Star Water Resource, Permit # M- 1977-522 Adequacy Response # 1 On behalf of my client L.G. Everist, Inc., I am responding to your first adequacy review letter received on March 24, 2014. I have included your review points that need to be addressed as presented in the letter so the question and answer will be in the same document for easy reference. APPLICATION FORM: Item 3 - Permitted Acreage. On the first page of the application form submitted, the currently permitted acreage is listed as 75 acres. The application form and legal description contained in AM01 , approved in 8/1994, indicates that through AM01 , 35 acres were added to the previous 75 acre permit for a total of 110 permitted acres. It would appear there have been some historic errors in acreage reporting that need to be reconciled through this amendment; however, it seems appropriate that the current permitted acres should be set to 110 acres based on the information in AM01 . The following information is provided based on an in-depth search of the DRMS 's files for Permit # M- 1977-522. I obtained information from the Division files and have included foot notes referencing pages from the Laserfiche files for your review. I did not include copies of these documents since they are already in the file. The permit area can not be 110 acres, because according to the Alta survey done when LGE purchased their parcel from Star Ready Mix, the original property was 97 . 16 acres ±. The intent of the 1994 AM01 was to increase it to 75 acres by adding 57.0 acres (explained on page 3). River Valley Rock (RVR) may have misstated the original permit area by saying that Goodell Brothers, Inc. ( 1977 Permittee) originally permitted 40 acres. This acreage is the area shown on Environment, Inc. Page 2 June 25, 2014 LGE Star Water Resource. the 1977 Reclamation Plan Map' while the Legal Description' for this same filing stated this area to be 54.617 acres. The fact is that the original permit area was issued for only 18.0 acres and this is the acreage that is supported by the application fee paid at that time. In 1977, the application fees were calculated by starting with a base fee of $50.00, then $ 15 .00/acre up to 20 acres, and then incrementally increasing the fee every 20 acres by $5 .00. In this case, it would have been $50.00 + 18 ac@$ 15 .00/ ac. = $320.00, the exact amount paid by the applicant. This acreage is also supported by a 3/6/94 memo3 to the file from Mr. Bill York-Feirn, in which he told RVR that the permitted area was only 18 acres in size. In the following text we will show that the information RVR's consultant submitted does not support a 93 acre permit area but only a 75 acre permit area. In 1977, the Goodell Brothers used the property boundary as the legal description but not the permit area (Eastern Parcel). They then took out the concrete batch plant site and some of the area that they did not plan to mine along the south side, in order to reach the final 18 acres they permitted. The 1977 Reclamation Plan map shows that there would eventually be 40 acres disturbed of the 54.617 acres in the property boundary. The remaining 14.617 acres appears to be the concrete plant site and other areas not to be used by the operation. It seems that they intended to amend the permit later to add 22 acres to make the total 40 acres but never got around to it. The map submitted as a Mining Plan Map' on 7/14/1994 is a little confusing, but if one looks at the title block, the mining limit line is shown as a dash-circle line. By scaling this map into Autocad, we are able to determine that the area circumscribed by this line is about 75 acres. I have attached a scaled down copy of that map where I have color coded the permit boundary line showing what I believe the file supports as the AM01 permit line. It appears that RVR followed the property line in a clockwise direction starting in the northeast corner, then along the east line, the south line until it got near the new river channel and ran 50 feet north of, but parallel to, the north bank of the river until it intersected with the east bank of the old channel. It then followed the old channel until reaching the overflow ditch where it returned to the property line along "O" Street until returning to the point of beginning. The legal descriptions shown in the 5/23/94 application packet describes the south line of the area as being 50 feet north of the northerly bank of the Cache La Pouder River and then running parallel to the river. This suggests that the river corridor was never within the permit boundary. In AM02 we placed this 50 foot setback into the permit and are backfilling along the south bank of the western lake and building the slurry wall pad in this area. In 1994, Mr. York-Feirn asked for photos showing the proposed permit line. Page 3 June 25, 2014 LGE Star Water Resource. stakes. These photon were submitted in response to a January 20, 2000, inspection' which noted that the permit boundary was not marked. In a May 24, 2000, inspection reports the boundary marker deficiency was noted again, and there is also a statement that a surveyor was hired to put the 75 acre permit area on the ground. A letter9 dated June 22, 2000, from the Division to RVR states that the Division had received the photographs. Note: 3 of the 4 pages of photos have a date noted in a stamped receipt area of 7/7/76 but you can tell that all the photos were taken at the same time, and one page has a note saying the photos are in response to the 1 /20/2000 inspection. Further indications that all the