RE: APPROVE CERTIFICATION OF WEED ENFORCEMENT LIEN - FRANK RAMOS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 15-2-70 of the Weld County Code, the Board of County
Commissioners may certify to the Weld County Treasurer any assessment for weed
enforcement work not paid within 33 days, to constitute a lien against each lot or tract of land
until paid, and
WHEREAS, the Vegetation Management Specialist performed weed enforcement work
on property owned by Frank Ramos, 4709 County Road 38, Platteville, CO 80651, on property
described as Parcel #106135000025, Section 35, Township 4 North, Range 68 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, a Billing Invoice was sent by Certified Return Receipt mail on July 18, 2014,
in the amount of $273.60 and evidence of delivery and receipt was not received, to date, and
the Billing Invoice has not been paid, and
WHEREAS, after review, the Board deemed it advisable to continue the matter to
November 17, 2014, to allow staff to investigate the matter further, and
WHEREAS, after review on November 17, 2014, the Board deems it advisable to certify
a lien against the property, described as Parcel #106135000025, in the amount of$273.60.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that a lien against the property, described as Parcel#106135000025, in
the amount of $273.60, be, and hereby is, certified, pursuant to Section 15-2-70 of the Weld
County Code, because of failure to pay within 33 days of the completion of weed enforcement
work.
BE IT FURTHER RESOLVED by the Board that the Weld County Treasurer be, and
hereby is, authorized to place said lien against each lot or tract of land under the parcel
numbers described above, in accordance with Section 35-5.5-109(5)(a), C. R., S., until such lien
is paid in full.

The following landowners have failed to pay their enforcement bills. Letters were mailed to the
certified mail that a lien was being requested at the
landowners on October 27 both regular mail and
Monday,November 3 meeting with the Board of County Commissioners.In compliance with County
Code, Section 15-2-70,Failure to Pay Assessment, I request that the weed enforcement bills listed
below be certified by resolution by the Board of County Commissioners to the County Treasurer to
be collected as taxes in accordance with Section 35-5.5-109(5)(a) C.R.S.
The amount due is $1336.80 for the property owner Franklin Hobart 204 W 6th Street Crooks, SD

Our records show you to be the owner of the property detailed above. Kerr-McGee Gathering
LLC would welcome the opportunity to discuss the possibility of a pipeline right-of-way
corridor across a portion of your property. That would begin with our request for your
permission to survey possible locations for said corridor. Prior to granting that permission we
would be glad to discuss the project and the route options, with your input,that would be
surveyed. If the survey is performed and a feasible route for the pipeline corridor is determined
we will make you an offer to purchase a right-of-way agreement. Granting permission for the
survey does not obligate you to grant a right-of-way for the project.

HDX Weed and Grass Killer Concentrate kills unwanted plants by inhibiting the
production of a substance found only in plants. It enters through the sprayed foliage and
moves down to the roots. Avoid direct spray or drift onto desirable plants, lawn grasses,
shrubs and trees. Protect desirable plants and vegetation with a piece of plastic or
cardboard. If desirable plants are accidently sprayed, wash with water immediately. Any
HDX Weed and Grass Killer Concentrate that is not absorbed by the plant is broken
down into natural materials. This product has no soil activity. Do not mow, cut or
otherwise disturb treated vegetation for at least 7 days following application. Most
treated weeds usually show initial symptoms in 2-4 days and complete kill in 1-2
weeks.

When I spoke with Frank Ramos he indicated that if the label told him to use 4 oz/gallon then
he would go with 6 oz/acre. If it called for 6 oz he would use 8 oz. So, my best understanding is
he was somewhere between 4 oz to 6 oz/gallon. This would put him at a 2 to 5% solution.

If he sprayed on the 18th of June, and we came in on the 26th of June to carry out the
enforcement we should have seen some symptoms. The thistle only that he targeted still
looked healthy and there was no indication of death on any of the surrounding plants.
I asked what weeds Frank Ramos targeted in his spraying job and he indicated that he treated
the thistle. We had also asked him to address the hoary cress and Russian knapweed that was
getting started on the property. Glyphosate is ineffective on Russian knapweed. The plant binds
it up so that it won't kill the plant.
The enforcement used a combination of Milestone and Telar so that we could effectively target
all thistle species, hoary cress and the Russian knapweed. These products are also labeled for
use near Cottonwoods and in cattail areas up to the waters edge. The formulation Frank Ramos
purchased technically is for use in yard settings. The label does mention preparing for wildlife
food plots. The label does not mention use near water.
We have had contact with Frank Ramos every year since 2006.
The 20% administrative fee could be withheld from the bill. This would bring the bill down to
$228.00 instead of the $273.60 as it stands now.
