The attached zoning map and aerial photograph demonstrates the site's contiguity with the City of Greeley and the urbanizing nature of this area. Rezoning this area while remaining in unincorporated Weld County provides a short-term solution,but establishes a long-term problem. Rezoning the property may rectify the current zoning violation, but remaining in unincorporated Weld County zoned as C-3 gives a false perception to potential users of the location's ability to further develop in the future. Specifically,the C-3 Zone District would give the impression that fairly intensive commercial activities may develop. In reality this site would not be in such a position.At such time the site's users require any additional water or sewer service, it would be required to annex. It is prudent to annex at this time to better incorporate this parcel into its urbanizing surroundings.Additionally, please consider the following goals and policies from the County Code pertinent to this location: UD.Goal 1. Concentrate urban development within existing municipalities, an approved Intergovernmental Agreement urban growth area, the Regional Urbanization Areas, County Urban Growth Boundary Areas, Urban Development Nodes or where urban infrastructure is currently available or reasonably obtainable. UD.Policy 3.3. Inside the County Urban Growth Boundary,urban-type uses and services are planned and supported,and annexation is encouraged. C.Goal 1.Promote the location of commercial uses within municipalities,County Urban Growth Boundary areas, Intergovernmental Agreement urban growth areas, growth management areas as defined in municipal comprehensive plans, the Regional Urbanization Areas,Urban Development Nodes or where adequate services are currently available or reasonably obtainable. C.Goal 2. Encourage appropriate commercial development to annex into a municipality if the new or expanding commercial development is adjacent to the municipality's corporate limits.