photos are from 2000 are as follows: In 1976, a sign was not needed at the mine entrance, and some of the photos show the western side of the property with the fence along "O" Street visible in the background. The original permit was approved in March 1978, so if the '76 date was correct, that would mean the photos were submitted before the permit was applied for. And finally, the location of the markers in the photo appear to correspond with the permit line on the 1994 map. Here is proof that in 1994, the permit area was increased to 75.0 acres. The 1994 Legal Description did not match the area being added to the permit in AM01 . On the permit map they added the area bounded by the 1977 legal description (the East parcel) until it intersected the described offset line, described in the 1994 Legal Description, along the new river bank, This increased the permit area from 18 to 51 .23 acres, a 33.23 acre increase. They then followed the offset line along the north side of the new river channel to a line that followed the east bank of where the old river channel had been until it intersected the west line of the east parcel. This increased the permit to 75 acres by using 23.77 acres of the west parcel. As a recap, it appears that of the 57 acres needed to bring the total to 75 acres, 23 .77 acres was in the western parcel and 33 .23 acres came from the east parcel. In AM02 we have included the remaining 15.63 acres of the West Parcel that was north of the top of the north river bank and leaving out that area south of the north bank of the Cache La Poudre River. This permit area covers 90.63 acres and includes the Varra Companies Concrete Batch Plant Site since it appears to have been included in 1994. Please set the current permitted acres to 110 on the AM02 application form and revise the application as needed unless you can provide documentation to substantiate a different value. DRMS will then adjust the permitted acreage to the appropriate current value through the approval of AM02 in order to reconcile the permitted acreage to current survey data and conditions on the ground. Also see comments on Exhibits C and D regarding total permitted acres. See discussion above. The correct acreage is 90.63 acres. This includes all of the previously permitted areas; 18.0 acres in original 1977 permit; the increase of 57.0 acres in 1994's AM01 to reach the current 75 .0 acres; and the increase in this amendment (AM02) of 15.63 acres. EXHIBIT C - Pre-mining and Mining Plan Map(s) of Affected Lands (Rule 6.4.3): The total acreage(s) reported on the map submitted (52.92+9.36+28.08) gives a proposed permitted acreage total of 90.36 acres. This does not correspond with the acreage listed on page 1 of ' 1/20/00 Inspection report — DRMS- Document # Inspec39860 8 5/24/00 Inspection report — DRMS- Document # Inspec31443 9 6/22/00 Letter — DRMS - Document # Inspec 12044 Environment, Inc. Page 4 June 25, 2014 LGE Star Water Resource. the application form or throughout the remainder of the application (90.63ac). This appears to be due to a 0.27 ac discrepancy between the combined acreage shown on the map for east and west areas (81 ac), and the acreage reported in item (c) on the first page of Exhibit D (81 .27 ac). Please verify the acreage(s) and revise submittal as needed for consistency. Also see comments on Exhibit D regarding total permitted acres. Page 1 of the application form is correct. The map acreage number for the western area is wrong, it should have been 53 . 19 acres and I forgot to fix the map and text numbers to match when doing the final edits. The 81 .27 acres on the first page of Exhibit D is correct. I have fixed the area numbers for the west area on all maps. The acreages in the Reclamation Timetable on page 11 have been corrected as needed. I attached the page that was revised and added the revision date next to the page number. EXHIBIT D - Mining Plan (Rule 6.4.4): Exhibit D as submitted proposes to "relocate" a portion of the southern permit boundary, which currently follows the property/section line and runs through the Cache La Poudre River, to the top of the north bank of the river. This seems to be a practical boundary adjustment; however this would release the currently permitted north bank area of the river from the permit area. Current DRMS policy does not allow for the release of permitted acreage through the amendment process. Therefore, the permittee will need to release this acreage under a subsequent partial release request (perhaps at the same time the request for the industrial parcel is submitted) instead of as a part of AM02. For the purposes of AM02, the current southern permit boundary should continue to be used. Please revise the acreage totals and submitted maps as appropriate. As explained above, the existing Permit does not include the river area, the current 75 acre permit boundary uses a setback of 50 feet from the top of the north bank of the river as its southern boundary. This boundary is shown on the map, but it was never highlighted. The corrected Map Exhibit C-i has fixed that oversight and LGE has included this 50 foot setback area into the permit area so it can be reclaimed and used to provide a place for the proposed slurry wall. To now include the rest of the river corridor would place a costly burden on L.G. Everist, Inc. to address a situation that has existed since the new channel was constructed in 1976-77. We can not find any records that show the previous permittees had anything to do with this change in the river channel and the permit area was not