RE: RECORDED EXEMPTION NO. 280 - MCKAY LAND AND CATTLE COMPANY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 3rd day of October, 1977 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of the McKay Land and Cattle
Company, located on a parcel of land described as the East Half
of the Southwest Quarter of Section 28 , in Township 6 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, more par-
ticularly described as follows, to-wit:
The East Half of the Southwest Quarter (E'�SW4) of Section
28, in Township 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado and all that part of the Fast Half
of the Northwest Quarter (EZNW4) of Section 28, Tbumship
6 North, Range 66 West of the 6th P.M., Weld County, Colo-
rado, described as follaas, to-wit: Beginning at a point
on the west line of the East Half of the Northwest Quarter
(E'NW3) of said Section 28, Township 6 North, Range 66
West of the 6th P.M., which is 68 rods (1122 feet) North
of the Southwest corner of said East Half of the Northwest
Quarter (E-1/2NWa) , running thence south on the west line of
said East Half of the Northwest Quarter (E1/2NWa) to the
Southwest corner of said East Half of the Northwest Quarter
(EzNW ) ; thence East on the half section line a distance of
80 rods (1320 feet) , to the Southeast corner of the East

Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not with-
in the purposes of the Weld County Subdivision Regulations and

the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by the McKay Land and Cattle Company,
be exempt from the definition of the terms, "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973 , subject to the recorded exemption plat being
amended to provide access to the part of Lot B north of the rail-
road tracks as requested by the County Engineer's Office.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 3rd day of
October, A.D. , 1977.

RE: Recorded Exemption #280
Dear Commissioners:
The attached application, plat , and related items are in reference
to a request by McKay Land and Cattle Company for a recorded exemption.
The parcel of land is described as Pt . of the WA of Section 28, T6N,
R66W of the 6th p.m. , Weld County, Colorado. Said property is located
1 mile south and 22 miles west of Seeley Lake. The subject property
contains 100. 28 acres of predominantly Class I , II , and III irrigated
soils. The request is to split the property into parcels of 5.121
acres and 95.159 acres. A letter dated September 19, 1977, submitted
by Charles B. Dickson, attorney for McKay Land and Cattle Company,
explains the reasons for the recorded exemtpion request . Essentially
the request stems from the fact that the McKay Land and Cattle Company
is being forced to liquidate their assets and the McKay' s desire to
retain their single family residence which is located on the proposed
5.121 acre parcel . Presently, the 95.159 acre parcel is unimproved
irrigated farm land and it appears that the people interested in
purchasing said property are only doing so to add to already existing
farm land and thus it appears the site is not needed as a new
residential home site.
Based upon the information submitted and the adopted policies in the
county, the Planning Commission staff recommends the request be
approved for the following reasons:
1. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District
(Section 3 .3(A) of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan since the use would be compatible
with surrounding agricultural uses.

2. The request complies with the provisions of Section 9-4(A) of
the Weld County Subdivision Regulations
The Planning Commission staff recommendation for approval is subject
to the recorded exemption plat being amended to provide access to the
part of Lot B north of the railroad tracks as requested by the County
Engineer' s Office.

LETTER OF EXPLAINATION
Weld County Planning Commission

Dear Sirs:
The exemption being sought in this matter is as a result of
McKay Land and Cattle Company's being forced to liquidate their assets.
The president and owner of McKay Land and Cattle Company, James P. McKay,
and his wife occupy a present single family dwelling located upon the land
in question. A detailed review of the assets of McKay Land and Cattle
Company, when compared with the outstanding indebtedness of the same,
indicate that Mr. and Mrs. McKay will be able to meet their financial
obligations without the necessity of selling their family home. Presently,
that home is located on a parcel of irrigated farmland, which it will be
necessary to liquidate in order to meet their present obligations. If the
exemption is not granted, the home will be sold as a portion of this farm-
land. If that action is taken, neither the farmland nor the home would
bring, in the form of a monetary return, what each is worth individually.
Obviously, any farmer buying the land would have little or no use for the
home, and the person buying the home would not need 100 acres. The McKay's
are desirous of retaining and maintaining their home and to do so they
desparately need the exemption in question.
Additionally, should it be determined that the farmland itself is
not adequate to meet their obligations, it is contended that the sale of
the home separately would result in a greater monetary return to the McKay's
than is possible presently. It is very hard for the McKay's to divest themselves
of the property they have worked hard to obtain and it seems only equitable
that if they are able to retain their home, they be given the chance to
do so.
The purpose of this exemption is as stated above and this exemption
is materially necessary to this family's retention of their home.
The parcel being created by this exemption would include only the
family home and outlying buildings, comprising approximately 41 acres. The
land being retained as parcel B would consist solely of irrigated farmland.
There is no present intention whatsoever to build any home on parcel B and
it appears that those people interested in purchasing the same are only doing
so to add to already existing farmlands they have and thus it is not

contemplated that any such home site would be built in the near future.
I trust that the above provides a satisfactory explaination of
the situation. If I can be of any further help, please call me immediately
as this matter is of great concern to the McKay's.
