S . , for an order to: 1 ) Amend Order Nos . 407-514 and 535- 104 to include the Codell Formation as to the Application Lands , for the production of oil , gas and associated hydrocarbons from the Codell Formation ; 2) Approve the drilling of up to 15 additional horizontal wells , for a total of 16 horizontal wells , in the approximate 1280-acre drilling and spacing unit established for the Application Lands , for the production of oil , gas and associated hydrocarbons from the Codell- Niobrara Formation ; 3) Require the productive interval of the wellbore to be located no closer than 450 feet from the unit boundaries , and no closer than 150 feet from the productive interval of any other wellbore located in the unit, without exception by the Director; 4) Applicant requests that the proposed wells be located on no more than one well pad per quarter section , subject to Rule 318A; 5) Pool all interests in an approximate 1280-acre drilling and spacing unit established for the Application Lands , for the development and operation of the Codell-Niobrara Formation ; and 6) Subject any nonconsenting interests to the cost recovery provisions of §34-60- 110(7) , C . Pending) . 401O4°- 050 (1412-UP-371 ) Loorn7 APPLICABLE RULES AND ORDERS (available online at: http://cogcc.state.co.us, under"ORDERS") • On April 27, 1998, the Commission adopted Rule 318A, the Greater Wattenberg Area Special Well Location, Spacing and Unit Designation Rule. • On February 19, 1992 (amended August 20, 1993), Order No. 407-87 established 80- acre drilling and spacing units for the production of oil, gas and associated hydrocarbons from the Code!' and Niobrara Formations, with the permitted well locations in accordance with the provisions of Order No. 407-1. • On December 16, 2011, Order Nos. 407-514 and 535-104 established 1280-acre drilling and spacing units for the Application Lands, and approved one horizontal well for each unit, for the production of oil, gas and associated hydrocarbons from the Niobrara Form ation. In support of its Application, Applicant states and alleges as follows: 1. Applicant is a corporation duly authorized to conduct business in the State of Colorado, and has registered as an operator with the Commission. 2. Applicant owns substantial leasehold interests in the below-listed lands ("Application Lands"): Township 2 North. Range 64 West, 6th P.M. Sections 13 and 24: All 3. A map depicting the acreage comprising the Application Lands is attached hereto and incorporated herein as Exhibit A. 4. On April 27, 1998, the Commission adopted Rule 318A, which among other things, allowed certain drilling locations to be utilized to drill or twin a well, deepen a well or recomplete a well and to commingle any or all Cretaceous Age Formations from the base of the Dakota Formation to the surface. Rule 318A supersedes all prior Commission drilling and spacing orders affecting well location and density requirements of Greater Wattenberg Area wells. On December 5, 2005, Rule 318A was amended, among other things, to allow interior infill and boundary wells to be drilled and wellbore spacing units to be established. On August 8, 2011, Rule 318A was again amended, among other things, to address drilling of horizontal wells. The Application Lands are subject to certain aspects of Rule 318A for the Niobrara Formation. 5. On or about December 16, 2011, the Commission entered Order Nos. 407- 514 and 535-104 which, among other things, established 1280-acre drilling and spacing units for certain lands, including the Application Lands, and approved one (1) horizontal well for each such drilling and spacing unit for the production of oil, gas and associated hydrocarbons from the Niobrara Formation. Amendment of Order Nos. 407-514 and 535-104 to Include Codell Formation as to Application Lands 6. Applicant Requests that Commission Order Nos. 407-514 and 535-104 be amended, as to the Application Lands alone, to include the Codell Formation with respect to horizontal wells. 7. With respect to the Application Lands, the 1,280-acre drilling and spacing unit established by Commission Order Nos. 407-514 and 535-104 as to the Niobrara Formation is not smaller than the maximum area that can be economically and efficiently drained by the horizontal wells to be drilled under this Application and completed in the Codell Formation. Authority to Drill Additional Horizontal Wells within the Codell-Niobrara Formations 8. Pursuant to § 34-60-116(4), C.R.S., Applicant requests that the Commission authorize the drilling of additional wells within the drilling and spacing unit established for the Application Lands, as amended pursuant to this Application to include the Codell Formation. 9. Applicant requests that the Commission order authorize up to fifteen (15) additional horizontal wells, for a total of up to sixteen (16) horizontal wells, for the approximate 1280-acre drilling and spacing unit established for the Application Lands, for the production of oil, gas and associated hydrocarbons from the Codell-Niobrara Formations. 2 1 r 10. Applicant states that, for any permitted wells to be drilled under an order of the Commission issued pursuant to this Application, the treated intervals of the wellbore should be not less than four hundred sixty feet (460') from the drilling and spacing unit boundaries, with an inter- well setback of not less than one hundred fifty feet (150') from the treated interval of a well producing from the Codell-Niobrara Formations, absent exception or variance being granted by the Director. Pooling of All Interests in Application Lands for the Development of the Codell-Niobrara Formations 11. Pursuant to the relevant provisions of § 34-60-116(6) & (7), C.R.S. and Rule 530, Applicant seeks an order pooling all interests in the Application Lands for approved horizontal wells drilled within the Application Lands, for the development and operation of the Codell-Niobrara Formations. 