However, commercial industries and residential spaces each have their appropriate place. It is our strong belief that this proposal encroaches on this boundary. In reference to this proposed rezoning we strongly oppose this action moving forward for the following reasons: 1) Property value losses will be extreme for residential property owners in this vicinity. This proposed facility will be severely detrimental to the resale value of homes in the area. We have been advised that the commercial zoning and building of this facility will diminish the value of our home by 35%. 2) The reason we built our home in this agriculturally zoned area was for the peaceful enjoyment of country living. The increase in traffic and the 24 hour a day/7 day a week atmosphere of the petroleum industry will not allow for that. 3) The roads in this area are already at maximum capacity. This has been evident with the recent stop light/restructuring at County Road 31 and the restructuring at County Road 35 performed by the state on Highway 392. Not only has there been an extreme increase in oil and gas transportation in this corridor but there also exists a strong agricultural industry and it's inherent commercial traffic. Adding more volume to this already extreme abundance of traffic increases the safety risks for residents, as well as travelers commuting in this area. As concerned citizens we hope that you, as a board, will evaluate this proposal as if it were encroaching on your lifestyle. LLC GREELEY OFFICE I am writing to inform you of our opposition to your proposed zoning change in my area. My family, and I are strongly opposed to this change. Please keep the industrial business in the proper zoning. There are many places to locate this business with out ruining more farm land, and water.Not to mention the increase in traffic. The people that choose to live in the country do so for many reasons. To be outdoors in the fresh air, and, enjoy the peace, and quiet The ability to sit out and enjoy the country will be lost for us if you approve this zoning change. Not to mention the loss of property values. Is Weld County in the position to relocate my family to a home comparable to the one we are in if this place is built?I hope so. The increase of employment opportunities provided, has been staggering. It will continue down this path, as this industry is expanding daily. However, the location of certain facilities, in this industry, should be taken into complete consideration, on the human impact it may have. Health, safety, happiness, and environment, should all be part of this important decision. Our residential home is located on the North East corner of hwy 392 and road 33, in extreme close proximity of the proposed site. We are strongly opposed to the special use permit, to allow Circle B Land company, to build an industrial oil and gas production, storage facility. Reasons are as follows: 1. Encroachment of heavy industrial zoning near residential homes has been proven to dramatically decrease property values and make resale nearly impossible. 2. Environmental concerns: a.) A constant flow of heavy tractor trailers entering and exiting the proposed site, and the use of equipment and tools, will increase noise pollution. EXHIBIT u3R l 1(-°°0 Z b.) The beauty of our westward views would be obstructed and lost forever. A six foot unsightly green slatted fence, trying to hide the ugliness behind it, a huge building, parking lots and the dust rising from the constant flow of vehicles, entering and exiting this facility, is what we would have the privilege of looking at daily. c.) It has been stated that there wouldn't be any washing of trucks and equipment on the site. However, there was no mention of the use of a blaster machine, which can be used to clean oil, gas, and dirt off machinery. I heard that this practice is used for this purpose in this industry. The blaster machine uses materials such sand, soda, and glass. The blaster emits a cloud of dust and the noise is deafening. Will they be using such a machine on the site? If so, what is the proposed plan for clean up? "Water?" What will be lurking behind the green curtain? If unclean equipment is brought in for storage, what is the plan to prevent contamination of the soil? 3. Safety concerns: a.) The unauthorized use of the easement on our property, continually worsens as traffic increases.Westbound traffic exit off the highway prior to the intersection to proceed north on road 33. People traveling south, on road 33, to avoid having to back up at the stop sign, to allow semis turning onto road 33, will drive through the easement and continue onto highway 392. Congestion from pulling off and parking on the easement, has on many occasions, made it impossible for us to enter and exit our own property. All of the easement adjacent to highway 392, has become a new road, with exits and entrances wherever convenient. These inconsiderate, unsafe habits, result into road and property damage, with trash and debris being left behind. When concerns are presented, no solution is ever offered. Instead we are told, we are to maintain the easement. The damage to roads, completely ignored. We've been advised, with two shifts of ten employees, lunch breaks, delivers incoming and outgoing, sales, temporary storage, etc..., daily trips to the proposed facility may well exceed over 250. Issues on our property would definitely worsen. (Pictures enclosed.) * Is there to be any road improvements made by Circle B Land Co. , to help alleviate already existing problems? b.) Highway 392, Rd. 33 and their intersections are already inadequate and unsafe. We have