SUBJECT: USR14-0017, Swink - Encana
A Use by Special Review (USR) permit for an oil and gas liquids handling hub.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process. All issues of concern and critical issues
during further review must be resolved with the Public Works Department.
COMMENTS:
This project is located at the Northwest corner of CR 6 and CR 7.
CR 6 (gravel) and CR 7 (paved) is owned and maintained by the Town of Erie. The Town has annexed
the portion of roadway adjacent to the site. The applicant shall contact the Town to determine their
requirements. The applicant must contact the Town to determine the required future right of way for this
segment of roadway. Written evidence of access approval from the Town for the existing/proposed
access is required.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
The site plan indicates that tracking control devices (cattle guards) will be installed at the entrances. It
also indicates that the internal site will be paved or concrete in the areas of truck traffic; therefore, I do not
see a need for the tracking control devices if the internal driving areas remain hard surfaced.
This area IS within a Geohazard Boundary and requires a Geohazard Permit. The applicant has
submitted this application to Planning which is currently reviewing the application and has submitted a
referral to the Colorado Geological Survey. Fee collection for both the application and referral review are
still pending. Once the fees have been determined, the applicant shall submit payment before the permit
is issued.
A Weld County Planning Department Grading Permit will be required if disturbing more than 1 acre.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:

REQUIREMENTS:
1. Show on the Map
a. CR 6 and CR 7 is owned and maintained by the Town of Erie. The Town has annexed
the portion of roadway adjacent to the site. The applicant shall contact the Town to
determine their requirements. The applicant must contact the Town to determine the
required future right of way for this segment of roadway or any road improvements or
safety concerns.

b. Show the existing access point on the Plat and label it with the Access Permit number
(Only applicable if Erie has requirements).
c. Delineate the storm water detention on the plat and label as "No Build/Storage Area".
Label the volume and dimensions of the detention feature(s) on the plat.
d. Show a 60' minimum radius on the map for main access onto CR 6 to accommodate
commercial/truck traffic.
e. Show areas of gravel, paving, or recycled concrete/asphalt, identify parking areas.
2. Add the following notes on the map:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. Off-street parking spaces and internal drive isles shall be surfaced with gravel, asphalt,
recycled asphalt base, concrete or the equivalent and shall be graded to prevent
drainage problems.
c. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
d. The applicant must take into consideration storm water quality and provide accordingly
for best management practices.
e. Weld County is not responsible for the maintenance of drainage related features. This
must be addressed by the owner.

Environmental Health Services has reviewed this proposal for mineral
resource development facilities, including oil and gas support and service,
(centralized liquids management facility, and the transloading of a commodity
from one mode of transportation to another including truck and pipeline
without limitation for oil and gas industries, including petroleum products
and storage related to same, new offices and support buildings, and related
equipment; temporary staging area and lay down yard for construction
materials, construction office trailers, and construction parking), in the A
(Agricultural) zone district.
Crude oil will enter the facility via pipelines, and will leave the facility via tanker trucks.
There will be eight truck drivers per hours accessing the site and up to 5 employees
working on site.
The applicant is proposing to install a new commercial septic system. The septic
system will require engineer design and Weld County Board of Health approval. Left
Hand Water District will provide water service.
A comprehensive waste handling plan as well as MSDS information was submitted with
the application. The facility will contract High Sierra Water Services or High Plains
Disposal to handle water disposal. Trash will be placed in a dumpster that will
be serviced by Waste Connections. The dumpster will be emptied either weekly or
every two weeks. A Spill Prevention Control and Countermeasure plan (SPCC) is
required and the plan shall be available on site at all times.
An Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application may be
required.
The dust abatement plan stipulates that during construction water trucks will be utilized.
Water or magnesium chloride will be utilized after construction as necessary. The site
plan indicates entrance drive, parking areas and truck load out areas will be either
asphalt or concrete.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
1 . Prior to allowing the plat to be recorded:
A. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. Prior to the issuance of the Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved "waste handling plan".
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code or all
applicable State noise statutes and/or regulations.