12. Applicant certifies that: (i) at least thirty-five (35) days prior to the date of the hearing on this Application, each interest owner for which an address could be located, and who was not already leased or voluntarily pooled, was provided with the well proposal and information required by Rule 530, and tendered either a reasonable offer to lease (in the case of unleased mineral owners) or a reasonable offer to participate in and bear the costs associated with the drilling and completion of, the following wells and (ii) each such interest owner failed to elect in writing to lease or consent to participate in and bear the costs associated with the drilling and completion of, the following wells (each a "Well" and collectively, "Wells"): (a) L.E. Gerkin 1H Well (API # TBD), with a surface location in the NE/4NW/4, Section 13, Township 2 North, Range 64 West, 6th P.M. and a bottom hole location in the SW/4SW/4, Section 24, Township 2 North, Range 64 West, 6th P.M., which is a horizontal well designed to test and produce oil, gas and associated hydrocarbons from the Codell-Niobrara Formations underlying the Application Lands; (b) L.E. Gerkin 2H Well (API # TBD), with a surface location in the NE/4NW/4, Section 13, Township 2 North, Range 64 West, 6th P.M. and a bottom hole location in the SW/4SW/4, Section 24, Township 2 North, Range 64 West, 6th P.M., which is a horizontal well designed to test and produce oil, gas and associated hydrocarbons from the Codell-Niobrara Formations underlying the Application Lands; (c) L.E. Gerkin 3H Well (API # TBD), with a surface location in the NE/4NW/4, Section 13, Township 2 North, Range 64 West, 6th P.M. and a bottom hole location in the SW/4SW/4, Section 24, Township 2 North, Range 64 West, 6th P.M., which is a horizontal well designed to test and produce oil, gas and associated hydrocarbons from the Codell-Niobrara Formations underlying the Application Lands; (d) L.E. Gerkin 4H Well (API # TBD), with a surface location in the NE/4NW/4, Section 13, Township 2 North, Range 64 West, 6th P.M. and a bottom hole location in the SW/4SW/4, Section 24, Township 2 North, Range 64 West, 6th P.M., which is a horizontal well designed to test and produce oil, gas and associated hydrocarbons from the Codell-Niobrara Formations underlying the Application Lands. 3 13. Applicant requests that the pooling order entered as a result of this Application be made effective as of the date of this Application, or the date that the costs specified in § 34-60- 116(7)(b)(I)-(II), C.R.S. are first incurred for the drilling of the Wells, whichever is earlier. 14. Applicant further requests that the orders of the Commission issued pursuant to this Application provide for Applicant's recovery of both: (a) the costs specified in § 34-60- 116(7)(b)(I), C.R.S. and (b) the costs specified in § 34-60-116(7)(b)(II) against or out of the respective interests of nonconsenting parties in the Wells. 15. Applicant states that any horizontal wells to be drilled under this Application will be drilled on the surface of the drilling unit, or on adjacent lands with consent of the landowner, without exception being granted by the Director. 16. The granting of this Application is in accord with the Oil and Gas Conservation Act, found at § 34-60-101, et seq., C.R.S., and the Commission rules. 17. That the names and addresses of the interested parties (owners within the Application Lands) are attached hereto and incorporated herein as Exhibit B. 18. Applicant shall submit a certificate of service for this Application within the seven (7) days required by Rule 503.e. WHEREFORE, Applicant respectfully requests that this matter be set for hearing, that notice be given as required by law, and that upon such hearing this Commission enter its order: A. Amending Commission Order Nos. 407-514 and 535-104, as to the Application Lands alone, to include the Codell Formation, with respect to horizontal wells, in the 1,280-acre drilling and spacing unit established by Commission Order Nos. 407-514 and 535-104 as to the Niobrara Formation. B. Authorizing the drilling of an additional fifteen (15) horizontal wells, for a total up to sixteen (16) horizontal wells, in the approximate 1280-acre drilling and spacing unit established for the Application Lands for the production of oil, gas and associated hydrocarbons from the Codell-Niobrara Formations, with the treated intervals of the wellbore of any permitted wells to be located not less than four hundred sixty feet (460') feet from the outer boundary of the established drilling and spacing unit and not less than one hundred fifty (150') from the treated interval of any well being drilled or producing from the Codell-Niobrara Formations, without exception or variance being granted by the Director. C. Pooling all interests in the Application Lands for any authorized horizontal wells, for the development and operation of the Codell-Niobrara Formations. D. Providing that the pooling order is made effective as of the date of this Application, or the date that the costs specified in § 34-60-116(7)(b)(I)-(II), C.R.S. are first incurred for the drilling of Wells, whichever is earlier. 4 1 E. Providing that the interests of any owners, with whom Applicant has been unable to secure a lease or other agreement to participate in the drilling of any of the Wells, are pooled by operation of statute, pursuant to § 34-60-116(7), C.R.S., and are made subject to the cost recovery provisions thereof. F. Providing that Applicant may recover both: (a) the costs specified in § 34-60- 116(7)(b)(I), C.R.S. and (b) the costs specified in § 34-60-116(7)(b)(Il) against or out of the respective interests of nonconsenting parties in the Wells. G. Requiring that any permitted wells to be drilled under a Commission order issued pursuant to this Application should be drilled on the surface of the established drilling and spacing unit comprised of the Application Lands, or on adjacent lands with consent of such adjacent surface landowner, without exception or variance being granted by the Director.