lived on the north east corner of this intersection for 15 years, and during this time, been witness to many accidents, including some fatalities. Head on collisions, vehicles in the irrigation canal, rollovers etc... One year, there were four accidents on our property alone, with damage exceeding $40,000.00. Two thirds of our white vinyl fence, on the south, was destroyed twice, by two separate accidents. Another, our mailbox was hit. Most memorable however, is when two semi trucks, lost control, crashing through our gated entrance. Just minutes earlier, two of our children were waiting there, in this vicinity, for the school bus to arrive.Thank God no lives were lost. (Pictures enclosed.) c.) Children and semis are not a good mix. This being a residential, community, there are school bus stops, on highway 392 and road 33. With the construction of new homes being built, by Turnkey Builders, just north of the proposed site, more stops are likely. Semis frequently, violate the law of coming to a complete stop when school bus lights are flashing and stopped. They tend to do the same at the stops signs on road 33. Just slow down and continue on. Safety of children should always be a priority. In reference to: A. Policy 8.5. (notification of schools)- From response made, by the Eaton School district, I believe it was only through communication by me, Karen Lohmann, that they became aware of the application for a USR, for Circle B. (Safety-Environmental concerns continued) In reference to; March 19th, 2014, an article in the Greeley Tribune: Will corners be cut and compromises made, to make scheduled deadlines? 4. Single family homes and heavy industry are never compatible. The small home based business located in the vicinity, is noninvasive and does not reflect,in any way, the proposed site. There is industrial property on 0 st. for sale that seems to us, would be more suitable for Circle B. (Pictures enclosed: of properties in close proximity and homes somewhat beyond of the proposed site.) 5. Preserve the integrity of our community: The intent, of past planners for this community was obvious, to have residential homes, with small acreage intermingled with agriculture. To allow industrial encroachment into our community, would be extremely detrimental. The negative effects, and emotional affects would way surpass the boundaries of property within 500 feet of the proposed project. Introduction of this kind of use, would only encourage more of the same. Impacting subdivisions like Seeley Lake, Pinnacle park, and beyond. It would be the beginning of the end of the "farm", in Greeley. Do you remember that word? Please take a moment to reflect on the history of that word, and what it represents. What words, what emotions come to mind? "Beauty, peace, tranquility," the reasons we and others moved to this community in the first place. I ask you, I beg you, to take all of the above into serious consideration. Forget the benefit of the almighty dollar. "Respect' the true meaning of agriculture. Make the intelligent, the right decision. A decision with heart, with people, family and community in mind. Since February is National Bus Month, that request is to give Re-5J bus drivers a break, or in the words of the billboard, "Give Us A Brake," in regards to drivers following the law and stopping for school buses that have flashing red lights. Once law- breakers are reported, they receive a $300 fine, six points on their driver's license, and a mandatory court date. Not just this month, but any time you encounter a school bus with . flashing red lights, don't drive around it and endanger students and other drivers. March 28th 2014 Weld County Planning Department 1555 North 17th Ave Greeley Co. 80631 RE: Case#USR 14-0002 To Whom It May Concern: We are writing this letter in opposition to the proposed change of land use on the Northwest corner of WCR 33 and Highway 392. We recently purchased 4 acres of land on the west side of WCR 33 and there will be no physical structures or natural landscape between us and the proposed building for Bill Barrett's facility. One reason we chose our building site was because it is not a direct traffic corridor to the City of Greeley going North and South. In addition, we are an agriculturally based family that has raises farm animals as well as we have two young sons that play outside frequently. Increased traffic due to Bill Barrett's facility will endanger the safety of not only our animals but more importantly our children. We are owners of a local construction company and have had recent experience building similar facilities for the oil and gas industries. There is a proper process as well as placement for facilities such as Bill Barrett's facility. Weld County Road 33 and Highway 392 is NOT the proper place for such a building and we do not feel that Bill Barrett's company has researched this process nor placement adequately.This letter is not an intent to be unsupportive of the oil and gas industry in Weld County, but rather a letter of extreme concern about proper placement of oil and gas facilities.With our past experience within this industry there are industrial zoned lots/acreage available to build such buildings. The location of the proposed entry to the Bill Barrett facility on WCR 33 is a bad idea.The angle of the current bridge is difficult to maneuver a pickup and trailer through coming from either direction off of Highway 392. We have watched several oil trucks not manage this maneuver correctly which could result in several accidents. Again, another danger in allowing the proposed facility to be built. Allowing this facility to be constructed