even close to the new channel until the 1994 amendment was approved by the DRMS. With the future release/adjustment in mind, DRMS will need some additional information before approving the proposed release for the area along the southern property boundary. The Division's files do not support an argument that the river corridor south of the north bank of the new channel was ever within the permit boundary, so a release for that area is unnecessary. Once this amendment is approved a release request will be filed for the Varra parcel. At what point (what year) was the channel straightened to approximately follow the southern property boundary, eliminating the historic channel that used to flow along the west side and through the center of the current site? When researching the timing of the river relocation I obtained a Farm Services Administration (FSA) photo dated 1977 that shows the river was diverted into the new channel at that time. The exact date of this photo is unclear but considering it came from the Farm Bureau I suspect it was take in late summer or early fall so they could do crop assessments. I also found a January 24, Environment, Inc. Page 5 June 25, 2014 LGE Star Water Resource. 1977 photo in the Colorado Aerial Photo Service (CAPS) archives that show the channel was nearly complete at that time. It is important to remember that the permit was not issued until 3/23/1978 and then for only 18 acres on the area east of the old river channel. It is clear on both of the 1977 photos that mining had not commenced next to the newly constructed channel nor was the permit area adjacent to it when it was constructed. The dark area on the photos is where mining was to begin and appears to be a brushy area surround by cultivated fields. This is clearly seen if you use an aerial photo stereo pair to review the site. I found a 9/3/1980 photo that shows the mining activities at the site and the relocated river area, this is a CAPS photo too. This photo is the closest to 1981 that shows the lake area already mined and was used to determine the location of the pre- 1981 lake surface area. It matches the 6. 1 acres that the Office of the State Engineer has approved in the current Temporary Substitute Supply Plan for the mine. Copies of the photos are attached for the file, The FIRM Panel dated 1982 submitted in Exhibit G shows the river in its historic channel. If the river was straightened after this site was permitted In 1977, then DRMS would state that the permittee is clearly responsible for the proper reconstruction and stabilization of the new channel within the current permit, regardless if that area was mined or not. In addition Army Corps of Engineers (ACOE) or other regulatory approval may be required. None of the historic permit holders were responsible for moving the river. The photo evidence shows that it was completed in the fall of 1977, and therefore happened prior to any permitting being done in the western area that was added in 1994. My research has never uncovered who was responsible for moving it in the first place. It appears that FEMA issued an inaccurate map by not ground-confirming their mapping. The river had been moved for 5 years before the FIRM map was issued. Furthermore, much of the area through which the river was straightened was completed through parcels of land which were never owned by the permittees. Does the existing northern river bank and site configuration in this area comply with the Weld County and/or City of Greely floodplain development requirements? If the permittee can demonstrate that ACOE approval is not necessary, and that the local floodplain regulatory entity is satisfied with the current configuration of the river bank in that area, it would certainly facilitate DRMS approval of the subsequent release request. As we have shown above, the river area was never disturbed by an operator of this mine. It is not within any Mined Land Reclamation Board permit issued to date, so asking for release is not necessary. And also, because the river area was never within the permit area, it is not LGE's responsibility to make sure it meets ACOE requirements or is in compliance with Weld County or City of Greely floodplain development standards. I suspect the river move predated any Government floodway regulations in this area. The new channel existed prior to permitting and has been in place for 37 years. It withstood flooding on the river in the past and even the 2013 and 2014 flood events have not overtopped the bank. L.G. Everist does not propose entering the river to do repairs or make any change to areas that are not within the permit boundary. The Mining Plan submitted does not discuss any additional mining in the eastern area of the permit; however the reclamation plan map seems to indicate that this eastern water body will be expanded and the shoreline re-contoured. Does the permittee intend to conduct additional mining in this area to expand the lake size? Environment, Inc. Page 6 June 25, 2014 LGE Star Water Resource. No mining is planned in the eastern area. The current Reclamation Plan Map - Exhibit F (Option A) shows how the area would be developed if a slurry wall liner was installed. However, during preparation of this adequacy response, LGE has decided that the area will be reclaimed using Option B. Attached is a new Map Exhibit F Reclamation Map (Option B) that shows the post- 1981 water will be covered with at least 2 feet of fill material leaving a 6. 