HomeMy WebLinkAbout20140329.tiff RESOLUTION RE: APPROVE CONSENT TO EXCEPTION LOCATION REQUEST FOR ANSCHUTZ O'BRIEN 5-61-33-57H WELL AND AUTHORIZE CHAIR TO SIGN - BILL BARRET CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Exception Location Request for the Anschutz O'Brien 5-61-33-57H Well between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Bill Barrett Corporation, with terms and conditions being as stated in said request, and WHEREAS, after review, the Board deems it advisable to approve and consent to said Exception Location Request, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Exception Location Request for the Anschutz O'Brien 5-61-33-57H Well between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Bill Barrett Corporation be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Exception Location Request. Box 758 1150 "O" Street Greeley, Colorado 80632 Re: Exception Location Request for the Anschutz O'Brien 5-61-33-57H Well Dear Mr. Barker: In 2012, Bill Barrett Corporation ("BBC") drilled the Anschutz.O'Brien 5-61-33-57H (Horizontal) Well (API 05-123-36165-02) located in Section 33-T5N-R61 W, Weld County, Colorado. As we discussed, and as shown on the well completion diagram I provided, this well inadvertently strayed toward the unit boundary, resulting in a setback of 448' for a portion of the "treated interval" (i.e. stimulated section)of the wellbore. This is 12' less than the COGCC unit boundary setback requirement of 460' according to (spacing) Order 535-4. Due to this minor deviation, BBC is requesting Weld County's consent to an "exception location" to Order 535-4 for the well, including the treated interval of the wellbore less than 460' from the unit boundary abutting the S1/2 of S34, T5N, R61W, in which Weld County, according to its records, owns the mineral estate, This consent will be provided to the COGCC to support BBC's request for an exception location. When we drilled the Anschutz O'Brien well in 2013,the horizontal leg apparently strayed 12 feet (448'versus 460')for a portion of the well towards the unit boundary line adjoining the S1/2, Sec. 34, TSN/R61W. Normally, we would identify the offset mineral owner and ask for a waiver of the setback. However, after 2 reviewing, literally,over 100,000 title documents filed against this tract,we were unable to pin down the mineral ownership. Our best guess is that Weld County may be the mineral owner. This was all clearly explained to the COGCC with the completion report, which included the attached well diagram. Now, almost a year later, and with the departure of Thom Kerr, with whom I discussed this issue, the staff is coming back and telling us we may need to shut this well in until this "encroachment" issue is resolved. So, two questions: 1. Does Weld County believe that it owns this mineral tract(assuming you have a relatively easy way to obtain this answer)? 2. If so,would Weld County be willing to provide a waiver of the setback/ Thanks for any help you can provide.
