DISTRICTS (OFFICE AND EQUIPMENT STORAGE FOR A CONCRETE
CONSTRUCTION COMPANY) PROVIDED THAT THE PROPERTY IS NOT A LOT IN
AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN
FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING
SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT— INEZ GUTIERREZ
A public hearing was conducted on July 16, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
ID I hereby certify that pursuant to a notice dated June 11, 2014, and duly published
June 16, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request
of Inez Gutierrez, for a Site Specific Development Plan and Use by Special Review Permit,
USR14-0007, for a Use permitted as a Use by Right, Accessory Use or Use by Special Review
in the Commercial or Industrial Zone Districts (office and equipment storage for a concrete
construction company) provided that the property is not a lot in an approved or recorded
subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling
subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made
this a matter of record.
Diana Aungst, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She noted there are an adequate number of parking spaces and reviewed
surrounding land use. The site is in proximity to Greeley, there is mature landscaping and a
fence already on the site, and the site is currently under violation. She stated no
correspondence from surrounding property owners was received and noted this item came
before the Board for a Change of Zone last year. She showed maps and images of the site.

E Don Carroll, Department of Public Works, reviewed the location and provided a brief
overview of the transportation plans and requirements. He stated the applicant estimates
around 10 truck trips per day, which is not a large impact.
Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions: Greeley provides water, there is a four-person septic system, there will be a
port-a-potty on site for the drivers, and there will be no vehicle equipment maintenance or
washing.
e John Gutierrez summarized the project and explained photos showing refuse on the
property; he explained that rip-rap is constantly being moved to and from the site, because
when they demolish concrete they keep it to provide rip-rap to ditch companies and other
projects.
El No public testimony was offered concerning this matter.
Commissioner Kirkmeyer addressed Development Standard #4, and asked the applicant if
the hours of operation from 7:00 a.m. to 5:00 p.m. were adequate. He said he was fine with the
hours. Commissioner Kirkmeyer asked that the word "existing" be inserted prior to "screening"
Development Standard #5.
El In response to Chair Rademacher, Mr. Gutierrez indicated he has reviewed, and agrees to
abide by, the Conditions of Approval and Development Standards, as amended.
El Commissioner Kirkmeyer moved to approve the request of Inez Gutierrez for a Site
Specific Development Plan and Use by Special Review Permit, USR14-0007, for a Use
permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or
Industrial Zone Districts (office and equipment storage for a concrete construction company)
provided that the property is not a lot in an approved or recorded subdivision plat or part of a
map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as amended and
entered into the record. The motion was seconded by Commissioner Conway, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:55 a.m.
