STUART BOMBEL, C/O ASPHALT SPECIALTIES CO., INC.
A public hearing was conducted on September 10, 2014, at 10:00 a.m., with the following
present:

The following business was transacted:
ig I hereby certify that pursuant to a notice dated July 11, 2014, and duly published July 16,
2014, in the Greeley Tribune, a public hearing was conducted to consider the request of
Stuart Bombel, c/o Asphalt Specialties Co., Inc., for a Site Specific Development Plan and Use
by Special Review Permit, USR14-0028, for any Use permitted as a Use by Right, Accessory
Use, or Use by Special Review in the Commercial or Industrial Zone Districts (heavy equipment
and truck repair shop, along with outside equipment/vehicles storage and staging) provided that
the property is not a lot in an approved or recorded subdivision plat or part of a map filed prior to
the adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District.
Brad Yatabe, Assistant County Attorney, made this a matter of record.
Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the positive recommendation of the Planning Commission into the record
as written. He said up to 14 employees will operate in two shifts onsite and 55 truck drivers will
arrive and leave each weekday, and possibly weekends as well. There is an existing USR on
the site, but this business is not consistent with what was originally approved, and there are two
other businesses located on this site. The Town of Erie's referral objects to the USR, stating the
proposed use is not compatible with their Comprehensive Plan and citing the lack of screening.
In response, staff has added a Development Standard regarding screening. The applicant has

applied for an upgraded access permit through CDOT, which is in the process of being
approved. Mr. Gathman showed aerials of the site, pointed out the truck route, and said there
are two residences to the northwest within 500 feet. El In response to Commissioner
Conway, r. Gathman reviewed the City of Erie's referral response, and noted this area already

has a lot of industrial use, but their Comprehensive Plan calls for more of a retail scenario.
fii Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements. Access is on the 1-25 west frontage road. He said there will be three
flatbed drivers in addition to the 55 truck drivers. The site is within the geological hazard area,
and there is a fault running through the property, so a geological hazard permit was submitted.

All roads in the area have been annexed or are associated with the State of Colorado.
Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions.
le Rob Laird, Resource Manager for Asphalt Specialties Company, Inc., stated the site is
ideal for this business, as all traffic can go straight onto I-25. The trucks are empty leaving the
shop and returning; they pick up asphalt from the plant. The frontage road will not be further
developed to the south, and the site cannot be seen from County Road 8, as it is over a rise. In
regard to the City of Erie's negative referral response, he outlined how the facility is compatible
with the area. In response to Chair Rademacher, Mr. Laird reviewed the road configuration. He
said they have a lease option agreement with the current owner and may potentially move their
office building onto the site, but that is another step. There may be further development on the
property, depending on water availability. In response to Commissioner Conway, Mr. Laird said
they are amenable to screening, and long-term water service may come from the Left-Hand
Water District, to the south and west; they are in discussions.
Ili No public testimony was offered concerning this matter.
ID Commissioner Kirkmeyer addressed a typo in Condition of Approval #1.1.5. Commissioner
Rademacher stated he does not see the purpose of screening, and the previous business was
not required to do so. Commissioner Kirkmeyer said this is the entryway to Weld County so
some limited common-sense, aesthetically attractive landscaping/screening would be
appropriate and does make a difference. In response to Commissioner Conway, Mr. Laird said
the company's office building, which the owner built in 2005, is a very attractive building, and a
new one would be also. Chair Rademacher addressed Development Standard #4, noting the
hours of operation from 6:00 a.m. to 11:30 p.m. this is a long day, therefore, the hours of
operation are probably unnecessary; Development Standard #4 was struck by assent of the
Board. Mr. Laird said there is a permanent pond on the site and a pre-existing boulder waterfall
and he spoke regarding future development of the site. In response to Commissioner Conway,
Mr. Gathman said the applicant will be able to go through the minor amendment process in
order to build the office building, as long as the impact is not significantly increased. Mr. Laird
confirmed that CDOT is fine with their plans, and he noted office traffic would use a separate
and existing access.

e In response to Chair Rademacher, Mr. Laird, and the applicant, indicated they have
reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as
amended.
El Commissioner Conway moved to approve the request of Stuart Bombel, c/o Asphalt
Specialties Co., Inc., for a Site Specific Development Plan and Use by Special Review Permit,
USR14-0028, for any Use permitted as a Use by Right, Accessory Use, or Use by Special
Review in the Commercial or Industrial Zone Districts (heavy equipment and truck repair shop,
along with outside equipment/vehicles storage and staging) provided that the property is not a
lot in an approved or recorded subdivision plat or part of a map filed prior to the adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as amended and entered into the record. The motion
was seconded by Commissioner Kirkmeyer, and it carried unanimously. The Board welcomed
Mr. Laird and Asphalt Specialties Co., Inc. to Weld County.
There being no further discussion, the hearing was completed at 11:00 a.m.
This Certification was approved on the 15th day of September, 2014.
