WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated August 24, 2011, the Board approved the application of Dietzler Water Resources Corporation, 4970 Varsity Drive, Lisle, Illinois 60532, for an Oil and Gas Support and Service Facility (water supply and storage) on the following described real estate, to-wit: N1/2 NW1/4 of Section 13, Township 10 North, Range 61 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on April 23, 2012, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Pawnee Water Management / Halliburton Energy Services, Inc., with terms and conditions being as stated in said agreement, and accepted Performance Bond #K08358989 from Westchester Fire Insurance Company, 436 Walnut Street, Philadelphia, Pennsylvania 19106, in the amount of$270,283.00, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend partial release of said collateral, in the amount of$229,740.55. WHEREAS, the Board has been presented with replacement collateral in the form of a Bond Rider to Performance Bond#K08358989, from Westchester Fire Insurance Company in the amount of$40,542.45, to serve as warranty collateral for a period of two years. Following, please find a few additional comments/clarifications,further described in the attached"IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS" (Doc.#2012-1064),as detailed in Section E.-8.0, pages 14-15. In addition to those items you listed below, please submit: 1. A letter/email from the participants (Halliburton Energy Services, Inc.), requesting a partial release of collateral and indicating the dollar amount to be released. Generally this amount is equal to eighty-five (85%) of the project collateral that was originally submitted. In this case,85% of the original project collateral of$270,283.00 would come to$229,740.55 to be released. 2. "Warranty Collateral" in the amount of fifteen percent (15%) of the value of the improvements as shown in the agreement. In this case,15%of the original project collateral of$270,283.00 would come to$40,542.45 to be submitted. Collateral requirements can be found in Section E.-7.0, pages 10-14 of Doc.#2012-1064. As we discussed on the phone, perhaps Halliburton would prefer to procure a bond reduction rider for: Performance Bond#K08358989 from Westchester Fire Insurance Company. Upon receipt of the above-mentioned documents, and those you mentioned below, the County will review the documents. Following acceptance of the documents,the Weld County Clerk to the Board will be contacted and the collateral release request placed on the BOCC (Board of County Commissioners) Hearing Agenda.