10 acre lake. It is possible that more lake will be filled, but we do not know how much more will be filled, until construction and grading is done on the western parcel. EXHIBIT E - Reclamation Plan (Rule 6.4.5): The reclamation plan states that the currently reclaimed areas, and areas that may be re-disturbed or will need additional reclamation are depicted on the Current Conditions and Reclamation Plan maps — these acreages do not seem to be shown on the maps provided. In addition, the provided black and white/pattern- fill maps are attempting to depict so much information that they are already difficult to read. Please provide this additional information either on another map, or perhaps provide color keyed maps to depict the information shown. Sorry for the confusion. Attached is a 11 "x17" color map showing the areas discussed. I have labeled it Figure E - Reclaimed Area Map (Option B). I have also provided the acreages of each of the colored areas on the map. The dark green areas are areas that we believe will not be redisturbed during construction of the slurry wall, but in the text a commitment was made to do any reclamation necessary should they be disturbed. DRMS will not allow "Option 1 " as described for revegetation on page 8 of the submitted reclamation plan. Seeding with the approved seed mix will be required. Please remove "Option 1 " from the reclamation plan. DRMS may allow for the release of the site prior to the full establishment of vegetation to facilitate construction activities as outlined in "Option 2". A revised page 8 is attached making the changes you request. L.G . Everist understands that if the owners of the reservoir decided to continue development once back sloping and resoiling is complete, the area would still have to be seeded before the Division would consider releasing that area even if final construction was scheduled to start shortly. The contouring shown on the map provided for reclamation "Option C" appears to result in a large depression that would not allow any surface drainage from the eastern portion of the site. How will the permittee insure that water does not remain standing in the resulting basin, especially after major precipitation events in such close proximity to the river? State Engineer's Office (SEO) Division of Water Resources rules state that storm water will not be retained on site for over 72 hours. I have fixed the contours so it is shown as being backfilled to the same level as the property to the south. This will allow for positive drainage across the site. Thank you for catching this. EXHIBIT F - Reclamation Plan Map (Rule 6.4.6): Please refer to first comment on reclamation plan regarding depiction of acreages to be reclaimed, and/or currently reclaimed. Per your suggestion I have created a color version of the Reclamation Plan Map - Figure E - Reclaimed Area Map (Option B). 1 placed it on 11x17 paper to make it easier to reproduce. The larger scale maps provide the detailed contours that are harder to see on this map. Attached Environment, Inc. Page 7 June 25, 2014 LGE Star Water Resource. is a revised copy of the MAP EXHIBIT F - RECLAMATION PLAN MAP (OPTION B). It has been revised to correct the acreages, to show the modification by the adoption of Option B, fix the owners list and structures list where mistakes were also found, EXHIBIT G - Water Information (Rule 6.4.7): The second paragraph of Exhibit G states that five monitoring wells have been installed on site, however they do not appear anywhere on Exhibit C as stated. Please provide a map showing the locations of these wells, and the associated monitoring well boring and well construction logs for the five new wells. LG Everist will also need to commit to making the monthly groundwater level data collected a part of the annual report submitted to DRMS for this site. Only 4 wells were used not the 5 originally planned. I have added the 4 monitoring wells to Map Exhibit C-1 - Current Conditions Map and provided a new map exhibit in Exhibit G called MAP EXHIBIT G-2 - MONITORING WELL LOCATIONS. The monitoring well bore construction logs are attached and a Typical Monitoring Well Installation Sketch section to show the well construction. Even though only 2 months of data is available, the ground water monitoring data collected for each piezometer is provided. LG Everist will commit to making the monthly groundwater level data collection a part of the permit and provide the information as part of the annual report for this site. EXHIBIT L - Reclamation Costs (Rule 6.4.12): Recalculation of the reclamation bond will be required. Please adjust the bond calculations to include the following: 100% of the cost of the western slurry wall must be submitted. DRMS has not yet been provided with any detailed plans or design specifications for that slurry wall to-date. To qualify for the 20% bonding option, in addition to providing adequate plans and design specifications to DRMS for approval, the permittee will also need to provide construction QA/QC data to support that the slurry wall was installed in full compliance with the design specifications, or pass the SEO testing criteria. So you are aware, the 20% bonding option "policy" for slurry walls is currently under review by DRMS and may not be an available option in the future. I have recalculated the Reclamation Cost estimate using your suggestion of including the Western slurry wall at full cost since the detailed competition plans have not been submitted. LGE may choose to supply the QA/QC and design documents at a later date and request a reduction to the 20% level should the Division still be accepting that