HomeMy WebLinkAbout20140971.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 26, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, March 26, 2014, at the hour of 9:00 a.m. El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Controller, Barbara Connolly (Clerk's Note: Audio was inadvertently paused until Old Business item #2). MINUTES: Commissioner Garcia moved to approve the minutes of the Board of County Commissioners meeting of March 24, 2014, as printed. Commissioner Conway seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Conway moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. PUBLIC INPUT: No public input was given. COMMISSIONER COORDINATOR REPORTS Commissioner Conway reported on the Upstate Meeting regarding a new coalition to be called "Fix 1-25 by 2025", a collaborative effort with the business community. He said that at the Colorado Counties, Inc. meeting last week an attempt was repealed to reverse position on Senate Bill 93 regarding eminent domain for for-profit companies. Commissioner Freeman said this is a terrible bill for private property rights, noted the opposition to S.B. 93 is bi-partisan, and said Suncor Energy is the primary driver of the bill. Commissioner Garcia reported that there was a well-attended public meeting to update progress on the Spanish Colony. He also announced Jay McDonald has been appointed the new Director of the Department of Public Works. Commissioner Conway thanked Commissioner Garcia for his hard work (going door to door) and other staff for diligently pursuing the grant necessary to finish the Spanish Colony project. Commissioner Conway noted there was a nationwide search and many applicants were reviewed, and Minutes, March 26, 2014 2014-0971 (� Page 1 BC0016 yet the highest quality candidate was in Weld County's own Department of Public Works. Commissioner Kirkmeyer reported on the Child Welfare Allocation Committee; the existing formula will remain in place, which is good for Weld County kids and families. Commissioner Conway commended Commissioner Kirkmeyer's leadership and testimony opposing Senate Bill 93. (Clerk's Note: Commissioner Kirkmeyer present at 9:18) BIDS: 1) PRESENT AND APPROVE EMERGENCY BID #61400066, WATER IRRIGATION RIGHTS FOR LEASE - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, recommended acceptance of the sole bid from Petrocco Farms, Inc., for the Fulton Ditch at $71.00 per share. The minimum bid was $42.00 per share. Mr. Jiricek also said Joe Miller, of Miller Farms, who leased the Lupton Bottom shares last year, is interested at the minimum bid, and he will follow up on that with Mr. Miller. Commissioner Conway made a motion to accept staff's recommendation for this bid and instruct staff to pursue negotiations on the Lupton Bottom Shares. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. OLD BUSINESS: 1) CONSIDER EXPRESSION OF OPPOSITION FOR PUBLIC TRUST DOCTRINE BALLOT INITIATIVES: Bruce Barker, County Attorney, read the resolution into the record and entered a Greeley Tribune article, dated May 22, 2012, entitled, "Weld Commissioners formally oppose public water initiatives" into the record as Exhibit A. Chair Rademacher said this bill would rewrite water law damaging personal property and water rights. Commissioner Conway concurred it is a dangerous bill, and even if it is no longer on the ballot for this year, the Board wants to make a strong statement against this sort of initiative. Chair Rademacher reviewed the initiative's objectives. Commissioner Kirkmeyer concurred that Weld County relies upon water for agriculture and the Board will continue to be opposed to any threats to water rights. Commissioner Conway moved to approve said expression of opposition. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. El 2) FINAL READING OF WELD COUNTY CODE ORDINANCE #2014-4, IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 14 HEALTH AND ANIMALS, and OF THE WELD COUNTY CODE: Mr. Jiricek summarized the third reading changes for the record, noting the previous version had more stringent requirements than the State of Colorado. Commissioner Conway moved to read by title only. The motion was seconded by Commissioner Garcia, and it carried unanimously. Mr. Barker read the title for the record. Mr. Jiricek commended Heather Barbare, Department of Public Health and Environment, for reviewing these rules and formulating the suggested changes. Commissioner Kirkmeyer moved to approve said Code Ordinance on Final Reading, as amended. The motion was seconded by Commissioner Conway, and it carried unanimously. Commissioner Garcia noted he recently spoke with the Weld County Apartment Owners Association in regard to this code change and coordinating with State requirements rather than adding additional burdens to property owners. NEW BUSINESS: 1) CONSIDER APPLICATION FOR 2012-2015 COMMUNITY SERVICES BLOCK GRANT (CSBG) PLAN MODIFICATION FOR FISCAL YEAR 2014-2015: Judy Griego, Director of Department of Human Services, explained this will provide funding for two additional employment programs this year: subsidized employment and supportive services and Americorps. Commissioner Garcia moved to approve said application for plan modification. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. Minutes, March 26, 2014 2014-0971 Page 2 BC0016 ID 2) CONSIDER REQUEST FOR RENEWAL OF LAW ENFORCEMENT SERVICE AGREEMENT - TOWN OF MEAD: Commander David Clarke, Sheriff's Office, explained this is a service agreement. Commissioner Conway said that this is not circumventing the decision to reject the agreement with the Ritchie Brothers, and these services will not be utilized to cover the Ritchie Brothers' Auctions. Commissioner Conway referred to a productive work session on these types of agreements for smaller municipalities, and he expressed appreciation to Mayor Richard Macomber, who talked about the great service the Sheriff's Office provides. Commissioner Conway moved to approve said renewal of agreement. The motion, which was seconded by Commissioner Freeman, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance#2014-4 was approved on Final Reading, with amendments. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
