HomeMy WebLinkAbout20140456.tiff HEARING CERTIFICATION DOCKET NO. 2014-04 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0052, FOR A 192-FOOT TALL TELECOMMUNICATION TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT -ANADARKO E&P COMPANY, LP A public hearing was conducted on February 19, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: Q I hereby certify that pursuant to a notice dated January 16, 2014, and duly published January 21, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Anadarko E&P Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0052, for a 192-foot tall Telecommunication Tower in the At torney,County A (Agricultural) Zone District. Brad Yatabe, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written, and reviewed nearby USRs and land use. The site is near the Towns of Frederick and Erie, Dacono and Broomfield. The closest residence is 60 feet from the north property line. No related correspondence has been received. No lights, signs, landscaping or screening are proposed, although the referral from Broomfield did indicate concern regarding the Tower's height and lighting, which the applicant has addressed. She showed images of the site and adjacent area. El Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. The access point is off of County Road 12, and shall be graded and drained for all weather access. County Roads 12 and 7 have been annexed by the Town of Erie. This is an unmanned tower. It is outside the geo-hazard area, but a Geo-Hazard Plan was submitted. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and indicated no concerns. CC CR ,---VL ,Pw , H � 3 a o ,y 2014-0456 PL2254 HEARING CERTIFICATION -ANADARKO E&P COMPANY LP (USR13-0052) PAGE 2 El Elizabeth Smith, Anadarko, stated they are proposing to construct a 192-foot tower on their existing salt-water injection facility site to provide communications to their integrated operations center located in Evans. She said these towers are crucial in emergency response efforts, and confirmed this tower will not be lighted, per FAA regulations, as it is just under 200 feet. Ryan Rolsmeyer, Anadarko, explained the frequencies used, which are coordinated through the Federal Communications Commission. In response to Commissioner Kirkmeyer saying the County may want to put a repeater on this tower, Mr. Rolsmeyer said the company's general policy is to allow additional outside users, as long as it does not interfere with their load requirements. Ei No public testimony was offered concerning this matter. El Ms. Aungst stated the Firestone Fire Protection District referral requested the site be allocated a specific address in order to locate it in case of an emergency. Commissioner Kirkmeyer suggested adding a condition requiring an address for the site. She noted Condition of Approval #1.B states the applicant will attempt to address the concerns of the Department of Parks and Wildlife, and Ms. Smith said the tower will be built in August after the eagle's nesting season, and mentioned there is an eagle's nest a half mile from the site. Commissioner Kirkmeyer suggested the deletion of Condition of Approval #1.C, regarding Federal Aviation Administration regulations, as redundant, which was done by assent of the Board. She also noted, in regard to Condition of Approval #1.E, that access has already been determined by the City of Evans, and numbers provided, so that information may be inserted here. Commissioner Kirkmeyer requested an additional sentence in Development Standard #3, stating that other service providers shall be allowed "as long as they do not interfere with the Public Safety Communications of Weld County and meet the structural requirements of the tower." The last part of the addition was suggested by Anadarko; done by assent of the Board. • In response to Chair Rademacher, Ms. Smith indicated she has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Kirkmeyer moved to approve the request of Anadarko E&P Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0052, for a 192-foot tall Telecommunication Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