option. The existing exposed groundwater lake in the eastern area must be bonded for in some fashion. Bond may be calculated for the installation of a slurry wall to isolate it from the surrounding alluvial aquifer (see paragraph above for slurry wall calculation). Bond for that area may also be determined using a defensible determination of cost for the placement of the amount of fill required to backfill the existing exposed groundwater area to no more than 6.1 acres of exposed groundwater, with the rest of the area backfilled to a level at least two feet above the existing documented static water level. The backfilled areas must then be appropriately sloped and seeded. Areas to be re-sloped, otherwise re-graded, re- soiled, and reseeded should be shown on the provided reclamation plan map. When LGE opted to use Option B, I recalculated the bond to include backfilling the post- 1981 lake area to a least 2 feet above the ground water table. We believe there is enough material on the mine to avoid having to import fill material. If needed shale, could be mined from the reservoir area on the west parcel and used as fill. The slurry wall calculations include installing Environment, Inc. Page 8 June 25, 2014 LGE Star Water Resource. only the west area slurry wall. The Revised Reclamation Cost estimate is attached for your review. EXHIBIT N - Source of Legal Right to Enter (Rule 6.4.14): The exhibit submitted was mislabeled as Exhibit H, but otherwise adequate.. Attached is corrected Source of Legal right to enter with the title corrected. Thank you for catching this. EXHIBIT S - Permanent Man-Made Structures (Rule 6.4.19): As previously discussed, structure agreements will need to be obtained for all structures within 200 feet of the permit boundary. Please note that roadways and above-ground or underground utilities (if present) within 200 feet of the proposed affected area are considered permanent man-made structures. In accordance with Rule 6.4.19, when mining operations will adversely affect the stability of any significant, valuable and permanent man-made structure located within 200 feet of the affected area, the applicant may either: a.) Provide a notarized agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to provide compensation for any damage to the structure; or b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation. c.) where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect" on their utility. Please provide evidence (certified letter to structure owners) that a notarized agreement between the structure owners and the applicant was pursued. If an agreement is unable to be reached, a geotechnical assessment may be provided to demonstrate that the structures shall not be damaged. You must provide information sufficient to demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected land will not be adversely affected. A revised EXHIBIT S - PERMANENT MANMADE STRUCTURES is also provided, showing all owners within 200 feet of the area to be disturbed. Martin Marietta Materials ' structure was removed as it was south of the river (not within 200 feet) and the City of Greeley ' s street was added. Copies of the mailing receipts for the 11 structures of concern are attached. We have received 4 of the signed structure agreement letters to date and one was returned as undeliverable (copies are attached). Additional Information : You will also need to provide the Division with proof of notice publication and proof of notice to surrounding property owners within 200 feet. Any letters from other commenting agencies/entities received by the Division to date have been included with this correspondence for you to review. During preparation of the adjoining owner notices and structure agreement letters I found that an owner had been left off the list. Attached is a revised EXHIBIT O - OWNERS OF RECORD where I added the City of Greeley. Copies of the proof of notices to the surrounding landowners are also attached. We did not get green cards back for 2 notices and one was undeliverable. I have enclosed copies of the USPS receipts for the missing green cards showing the letters were delivered and copies of the mailing receipt. Publication ended on April 30 and the last comment day is May 20, 2014. Attached is a copy of the proof of publication from the paper. Environment, Inc. Page 9 June 25, 2014 LGE Star Water Resource. Presuming that the reservoir ( s ) have been sold to an end user and said end user plans to continue develop - ment in the near future and that this continued development may involve re - disturbing part of the reservoir banks to install armoring and pumping facilities . LGE proposes having an option to ask for reclamation bond release at anytime , if after planting is complete , the owner decides to begin development , then recla - mation will be considered complete , again if a notarized release letter from the owner is filed with the Division . As part of this Amendment it will be necessary to recalculate the surety to include the total disturbance area , and account for the slurry wall to be installed . We have chosen to calculate this bond based on the current plan to install a slurry wall around the western lake only . We have included a cost to complete bank sloping in that area since underwater sloping is not completed at this time . At this time , L . G . Everist has implemented Option B , that is to backfill 8 . 44 acres of post - 1981 lake area leaving the 6 . 