WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land being the property of Norman Moser, Hudson, Colorado, and
more particularly described as follows:
Part of the Northeast Quarter (NEa) of Section 26,
Township 1 North, Range 67 West of the 6th P.M. , Weld
County,,. Colorado being more particularly described as
follows:
Beginning at the East Quarter Corner (Ea Cor) of said
Section 26, and considering the South Line of said
Northeast Quarter (NEa) as bearing South 89°53 ' 08"
East, with all other bearings contained herein relative
thereto;
Thence North 00°33' 57" East, 81. 24 feet; thence North

does not come within the purview of the definition of the terms
"subdivision" and "subdivided lands" as set forth in 1973 C .R. S.
30-28-101 (10) , as amended, and
WHEREAS, the Board of County Commissioners of the County
of Weld, State of Colorado, has studied the request of the
petitioner and studied the recommendations of the Weld County
Planning Commission, and having been fully informed, now desires
to exempt this particular division of land pursuant to its
authority under 1973 C.R. S. 30-28-101 (10) (d) , as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Norman Moser, Hudson, Colorado,
be exempted from the definition of the terms "subdivision" and
"subdivided lands" as provided for in the new Weld County
Subdivision Regulations at Section 2-1, A. , (3) adopted August
30, 1972.
The above and foregoing Resolution was , on motion duly
made and seconded, adopted by the following vote on the 14th
day of July, A.D. , 1976.

RE: Recorded Exemption 215
Dear Commissioners:
The attached application, plat and related materials are in reference
to a request by Norman Moser, for a Recorded Exemption. The parcel of
land is described as part of the NEa of Section 26, T1N, R67W of the
6th P.M. , Weld County, Colorado. Said property is located i mile south
and i mile west of Wattenberg. The subject property contains 154.870
acres of predominantly Class II, III, and IV irrigated soils. The re-
quest is to split the property into parcels of 4.120 acres and 150.750
acres. Neither of the two resulting parcels would contain an existing
residence although the 4.120 acre parcel is the location of a former
residence and accessory buildings.
Based upon the information submitted and the adopted policies in the
County, the Planning Commission staff recommends that the request be
denied for the following reasons:
1 . The proposed split does not comply with the Weld County Com-
prehensive Plan because it would promote non-agricultural use
of agricultural land and it would encourage urban encroachment
on rural land use.

2. The recorded exemption request is not in compliance with the
intent clause of the recorded exemption procedure (Section
9-2 of the Weld County Subdivision Regulations). Said clause
states:
"The intent in establishing the Recorded Exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby non-productive agri-
cultural lands may be developed for higher or more pro-
ductive uses, in-so-far as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposed. (Rev. 4/17/74)"
Soils in this area are Class II, III, and IV. The granting of
this request would allow for the conversion of prime agricul-
tural lands since a new set of improvements would be allowed
to be constructed on both the proposed lots.
3. The recorded exemption request is not in conformance with the
intent clause of the Agricultural Zone District (Section 3.3 A
of the Weld County Zoning Resolution) which states:
"Intent - The intent in establishing the A-I Agricultural
Zone District is to allow all agricultural and related uses
in those areas in which agriculture is and should continue
to be the predominant land use. This district is intended
to discourage encroachment of incompatible uses upon the
agricultural land in the district, to encourage agricul-
tural uses as the highest and best use of the land in the
district as compared with other uses in conflict therewith,
and to provide for the orderly expansion of urban growth in
conformance with the Weld County Comprehensive Plan."
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be breaking up a large
block of agricultural land.
It should be pointed out that the City of Brighton has no objection to

RIGHT-OF-WAY EASEMENT AND LICENSE
Tills EASEMENT AND LICENSE made and entered into this day
of , A. D. , 19 , by and between The Brighton Ditch
company , a Colorado corporation, as First Party,
and PANHANDLE EASTERN PIPE LINE COMPANY, a Delaware corporation, as
Second Party;
WITNESSETH:

THAT WIIEREAS. First Party is the owner of that certain Canal known

in Weld County,
Colorado: and
WHEREAS, Second Party desires to construct, operate and maintain a
gas pipeline 3" under and across the right-of-way of said
Brighton Ditch at the point hereinafter described; and