will also impact our home values. Resale values on homes in a major traffic corridor of oil trucks do not fare as well as homes that are on less travelled county roads. In addition, homes near an industrial or commercial building lack in value as well. We feel we will see the resale value or appraised values drop on our current or future homes. We have not started construction on our own home but have started building our neighbors house. Currently, neither of us are sure we want to move forward on either of the homes not knowing the state of the value of our homes. We feel it is important that the Weld County Commissioners take into consideration the points that we have made. Please ask yourself, is this facility so important to risk the lives of our children? Or our animals? Or the safety of the citizens of Weld County? Our answer is NO and hopefully yours will be as well. Colorado is beautiful Tourists flock here from all over the world in search of something magnificent, something breathtaking—but not something that will literally take away their breath. They do not come here to see the world's tallest sky scraper or cathedrals made of stone;they come to witness, hear, and to smell the greatness left in nature. Indeed, our Rocky Mountains are the image of tranquility and wildlife in bloom but there is more of it beyond the mountains, and it lives in my neighborhood. We came to Greeley, Colorado for a taste of country life and though we may not raise livestock of our own, we share our home with many animals. Flocks of migrating birds find sanctuary in the large trees scattered throughout residential areas. Owls hoot soft words in the night as I lay down to sleep. I once had a deer grazing in my fields. Even the eerie cries and yipping of the coyotes is a sign that the natural world still has the will to endure just outside my own dwelling. But now, with every rumbling truck that thunders down the road a flock of birds fly away,unsure of the once safe place to rest. No longer do the owls tell me "good night". The coyotes have not been heard for months. Although the oil and gas industry has been a positive monetary gain for our county and state we feel that this is an encroachment on our lifestyle. There are other properties better suited for this type of facility. Let's take a look at JBS, Leprino, and many other corporations (including oil and gas companies)that have come into our city and county and have updated older facilities. They have made use of existing commercial properties that are better suited for this type of industry and traffic patterns. There are many properties in this area(O Street,Highway 34 east, and the Highway 85 corridor)that are similar in size and not at all near residences with better highway arterials. A prime example is the property at the corner of County Road 31 and Highway 392 (just one mile west),which already has turning lanes and a traffic light in place.-1n�Q�yingtly taxes is the ultimate oal of ' sui a e. There is a very high water table in this area. In fact, none of the homes in this area have basements due to this high water table. This brings the question of how safe it is for a business of this size to be putting a leach field next to the#2 irrigation canal. How can we be sure there won't be seepage into the irrigation canal?? The traffic to be created by their employees and vendors will create a minimum of 100 more visits a day to the stop sign at County Road 33 and Hwy. 392 if you take into consideration coming to work, leaving for lunch, coming back from lunch, and leaving for the day. This is only taking into consideration the 25 employees they have stated on their proposal and not including the vendors and large equipment that will be entering and exiting the facility. They state that this will all be done Monday-Friday with time variances from 6 AM to 7 PM. We all know that oil and gas support equipment run 24/7 and this is a deceptive statement by Bill Barrett Corporation. Do you realize that a semi tractor/trailer cannot even make the corner to turn north on County Road 33 whether coming from the east or west on Hwy 392,with a vehicle at that stop sign? We have to back up for these situations. How can this be done when you have vehicles stacked up at that stop sign because of the increase in volume of vehicles. We have lived at our property since 1996 and have seen an alarming increase in traffic since that time The safety of all property owners and anyone traveling County Road 33 south into Greeley is becoming very concerning without adding any additional vehicles to this scenario. Are the county and state monetarily prepared to restructure the intersection with turning lanes and traffic lights as what had to be done at County Road 3l\? We built our home here because of the unobstructed view of the Rocky Mountains and the peacefulness that comes with country living. This facility will take away all of this fXHIBff t.Y (1 S enjoyment,not to mention the wildlife that are frequently spotted. We frequently see fox, coyotes,owls,hawks, rabbits,and even eagles. The commotion and light pollution will force them to move out and take away that enjoyment, as well. That would narrow down the search field. Regardless, our comments are very minimal since the access is down the county road first. The expected site generated traffic is small enough that it does not trigger the threshold for when CDOT would ask for a traffic study even, let alone increase the traffic using the Hwy/county road intersection by greater than 20%. The permittee doesn't have to do anything with us. Our ROW request for this stretch of highway is 100' from