6. In accordance with Colorado Oil and Gas Conservation Commission Rule 604, a
spillage retention berm shall be constructed around the aboveground storage
tanks. The volume retained by the spillage berm should be greater than the
volume of the largest tank inside the berm and sufficient freeboard to contain
precipitation. Alternative protective measures may be allowed provided they
comply with the Colorado Oil and Gas Conservation Commission regulations.
7. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur. Any petroleum contaminated soils on the
facility shall be removed, treated or disposed of in accordance with all applicable
rules and regulations.
8. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
9. A Spill Prevention Control and Countermeasure plan shall be kept on site, at all
times.
10. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the public water supply. (Left Hand Water
District)
12.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
13.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures. A building permit application must be completed
and two complete sets of engineered plans. MSDS sheets for all materials stored shall be submitted with
building permit applications.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of

which is incorporated herein and made a part of these Rules and Regulations by reference, and all other
requirements set forth by this resolution.A Fire District Notification letter shall be submitted to the Fire

I wish to submit the following information regarding the above referenced project.
The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal. FRICO requires a minimum of 25' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment. Each canal has a different ROW depending on the deed.
The boundaries of the Right of Way must be agreed upon.
X Drainage is another concern that must be addressed as FRICO does not allow any
developed storm flow into our canals. This will apply if any development happens.
_ Property concerns need to be resolved.
_No construction of any structure can be put on our ROW. No use of any sort
including pedestrian or vehicle on our ROW is approved.
_ Please send additional information regarding your project so that we may
complete our review and that review criteria can be sent to you, if applicable.
FRICO has drainage concerns but we are currently in communication with Encana
regarding the seepage agreement and drainage plans.
The applicant has or X has not completed a Project Review Application and
submitted a deposit for review fees with the Ditch Company.

RE: Town of Erie Referral Comments

Dear Mr. Ogle,
Thank you for providing the Town of Erie the opportunity to provide comments on the Site
Specific Development Plan and Special Review Permit for the EnCana Oil & Gas (USA), Inc.,
Liquids Handling Hub. The Town of Erie respectfully submits the following comments:
1) The Town of Erie Comprehensive Plan indicates that future residential development
is likely to occur on adjacent properties. The Town requests that the applicant utilize
a combination of berming and landscaping to more effectively screen the proposed
facility from these future land uses.
2) Per the Town of Erie Transportation Master Plan,Weld County Road 7("WCR 7")is
indicated as a principal arterial roadway with a right-of-way width of 140-feet. The
Town requests 70-feet of right-of-way, (from and west of the section line) be
dedicated to the Town of Erie.
3) Per the Town of Erie Transportation Master Plan,Weld County Road 6("WCR 6")is
indicated as a collector roadway with a right-of-way width of 80-feet. The Town
requests 40-feet of right-of-way,(from and north of the section line)be dedicated to
the Town of Erie.
4) In previous discussions with the applicant the Town has indicated the preferred
haul/truck traffic route (Haul Route 3 in revised Traffic Impact Study) to the site is
WCR 6 via the eastern I-25 Frontage Road. Due to the anticipated volume of truck
traffic, the Town requests:
a. The paving of WCR 6 along the frontage of the property to the Town's
standard cross-section for a Rural Arterial.
b. Installation of streetlights on WCR 6 along the frontage of the property and at
the intersection of WCR 6/WCR 7.
c. That a traffic engineer make recommendation(s) for safety improvements at
the intersection of WCR 6/WCR 7.
d. That a traffic engineer make recommendation(s)for safety improvements at
the intersection of WCR 6/eastern 1-25 Frontage Road and those portions of
WCR 6 not annexed into the Town of Erie.
e. A detailed pavement analysis report of the preferred haul/truck traffic route to
determine structural improvements to existing asphalt roads.
5) The Town requests that the west access into the site align with the existing access on
the south side of WCR 6.
6) The Town requests that a Photometric Plan be provided indicating that a maximum
of two foot candles of illumination at the perimeter property line. In addition,permit
only full cut-off lighting fixtures to prevent unnecessary glare.
7) The Town requests that all oil/gas equipment, including steel rimmed berms, to be
painted to Town standard utilizing the approved color of Dutch Boy Northern Climb.
8) The Town requests that all fencing proposed to follow Town standard oil/gas fencing
of Ameristar Impasse or Stronghold fencing or approved alternate.
9) The applicant's submittal indicates a temporary staging area for pipeline
construction. Will a time limit for operation of this staging area be imposed/written
into the Special Review Permit? In the event no time limit is established the Town
requests that this area be screened as indicated in comment no. 1 above.
10) The applicant's submittal indicates up to a 200-foot tall telecommunications tower on
the site. Is this proposed tower being approved as part of the Site Specific
Development Plan and Special Review Permit?
11) As a reminder,any utility lines needed for the facility installed in Town right-of-way
will require a License Agreement with the Town prior to installation.
The Town of Erie appreciates the opportunity to coordinate with Weld County on issues
