RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO . 38 : 78: 7 FOR A SINGLE FAMILY RESIDENCE ON A TRACT OF LAND LOCATED IN PART OF SECTION 12, TOWNSHIP 1 NORTH, RANGE 66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 2nd day of July, 1979 at the hour of 9: 00 o ' clock a.m. for the purpose of hearing the application of Curtis Cato for the granting of a Conditional Use Permit for a single family residence on the following described real estate, to-wit : The West One-Half of the West One-Half of the Northeast One-Quarter of Section 12 , Township 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado . Excluding the North 30 feet thereof . Con- tains 40. 0691 acres more or less . WHEREAS, a representative of the petitioner was present , and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a single family residence, and WHEREAS, Section 3 . 3 .D. of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural Zone District on the granting of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent , has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Condi- tional Use Permit for a single family residence on the hereinabove described real estate complies with all of the conditions as set forth in Section 3. 3 .D. ( 2) of the Weld County Zoning Resolution. 790488 NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Curtis Cato for a Conditional Use Permit for a single family residence on the hereinabove described tract of land be, and hereby is, granted subject to the development standards con- tained in the Conditional Use Permit . BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated November 21 , 1978 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. Nix stated that as the property exists now it would be an improvement if it meets the Planning staff ' s requirements . Discussion followed regarding County Road 12 and extending it . Scheduled Planning Commission meeting, Thom Rounds presented to the Planning Commission the Weld County Housing Plan.. This plan was ; begiin ir1976 and completed in 1977 . Mr . Rounds briefly outlined and explained each section of the plan with the use of a -slide presentation. Ph '�llips Planning Commijssien Secretary - . - Curtis Cato CUP-38 : 78 : 7 PLANNING COMMISSION RECOMMENDATION November 21 , 1978 purpose of raising dairy heifers and small beef cattle as replacement feeders in addition to building a single family residence on the property. 2 . It is the opinion of the Planning Commission that the proposed use will be located on land which is essentially not considered to be prime agricultural land. The SCS Soil ' s Classification of the area under consideration indicates the soils on the site are predominantly Class IV and VI non-irrigated soils with reference to agricultural capability classification . The SCS capability classifications indicates that Class IV soils have severe limitations that reduce the choice of plants and require very careful management . Class VI soils also have severe limitations that make them generally unsuited to cultivation and limit their use largely to pasture or range , woodland , or wildlife food and cover . 3. It is the opinion of the Planning Commission that this request is in compliance with the provisions of Section 3 . 3. D . (2) of the Weld County Zoning Resolution which states : "The Planning Commission and Board of County Commissioners shall consider the following in making their deterimination in approving or denying a Conditional Use Permit : Compatibility with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses , need for the proposed use , its effect upon the immediate area, its effect on future development of the area and the health, safety and welfare of the inhabitants of the area and the County . " This determination is based upon the following : A. It is the opinion of the Planning Commission that the addition of one single-family residence and the raising of livestock on the property under consideration will be compatible with the surrounding agricultural uses. B. The Fort Lupton Fire Protection District has set forth no objections to this request . C. The Colorado Geological Survey has set forth no objections to this request . It has been recommended in a letter dated November 3 , 1978 , that the applicant consult a qualified soils engineer for his recommendations regarding a foundation design for the proposed residence. The Weld County Health Department has reviewed this request and found no apparent conflict with the health regulations . E. The Colorado Division of Water Resources has indicated that a dependable water supply will be available from the existing domestic well . F. The Fort Lupton Planning Commission has no objections to this request provided applicable county, state , and federal regulations are complied with. G. The Weld County Engineering Department has set forth no objections to this request . In addition , the Planning Commission ' s recommendation for approval is subject to the following conditions : 1 . The applicant shall provide evidence that an adequate access with the right of ingress and egress exists to the property prior to this Conditional Use Permit being scheduled before the Board of County Commissioners . 2 . The attached Development Standards being recommended and approved for the Conditional Use Permit area. 3. No building permits for any structure shall be issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the Department of Planning Services office . • Comments : 1. The Platte Valley. Soil Conservation District and Farmers Reservoir and Irrigation Company did not respond to the referrals sent to them. 2 . Our office has received a letter from Mrs . It is the opinion of the Department of Planning Services staff that this request is consistent with the Weld County Comprehensive Plan and the intent clause of the Agricultural Zone District , Section 3. 3 .A. of the Weld County Zoning Resolution in that the proposed use will be promoting an agricultural related use in an area where agriculture is the predominant land use . Further, this request is using the land as a higher and better agricultural use than it has been used in the past . As stated in the submitted application materials , it is the intent of the applicant to use the property for the purpose of raising dairy heifers and small beef cattle as replacement feeders in addition to building a • single family residence on the property . 2 . It is the opinion of the Department of Planning Services staff that the proposed use will be located on land which is essentially not considered to be prime agricultural land . The SCS Soil ' s Classification of the area under consideration indicates the soils on the site are predominantly Class IV and VI non-irrigated soils with reference to agricultural capability classification . The SCS capability classifications indicates that Class IV soils have severe limitations that reduce the choise of plants and require very careful management . Class VI soils also have severe limitations that make them generally unsuited to cultivation and limit their use largely to pasture or range , woodland , or wildlife food and cover. 3. It is the opinion of the Department of Planning Services staff that this request is in compliance with the provisions of Section 3. 3.D . It is the opinion of the Department of Planning Services staff that the addition of one single-family residence and the raising of livestock on the property under consideration will be compatible with the surrounding agricultural. uses . B. The Fort Lupton Fire Protection..District has set forth no objections to this request . C. The Colorado Geological Survey has set forth no objections to this request . It has been recommended in a letter dated November 3, 1978 , that the applicant consult a qualified soils engineer for his recommendations regarding a foundation design for the proposed residence . • D. The Weld County Health Department has reviewed this request and found no apparent conflict with the health regulations . E. The Colorado Division of Water Resources has indicated that a dependable water supply will be available from the existing domestic well . E.
