HomeMy WebLinkAbout760601.tiff RESOLUTION WHEREAS, it has been determined by the Board of County Commis- sioners, Weld County, Colorado, that a certain tract of land being the property of Philip C. Morgan, Platteville, Colorado, and more particularly described as follows: All of the Southeast Quarter of Section 14, Township 3 North, Range 66 West of the Sixth Principal Meridian, Weld County, Colorado, more particularly described as follows: Beginning at the Southeast corner of said section; thence along the South line of the Southeast Quarter of said Section South 89°17'52" West 2661 . 19 feet to the South Quarter corner of said Section; thence along the North-South centerline of said Section North 0°20'06" West 2629, 36 feet to the center of said Section; thence along the East-West centerline of said Section North 89°22'31" East 2655. 49 feet to the East Quarter corner of said Section; thence along the East line of said Southeast Quarter South 0°27'32" East 2625. 74 feet more or less to the point of beginning, containing 160, 35 acres, more or less, does not come within the purview of the definition of the terms "subdivision" and "subdivided lands" as set forth in 1973 C. R, S, 30-28-101 (10), as amended, and WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed, now desires to exempt this particular division of land pursuant to its authority under 1973 C. R. S, 30-28-101 (10) (d), as amended. NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described tract of land owned by Philip. C.. Morgan, Platteville, Colorado, be exempted from the definition of the terms "subdivision" and "subdivided lands" as provided for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3) adopted August 30, 1972. Morgan, for a Recorded Exemption. The parcel of land is described as the SEa of Section 14, T3N, R66W of the 6th P.M. , Weld County, Colorado. Subject property contains 160.35 acres of predominantly non-irrigated land. The request is to split the property into parcels of 8.31 and 152.04 acres. The location of the property is 4 miles East and 1 mile North of Platteville on the North side of County Road 32. Based on the information submitted, the Planning Commission staff recommends that the request be denied for the following reasons: 1 . The proposed split is not in compliance with the intent clause of the Subdivision Regulations, Section 9-2, which states: "The intent in establishing the Recorded Exemption procedure is to provide, in accordance with the Weld County Compre- hensive Plan, a means whereby non-productive agricultural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Rev. 4/17/74)" The parcel contains only one set of improvements and is currently non-irrigated land for the most part. The split would allow an extra set of improvements on the 160 acre parcel and therefore create an urban encroachment which would be a non-compatible with the Agricultural District. 2. The intent is to maintain large enough tracts for farmable purposes and assist the encouragement of agri- cultural uses as the highest and best use of the land.
