FACILITIES (TRUCK PARKING, MAINTENANCE, REPAIR AND OFFICE
ASSOCIATED WITH A CRUDE OIL TRANSPORTATION COMPANY) ALONG WITH
AMENDING THE BOUNDARIES OF USR-1526 TO ENCOMPASS THE ENTIRE AREA
OF LOT B OF RE-3779, IN THE A (AGRICULTURAL) ZONE DISTRICT- RODNEY AND
KAREN STEELY
A public hearing was conducted on March 12, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
EI I hereby certify that pursuant to a notice dated January 30, 2014, and duly published
February 4, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Rodney and Karen Steely, for a Site Specific Development Plan and Use by Special
Review Permit, USR13-0060 (formerly known as USR-1526), (storage of landscaping materials
and equipment, along with employee parking associated with a landscaping business) to include
Mineral Resource Development Facilities, including Oil and Gas Support and Service Facilities
(truck parking, maintenance, repair and office associated with a crude oil transportation
company) along with amending the boundaries of USR-1526 to encompass the entire area of
Lot B of RE-3779, in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney,
made this a matter of record.
e Chair Rademacher advised the applicant that, since Commissioner Kirkmeyer was not
able to be present, he had the option of continuing this matter to a date with the full Board
present. However, if he decides to proceed today, it will require three affirmative votes, or in the
case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining
vote. Mr. Steely indicated he would like to proceed.

El Chris Gathman, Department of Planning Services, presented a brief summary of the
application to amend a USR for an oil and gas service facility, with a storage yard and parking
area, and entered the favorable recommendation of the Planning Commission into the record as
written. The boundaries of the overall USR would be extended to encompass the entire lot, and
the landscaping business will remain. Mr. Gathman described the proposed landscaping and
stated CDOT has required an eastbound to northbound left turn-lane. This is a 70-acre parcel,
10 acres are used by the business, the rest will remain in crop, and parts of the site are in the
100-year floodplain.
Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements, including a shared access off State Highway 392; a traffic impact study
was provided and has been reviewed. The applicant proposes up to 465 trips per day on an
average weekday by 2015; therefore, an eastbound left-turn deceleration lane is indicated. In
response to Chair Rademacher, Mr. Carroll confirmed they are the owners of all three
businesses onsite - so shared access is not an issue. There shall be up to 20 (usually less than
10) crude oil trucks parked there according to the application. In response to Commissioner
Conway, Mr. Carroll addressed the haul route, confirmed there is only one access point on flat
land and they be turning both directions from an internal road gravel road.
e Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions. North Weld County provides water; there is a Condition of Approval to
evaluate the existing sewage for the landscaping business. A new sewer system will be
required. She addressed the Waste Management Plan, and said there will be no washing of
vehicles or fuel service onsite.
E9 Rodney Steely, Colorado Crude Carriers/Fisher Landscaping (also the closest residents),
explained the history of the property and the company. He said Fisher Landscaping is thriving,
so they want to keep that going as well. There will be a five to six bay shop, plus offices, and he
mentioned their only issue has been the access onto such a high-traffic road, and they are in full
agreement with the need for the deceleration lane. He confirmed the trucks will be turning
50/50 both directions, the access will need to be widened, and the rest of the property will
remain in agriculture. He also addressed dust abatement. Trips in and out would likely be 100
per day, but this site is for storage and maintenance, not staging, and their driveway will have
speed limits and Stop signs. In response to Commissioner Conway, he said the landscaping
business customers are few and mostly turn to the west. He stated he doesn't foresee any
traffic problems. Paul Brewer, Project Coordinator, was also present to answer questions.
ICJ No public testimony was offered concerning this matter.
IR In response to Commissioner Garcia, Mr. Steely said the landscaping business is open to
the public; however it is rare that the public comes to this site, and the hours of operation are
adequate for the landscaping business. He said there is one homeowner to the North; however,
they do not share an access. Commissioner Freeman suggested extending the hours of
operation. Mr. Gathman explained Development Standard #5 was put in for the purpose of
clarifying the two different businesses, and it was subsequently removed by assent of the
Board, and the specific reference to the oil and gas facility in Development Standard #4 was

also deleted.
El In response to Chair Rademacher, Mr. Steely indicated he has reviewed, and agrees to
abide by, the Conditions of Approval and Development Standards, as amended.
VII Commissioner Conway moved to approve the request of Rodney and Karen Steely for a
Site Specific Development Plan and Use by Special Review Permit, USR13-0060 (formerly
known as USR-1526), (storage of landscaping materials and equipment, along with employee
parking associated with a landscaping business) to include Mineral Resource Development
Facilities, including Oil and Gas Support and Service Facilities (truck parking, maintenance,
repair and office associated with a crude oil transportation company) along with amending the
boundaries of USR-1526 to encompass the entire area of Lot B of RE-3779, in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as amended and
entered into the record. The motion was seconded by Commissioner Garcia, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:39 a.m.
This Certification was approved on the 17th day of March, 2014.