centerline, if that much is not already present. Regarding the "This intersection is too busy for further development" discussion I'm afraid you'll have to go that alone with your citizens. Since CDOT does not have land use authority and there is not a direct access to the highway, our official response to that type of questioning is "We have no comment". My wife and I built a home 1/2 mile north of Hwy 392, along Road 33, on the south east corner of our family farm, ten years ago. I have lived on this farm since 1969 and farmed this piece of land for 21 years. Our farm has been in our family for three generations, bought by my Great Grandfather(William J Moore) in 1917. He farmed it, then my Grandfather, then my father and now me. We have a young son, and if it is his desire, we would like him to continue this legacy. We are now three years shy of this being a centennial farm. Our primary concern with the Oil and Gas storage facility is that first and foremost this is agricultural land. Although the BBC wishes to convince you that the Oil and Gas storage facility would be simbiotic with agriculture, it is not. It is like suggesting that standing by a tree makes you able to sprout leaves and produce fruit. It would be a commercial, industrial type building and no matter how"pretty" they make it, it would be inconsistent with the farms, homes and small businesses in this area. Preserving agriculture seems to be low on most peoples lists and that is why we have always been so proud to live in a county that makes it a priority—right to farm, meaning agriculture comes before everything else. As the fifth county in the nation in total market value of agricultural products sold, this is not an industrial commercial area—it is a farming area, and there are no other businesses like this one in the area. There are plenty of locations along Hwy 85,just 3 miles or so away from this site, where there are commercial industrial buildings,just like this one. We firmly believe that or another similar location is much more fitting for this type of business. We are not opposed to the Oil and Gas industry. Right now, we have an oil company drilling on our land. It is an eyesore, but thankfully in a few months, they will be finished and move out leaving only the oil tanks. The Bill Barret building, however,will not be temporary, and from their plans, it looks like they intend to double it's size further down the line. The junction at County Road 33 and Hwy 392 is one I commonly use when delivering crops. In a large farm truck the extra traffic created by the business would be very inconvenient and make my deliveries more dangerous. I also drive my tractors on that road (although I try to only do this when absolutely necessary). The traffic along that road is generally inconsiderate of farm trucks and tractors, and the more traffic there is, the more hazardous it becomes for me. Most people try to overtake the farm truck and/or tractors as quickly as possible using little caution, and several years ago, I was in an accident (caused by the other driver)who impatiently tried to overtake me while I was turning left— running into the side of me and causing me a minor head injury. The more traffic there is along Road 33, the more these incidents will grow. For a simple, rural farming community, this building will only make farming more difficult. County Road 33 is getting increasingly busy, especially during the early morning and evening commute's. We drive our children to a school in Greeley and have to go down to the stop sign on Rd 33 and 392. We are noticing a significant increase in large vehicles, especially semi-trucks and it is always very hazardous when they are turning onto Road 33. The road simply isn't very wide and they always have to drive into the other lane—often they drive into it completely. To have an entrance to a commercial facility near there would make the situation worse. The road simply isn't large enough. In the proposal, BBC states that vehicles from their facility will make approximately 60 trips a day. There will also be other vehicles(such as semi's and courier's etc). That is a LOT of extra traffic to a junction that is already straining with the current traffic. Our biggest concern with this business is if you give them permission to build here, then it will open the door for many more commercial industrial type buildings and businesses to move in along this road. At that point, there won't be an agricultural priority. We know that nobody lives around commercial industrial areas—it is simply undesirable and the two rarely co-habitate. Our experience with oil support businesses show they may say most anything to get their foot in the door. Once they have built and are established, they can change things and at that point, and very little can be done about it. There is a water tank company that has built some large water tanks just south west of our property. To get to the tanks, they have to drive along a farm road. We had a verbal agreement with them regarding several things. Presently, they are yet to uphold their end of the deal. In hindsight we regret that we agreed to allow them on our property at all and will consider them tresspassers in the future. We hope you will remember that this is an agricultural community and most people living around here want it to stay that way. This business will not fit in and will cause much angst to the farms and families living close by with increased traffic, and may open the door to other similar businesses changing the rural lifestyle of this area completely. We don't want that, and ask you to vote against this proposal.
