APPLICATION
On May 29, 2014, Bonanza Creek Energy LLC ("Bonanza" or "Applicant") filed a verified
application pursuant to §34-60-116, C.R.S., for an order to:
1) Pool all interests in two approximate 160-acre designated wellbore spacing units
established for Section 34, Township 5 North, Range 63 West, 6th P.M. ("WSU #2, #8"), for the
development and operation of the Codell and Niobrara Formations;
2) Subject any nonconsenting interests to the cost recovery provisions of §34-60-
116(7), C.R.S., effective as of the earlier of the date of the Application, or the date that any of
the costs specified in §34-60-116(7)(b), C.R.S. were first incurred for the drilling of the North
Platte 14-11-34HNB Well (API No. Pending) and the North Platte 14-11-34HC Well (API No.
Pending);
3) Pool all interests in six approximate 320-acre designated wellbore spacing unit
established for Sections 33 and 34, Township 5 North, Range 63 West, 6th P.M. ("WSU #1, #6,
#7" and "WSU #3, #4, #5"), for the development and operation of the Codell and Niobrara
Formations; and
4) Subject any nonconsenting interests to the cost recovery provisions of §34-60-
116(7), C.R.S., effective as of the earlier of the date of the Application, or the date that any of
the costs specified in §34-60-116(7)(b), C.R.S., were first incurred for the drilling of North Platte
E14-A11-34HNC Well (API No. Pending), the North Platte J14-F11-34HNC Well (API No.
Pending), the North Platte J-F-34HNB Well (API No. Pending), the North Platte J-F-34HC Well

NOTICE IS HEREBY GIVEN, pursuant to: 1) the general jurisdiction granted to the Oil
and Gas Conservation Commission of the State of Colorado under §34-60-105 C.R.S.; 2)
specific powers granted pursuant to §34-60-106 C.R.S.; 3) the State Administrative Procedures
Act at §24-4-105 C.R.S.; and 4) the Commission's Series 500 Rules at 2 CCR 404-1, that the
Commission has scheduled the above-entitled matter for hearing on:

APPLICATION
COMES NOW Bonanza Creek Energy LLC ("Applicant"), by its attorneys,
Jost & Shelton Energy Group, P.C., and makes this application to the Oil and Gas
Conservation Commission of the State of Colorado ("Commission") for an order to pool
all interests within two (2) approximate 160-acre designated horizontal Wellbore
Spacing Units (`1NSU"), as defined below, for the North Platte 14-11-34HNB Well (API
No. Pending) and the North Platte 14-11-34HC Well (API No. Pending), along with all
interests within six (6) approximate 320-acre designated horizontal Wellbore Spacing
Units, as defined below, for the drilling of the North Platte E14-A11-34HNC Well (API
No. Pending), the North Platte J14-F11-34HNC Well (API No. Pending), the North Platte
J-F-34HNB Well (API No. Pending), the North Platte J-F-34HC Well (API No. Pending),
the North Platte E-A-34HNB Well (API No. Pending) and the North Platte E-A-34HC
Well (API No. Pending) ("Wells"), for the development of the Niobrara and Codell
Formations on the following described lands:

320 acres, more or less, Weld County, Colorado (hereinafter
collectively as "Application Lands").
In support thereof, Applicant states and alleges as follows:
1. Applicant is a corporation duly authorized to conduct business in
the State of Colorado, and is a registered operator in good standing with the
Commission.
2. Applicant owns certain leasehold interests in the Application Lands.
3. On April 27, 1998, the Commission adopted Rule 318A, which
among other things, allowed certain drilling locations to be utilized to drill or twin a well,
deepen a well or recomplete a well and to commingle any or all of the Cretaceous Age
Formations from the base of the Dakota Formation to the surface. On December 5,
2005, Rule 318A was amended to allow interior infill and boundary wells to be drilled
and wellbore spacing units to be established. On August 8, 2011, Rule 318A was again
amended to, among other things, address the drilling of horizontal wells.
4. Applicant designated the two (2) approximate 160-acre horizontal
Wellbore Spacing Units, and the six (6) approximate 320-acre horizontal Wellbore
Spacing Units, for the production of oil, gas, and associated hydrocarbons from the
Niobrara and Codell Formations pursuant to Rule 318A. and notified the appropriate
parties under Rule 318A.
5. Applicant, pursuant to Commission Rule 530 and/or the provisions of
C.R.S. § 34-60-116 (6) and (7), hereby requests an order to pool all interests within the
Wellbore Spacing Unit, including but not limited to, any nonconsenting interests and
leased mineral interests, in the Application Lands in the Niobrara Formation underlying the
following approximate 320-acre Wellbore Spacing Unit for the North Platte E14-A11-
34HNC Well (API No. Pending):

Section 33: EY2E1/2
Section 34: W'/2W'/2
(hereafter "WSU #1").
6. Applicant requests that the Commission's pooling order be made
effective as of the earlier of the date of this Application, or the date that the costs specified
in C.R.S. § 34-60-116(7)(b) are first incurred for the drilling of the North Platte E14-A11-
34HNC Well (API No. Pending) to the Niobrara Formation on the Application Lands.