WHEREAS, First Party is willing to grant the rights and easements
requested by Second Party;
NOW, THEREFORE, in consideration of the sum of $ >_50 00
paid to First Party, receipt of which is hereby acknowledged, and the agreements of
Second Party to he performed hereunder, and upon the conditions and for the period
herein stated, First Party does hereby grant to Second Party, its. successors and
assigns, the use of a right-of-way at the point hereinafter described to construct.
install, lay, operate. maintain, alter, repair and remove a gas pipeline under and
across the right-of-way of the Brighton Ditch at the location shown and
set forth in the map attached hereto, and marked Exhibit A and which is by this
reference made a part hereof, said right-of-way crossing being location in Section
Sec. 26-TIN-R67w 6th P.M. , WPtd County,
Colorado.
The construction of said gas pipeline at the right-of-way crossing shall
P be in accordance with the specifications and plans applicable to crossing as the same 1
are outlined on the applicable map which is a part of Exhibit A hereto attached.
Second Party agrees not to commence construction of said gas pipeline
at the right-of-way crossing without first having obtained the consent of the Superin-
tendent of First Party.
It is understood that, if the First Party only owns an easement for said
Brighton nirrh , right-of-way, or any part thereof, at the location described in
said map marked Exhibit A. this instrument shall grant to Second Party only such
rights as First Party may under such circumstances grant.
All canal crossings are to be bored.
In laying and constructing said gas pipeline and thereafter in operating,
repairing, maintaining or removing same, Second Party shall do so in such manner as
not to damage said Canal or the embankment thereof and so as not to interfere with the
flow of water in said Canal. Any and all excavations made shall be immediately leveled
off, and any damage to the canal embankments, fences, roads or other improvements
shall be promptly repaired by Second Party at its sole cost.
Second Party agrees that it will at all times maintain said gas pipeline
and repair all breaks, leaks and damages therein and thereto at its own expense, and,
further, that if by reason of any break, leak or damage in and to the gas pipeline,
injury to the properties of First Party is sustained, then Second Party will , with all
due diligence, repair and replace such property of First Party in the same condition

Second Party further agrees that, if at any time the gas pipeline causes
any settling in the ditch embankments, the road therein, or any part of the ditch right-
of-way, it will, upon notification from First Party, immediately make all repairs re-
quired by First Party at Second Party's expense.
Second Party further agrees to indemnify and save harmless First
Party, its successors, assigns, employees and stockholders on account of any
damages or loss sustained by them or any of them arising out of the construction,
operation. maintenance or removal of said gas pipeline.
in the future First Party should desire to enlarge, deepen or other-
wise change or relocate said Canal or to construct any other canal, ditch or waterway
on said Canal right-of-way, or do any other thing incident to the operation of said
Canal, or any other portion of the irrigation Lystem of First Party, then Second Party
agrees, at Second Party's expense. with all due diligence, to change, relay and re-
construct its gas pipeline so as to comply with such plans and specifications as First
Party may prescribe as being necessary to permit the proper maintenance and
operation of First Party's irrigation system.
Second Party agrees to protect First Party and save and hold it harmless
from any and all third party claims and damages caused by Second Party's operation,
construction, maintenance or removal of said gas pipeline; and Second Party hereby
releases First Party, its successors, assigns, employees and stockholders from any
and all claims and damages of whatsoever character to said gas pipeline or other
property of Second Party located in, along or across said Canal right-of-way arising
out of either the operation or maintenance of said Canal or other portions of First
Party's irrigation system or resulting from any other act either on the part of First
Party or on the part of any third party, except First and Third Parties negligence.
The right-of-way herein granted to Second Party shall continue so long
and only so long as Second Party, its successors and assigns, shall faithfully and
promptly comply with the provisions herein stated.
It is mutually understood and agreed that this agreement and all the
terms and conditions hereof shall extend to and be binding upon the parties hereto,
their successors and assigns.

It is recommended that the residential site be utilized
for conventional residential construction and that an inde-
pendent mobile home not be allowed, as it has a tendency to
open up an area for more and more low tax base mobile home
sites .