10 pre - 1981 lake . This is a change from what was originally proposed involving building a slurry wall around the western lake to address evaporative loss issues . It will be necessary to remove material from the bottom of the reservoir to create a hard bottom on the reservoir . This material will be used to reclaim the post - 1981 lake area of the eastern lake . It will involve placing 138 , 635 cubic yards ( includes swell factor 1 . 12 ) in the 8 . 44 acres to a depth of 2 feet above the ground water level . There is adequate material on site to backfill the lake so none would have to be imported . Material could be removed from the area above the water area in the eastern area or from the bottom of the west lake after dewatering is done for sloping . Most of the area around the eastern lake and part of the upper side of the western area has been seeded and not redisturbed at this time . This reclamation cost estimate is based on the assumption that no more than 90 . 63 acres will need some form of reclamation at any one time . Of this , 22 . 25 acres will need revegetation and resoiling ; 9 . 36 acres is industrial area ; 4 . 26 acres is road area ; 33 . 83 acres would be covered by water that needs to be pumped for sloping . Three areas would not need reclamation the 0 . 68 acres oil facility area , 0 . 87 acre overflow ROW ; the 6 . 10 acres of pre - 1981 lake area and 13 . 28 acres that is reclaimed . The Tables L1 , L2 , and L3 contain all the base information used to calculate this estimate . The disturbed areas include the roads , slurry wall construction pads and the above - water areas around active mining areas . In addition , minor slope shaping may be necessary on the below - water areas in the eastern reservoir to complete the 3h to lv slopes . In this estimate , there will be one certified slurry wall that will be installed by mid - summer 2014 but will not expose water since the site is being dewatered . The cost to backfill the post - 1981 area is added to address Office of the State Engineer regulation and no additional below-water sloping is planned in that area . The slurry wall depth is to the bottom of the key trench and the estimated length is shown in the Table L3 . Should that become available , L . G . Everist may choose to request a bond reduction that would use a factor of 20 % for the Division to do remedial work on the completed liners until OSE certification is accomplished . The total potential water surface area in the western uncertified reservoir area is estimated to be 33 . 83 acres . The dewatering calculations are shown in Table L2 . We rounded the pumping time to the next day and used 72 , 300 gal / day , as a transmissivity number to figure inflow from the aquifer . These figures are then used in the calculations for the bond amount . The slurry wall platforms and slopes above the water line would only need grading and seeding as they will be shaped during slurry wall construction . No dewatering would be needed in the eastern area since that sloping is done . A 627C Cat motor scraper or similar equipment will be used to recoil the area and a 140G Cat motor grader or similar equipment will be used to shape the seed bed , and the resoiled areas . A D8N Cat dozer or similar equipment will be used to shape the underwater slopes on the perimeter of the reservoir and to push fill material into the eastern lake . Permit # M-1977-522 Star Water Resource JUNE 2, 2014 GEOTECHNICAL STABILITY EXHIBIT This information is presented to address the plan to mine within 200 feet of the structures listed in Exhibit S . Mining is completed on areas that were within 200 feet of any structures around the mine . However , a slurry wall installation is planned for the existing lake areas shown on the map . In relation to these slurry walls it will be necessary to create level pads where the slurry walls will be excavated . A slurry wall is typically 3 to 4 feet wide excavated through the gravel deposit into bedrock . This excavation is filled with a bentonite clay and dirt slurry that keeps the walls from collapsing so there is no danger that it will fail and cause damage to structures within 200 feet . During construction of the pad it is necessary to excavate into the existing slope creating a level bench that at its deepest point would be 16 feet below the original slope . The up and down hill edges are then graded 3h : lv to blend with the existing slope . At this site , that means the maximum depth of near vertical highwall is 16 feet high . The closest structure for which there is no damage agreement is " 0 " Street along the north side of the site . This street at its closest point is 84 . 5 feet from the vertical face . The following information is presented using these distances to determine the safety factors that show there would be no impacts to structures within 200 feet of the permit area . Site information shows that the existing slope is graded at 3 : 1 of flatter . The natural angle of repose or friction angle for this gravel deposit is approximately 45 or 1 : 1 . This falls into the parameters listed in Rock Slopes : Design, Excavation and Stabilization, Publication No . FHWA-TS-89-045, Table 1 - Typical Soil and Rock Properties for Sand and Gravel , mixed grain size . This deposit contains no clay lenses or non - conformities that would weaken the working face . The material in the near vertical wall will be in -place sand and gravel and assumed to be cohesion less and having a friction angle (a) of 45 . Using this information we have calculated the factors shown in the following table using the formula FS = TanV =Tang , where e is the slope angle .