7. Applicant, pursuant to Commission Rule 530 and/or the provisions of
C.R.S. § 34-60-116 (6) and (7), hereby requests an order to pool all interests within the
Welibore Spacing Unit, including but not limited to, any nonconsenting interests and
leased mineral interests, in the Application Lands in the Niobrara Formation underlying the
following approximate 160-acre Wellbore Spacing Unit for the North Platte 14-11-34HNB
Well (API No. Pending):

(hereafter "WSU #2").
8. Applicant requests that the Commission's pooling order be made
effective as of the earlier of the date of this Application, or the date that the costs
specified in C.R.S. § 34-60-116(7)(b) are first incurred for the drilling of the North Platte
14-11-34HNB Well (API No. Pending) to the Niobrara Formation on the Application
Lands.

C.R.S. § 34-60-116 (6) and (7), hereby requests an order to pool all interests within the
Wellbore Spacing Unit, including but not limited to, any nonconsenting interests and
leased mineral interests, in the Application Lands in the Niobrara Formation underlying the
following approximate 320-acre Wellbore Spacing Unit for the North Platte J14-F11-
34HNC Well (API No. Pending):

10. Applicant requests that the Commission's pooling order be made

Lands.

19. Applicant, pursuant to Commission Rule 530 and/or the provisions of
C.R.S. § 34-60-116 (6) and (7), hereby requests an order to pool all interests within the
Wellbore Spacing Unit, including but not limited to, any nonconsenting interests and
leased mineral interests, in the Application Lands in the Codell Formation underlying the
following approximate 160-acre Wellbore Spacing Unit for the North Platte 14-11-34HC
Well (API No. Pending):

(hereafter "WSU #8").
20. Applicant requests that the Commission's pooling order be made
effective as of the earlier of the date of this Application, or the date that the costs
specified in C.R.S. § 34-60-116(7)(b) are first incurred for the drilling of the North Platte
14-11-34HC Well (API No. Pending) to the Codell Formation on the Application Lands.
21. Applicant certifies that copies of this Application will be served on all
persons owning an interest in the mineral estate of the tracts to be pooled, including
leased mineral interest owners, within seven (7) days of the date hereof, as required by
Rule 507.b(2), and that at least thirty (30) days prior to the hearing on this matter, each
such interest owner not already leased or voluntarily pooled will be offered the opportunity
to lease, or to participate in the drilling of the Wells, and will be provided with the
information required by Rule 530 as applicable. The list of such interested parties is
attached hereto as Exhibit A.
22. That in order to prevent waste and to protect correlative rights, all
interests in each of the Wellbore Spacing Units should be pooled for the orderly
development of the Niobrara and Codell Formations, including any nonconsenting
interests therein.
WHEREFORE, Applicant requests that this matter be set for hearing at
the next available opportunity, that notice be given as required by law, and that upon
such hearing, the Commission enter its order:
A. Pooling all interests in two (2) approximate 160-acre designated
horizontal Wellbore Spacing Units, and six (6) approximate 320-acre designated
horizontal Wellbore Spacing Units established on Application Lands for the
development of the Niobrara and Codell Formations.
B. Providing that the Commission's pooling order is made effective as of
the earlier of the date of this Application, or the date that any of the costs specified in
C.R.S. § 34-60-116(7)(b) are first incurred for the drilling of the North Platte E14-A11-
34HNC Well (API No. Pending), the North Platte 14-11-34HNB Well (API No. Pending),
the North Platte J14-F11-34HNC Well (API No. Pending), the North Platte J-F-34HNB
Well (API No. Pending), the North Platte J-F-34HC Well (API No. Pending), the North
Platte E-A-34HNB Well (API No. Pending), the North Platte E-A-34HC Well (API No.
Pending), or the North Platte 14-11-34HC Well (API No. Pending) to the Niobrara and
Codell Formations on the Application Lands.
C. Providing that the interests of any owners with whom the Applicant
has been unable to secure a lease or other agreement to participate in the drilling of the
Wells are pooled by operation of statute, pursuant to C.R.S. § 34-60-116(6) and (7), and
made subject to the cost recovery provisions thereof with respect to the Wells drilled to
develop the Niobrara and Codell Formations in the Wel!bore Spacing Units comprising
the Application Lands.
D. For such other findings and orders as the Commission may deem
proper or advisable in this matter.
WHEREFORE, Applicant respectfully requests that this matter be set for
hearing in July 2014, that notice be given as required by law, and that upon such
hearing, the Commission enter its order consistent with Applicant's request as set forth
above.

Attached is an Application for the statutory pooling of an oil and gas well that has been filed
with the Colorado Oil and Gas Conservation Commission ("COGCC"). Accordingly, I have
answered a few commonly asked questions below and provided you with my contact information
in case you have other questions.
Why am I receiving it?
The COGCC Rules and Colorado Statutes require the attached application be sent to you. You are
receiving this Application because you own an interest in the proposed well.
What action is required of me?
At this time, no action is required on your part; however, you do have certain rights as described
in detail in the enclosed Application and letter.
Will I still receive royalty from the well if I do not respond to this Application?
There are various types of interest owners in oil and gas wells: (1) Working Interest Owners, (2)
Unleased Mineral Owners, and (3) Royalty Owners, otherwise known as Leased Mineral Owners.
We have sent previous notice of this well to Working Interest Owners and Unleased Mineral
Owners. If this is the first notice you have received concerning the proposed well, you are a
Royalty Owner. If the proposed well produces, Royalty Owners will receive a royalty from the
well, based the terms of the applicable lease, regardless of their response to this Application.
