the parties that any entity other than the undersigned parties receiving
services or benefits underthis Memorandum of Understating shall be deemed an incidental beneficiary
only.
�o Wulver of Immunity. No portion of this Memorandum of Understanding shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees may posses,nor shall any
portion of this Memorandum of Understanding be deemed to have created a duty of care that did not
previously exist with respect to any person not a party to this Memorandum of Understanding.
Severability. If any provision of this Memorandum of Understanding should be held to be invalid,
illegal,or unenforceable for any reason,the validity,legality,and enforceability of the remaining
provisions shall not in any way be effected or impaired thereby.
IN WITNESS WHEREOF,the parties hereto have duly executed the Agreement as of the day,month,
and year first above written.
