RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF CERTAIN
PUBLIC ROAD RIGHTS-OF-WAY IN THE TOWN OF CARR, COLORADO - TOM
PARKO ON BEHALF OF WELD COUNTY DEPARTMENT OF PLANNING SERVICES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board is authorized to vacate public road rights of way pursuant to Part 3
of Article 2 of Title 43, C.R.S., and Chapter 17 of Article VIII of the Weld County Code, and
WHEREAS, the Board has been presented with a Road Petition from Tom Parko, on
behalf of Weld County Department of Planning Services, 1555 North 17th Avenue, Greeley, CO
80631, a copy of said petition requesting vacation of a portion of right-of-way for certain Public
Road rights-of-way, and a list of the adjoining property owners marked Exhibit C, being more fully
described as follows:
The entire public road right-of-way of 2nd, 3rd, and
6th Streets, along with the alleys running
North-South and East-West, located within
Section 27, Township 11 North, Range 67 West of
the 6th P.M., Weld County, Colorado; being further
described and depicted in Exhibits A and B,
attached hereto
WHEREAS, the County Attorney's Office and Departments of Public Works have
recommended approval of said request since that portion of said right-of-way is not needed for the
safety and welfare of the traveling public, and
WHEREAS, the Board, after notice and at a public hearing, was presented with evidence
of a need within the Town of Carr, Colorado, to vacate certain public road rights-of-way, and
WHEREAS, any persons owning dedicated and recorded easements and rights-of-way
for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation
by Weld County, and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public showing that the vacation of that portion of
right-of-way which is described above will not leave any land adjoining the roadway without an
established public road or private access easement connecting the land with another established
public road, and
WHEREAS, after review, the Board finds that it is advisable to vacate certain public road
rights-of-way in the Town of Carr, Colorado, as shown in Exhibit A, described more specifically in
Exhibit B, copies of which are attached hereto and incorporated herein by reference, and

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Road Petition from Tom Parko, on behalf of Weld County Department
of Planning Services, be, and hereby is, accepted.
BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is
described above be, and hereby is, vacated.
BE IT FURTHER RESOLVED by the Board that this action shall not be construed to affect
any private easements, including utility easements which may exist within the public road
rights-of-way.
BE IT FURTHER RESOLVED by the Board that any change in ownership interests or
rights of adjacent property owners as a result of this action shall be in accordance with State law.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution and the attached Exhibits in the records of the Weld County
Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 30th day of July, A.D., 2014.

RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF CERTAIN
PUBLIC ROAD RIGHTS-OF-WAY IN THE TOWN OF CARR, COLORADO - TOM
PARKO ON BEHALF OF WELD COUNTY DEPARTMENT OF PLANNING SERVICES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board is authorized to vacate public road rights of way pursuant to Part 3
of Article 2 of Title 43, C.R.S., and Chapter 17 of Article VIII of the Weld County Code, and
WHEREAS, the Board has been presented with a Road Petition from Tom Parko, on
behalf of Weld County Department of Planning Services, 1555 North 17th Avenue, Greeley, CO
80631, a copy of said petition being attached hereto and included by reference, requesting
vacation of a portion of right-of-way for certain Public Road rights-of-way, being more fully
described as follows:
The entire public road right-of-way of 2nd, 3rd, and
6th Streets, along with the alleys running
North-South and East-West, located within
Section 27, Township 11 North, Range 67 West of
the 6th P.M., Weld County, Colorado; being further
described and depicted in Exhibits A and B,
attached hereto
WHEREAS, the County Attorney's Office and Departments of Public Works have
recommended approval of said request since that portion of said right-of-way is not needed for the
safety and welfare of the traveling public, and
WHEREAS, the Board, after notice and at a public hearing, was presented with evidence
of a need within the Town of Carr, Colorado, to vacate certain public road rights-of-way, and
WHEREAS, any persons owning dedicated and recorded easements and rights-of-way
for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation
by Weld County, and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public showing that the vacation of that portion of
right-of-way which is described above will not leave any land adjoining the roadway without an
established public road or private access easement connecting the land with another established
public road, and
WHEREAS, after review, the Board finds that it is advisable to vacate certain public road
rights-of-way in the Town of Carr, Colorado, as shown in Exhibit A, described more specifically in
Exhibit B, copies of which are attached hereto and incorporated herein by reference, and

This right of way forms a boundary with another county, state, or incorporated municipality:
•*A public right of way that borders another jurisdiction may not be vacated without the approval of both the Weld County Board of County
Commissioners and the goveming body of the other jurisdiction.
Background and Purpose of ROW and Alley Vacation in Carr:
Weld County and the residents of Carr believe it's in the best interests to vacate all of 6th, 3rd and 2'
Streets as well as all of the alley's that run north/south and east/west.
Why? Over the past couple of decades structures have been built in the right of way and alleys and
historical records coupled aerial photos suggest that the streets and alleys listed herein were never
utilized by the traveling public or the residents. By vacating the Streets and Alleys the owners will gain
title to the centerline and will meet current codes pertaining to setbacks, etc.
County staff has met with the residents of Carr and held an open house to discuss the vacations. During
the open house all of the residents present agreed to pursue the vacation process. Staff has mailed
notifications to all the residents and also contacted the utility service providers to ensure that there are
no public utilities in the streets and alleys proposed to be vacated. The utility companies gave the "all
clear".
If the Commissioners pass a Resolution vacating the Streets and alleys listed herein all of the lots in Carr,
both improved and unimproved, will retain access. No landlocked parcels will be created. Staff from
both Planning and Public Works has been involved in this process and two (2) work sessions have been
held with the Board to update them on the status. The last work session the Board gave staff direction
to proceed with the vacation process and also agreed to initiate the process on behalf of the residents.
Affirmation
By submitting this application, all undersigned Petitioners understand and agree that the Board of County
Commissioners may approve or deny the petition in whole or in part; reserve any and all current utilities,
easements, and other encumbrances currently existing on the right of way; impose other provisions as the Board
deems appropriate.
Petitioner(s) agree to abide by the Board's resolution vacating the right of way, and to pay for all costs associated
with the vacation, including publication, notice, and recording the resolution with the Weld County Clerk and
Recorder.
Petitioner(s) affirm that they have complied with Article VII of Chapter 17 of the Weld County Code, and with
Article 3 of Title 42 of the Colorado Revised Statutes. Petitioner(s) understand that title to any vacated right of

Weld County is in the process of working with the residents of Carr to vacate certain alley's and streets. Over
the last couple of years the County has noticed issues with residents building in platted streets and alleys.
Following up with the residents and looking at historical maps and aerials we realized that many of the streets
and alleys are not used for access. The County Commissioners and staff have met with the residents of Can and
they would like the County to pursue vacation on all of 6`h, 3rd and 2°d Street as well as all the alleys that run
