A public hearing was conducted on December 10, 2014, at 10:00 a.m., with the following
present:

The following business was transacted:
ID I hereby certify that pursuant to a notice dated October 31, 2014, and duly published
November 5, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Timbro Ranch and Cattle CO., LLC, do Noble Energy, Inc., for a Site Specific
Development Plan and Use by Special Review Permit, USR14-0058, for Mineral Resource
Development Facilities, Oil and Gas Support and Service, including, but not limited to, a Natural
Gas Processing Facility for the processing of natural gas products and related equipment and
structures, metering equipment for the custody transfer of gas, natural gas liquids (NGLS) and
condensate; outdoor equipment and materials storage yard; one (1) 35-foot in height
communication tower; a Morgan County REA Substation; and the transloading of a commodity
from one mode of transportation to another, including truck and pipeline without limitation for oil

and gas industries, including petroleum products and storage related to same and related
equipment; temporary staging area and lay down yard for construction materials, construction
office trailers, and construction parking and more than one cargo (conex) container in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and gave a brief description of the location of the site, surrounding land uses, site layout, facility
operations, and security. He reviewed the referral responses and entered the favorable
recommendation of the Planning Commission into the record as written. Mr. Ogle displayed
photographs of the site and surrounding area.
e Wayne Howard, Department of Planning Services Engineer, provided a brief overview of
the transportation plans and requirements. He stated the site is accessed from County Road
(CR) 106, which is a section line right-of-way that has been improved by the applicant through a
Nonexclusive License Agreement and an Access Permit was approved. He stated there are no
traffic counts at this location; however, 150 trips are anticipated during construction and then the
trips will reduce to 15 employee vehicle trips per day. He also noted there is a signed/stamped
Drainage Report.
• Heather Barbare, Department of Public Health and Environment, reviewed the water and
sewer provisions. She stated the applicant has submitted, and staff has approved, the Dust
Abatement Plan and Waste Handling Plan, which she reviewed for the record. She further
stated a new commercial septic system and water well are proposed (bottled water and portable
toilets will be acceptable during construction and for drivers). She also noted the applicant
needs an Air Pollution Emission Notice (Condition #5.A) and a Spill Prevention, Control and
Countermeasure Plan (Condition #8.A). In response to Chair Rademacher, Ms. Barbare
stated the reduced speeds will be on the interior circulation.
e Pam Hora, Tetra Tech Planner, represented the applicant and introduced the various staff
members present who have worked on the project. She displayed a PowerPoint presentation,
marked Exhibit D, which she reviewed for the record, including a vicinity map, surrounding uses,
access, site plan uses, and security. She explained the subject site is intended to support the
Keota Site which was approved last year and should be operating soon. She also reviewed the
leased areas of the site, electric substation, and three accesses. She noted traffic will consist of
employees working two 12-hour shifts, as well as three truck drivers, an occasional lease
employee and site maintenance vehicles. She further stated the proposal meets the criteria of
the Weld County Code and she requested the deletion of Condition of Approval #1.E.9 (not
needed since the road has already been upgraded and maintained) and a modification to
Development Standard #16 to require the submittal of an approved Emergency Action and
Safety Plan "starting one month prior to operation and thereafter. . ." to be consistent with
Condition of Approval #7.A.
In response to Commissioner Conway, Ms. Hora confirmed gas facilities are primarily
piped. Responding to Chair Rademacher, Ms. Hora stated the three accesses on CR 106 will

enhance safety at the site; employees will access through the north gate and the central and
southern access will facilitate truck circulation through the site. She also confirmed the road
does not currently exist and will have to be built.
No public testimony was offered concerning this matter. Chair Rademacher confirmed
Condition of Approval #1.A has been met but will be retained. Regarding Condition of Approval
#1.E.9, Mr. Howard confirmed the tracking control has been met and the language may be
deleted. Ms. Hora reviewed the proposed language to be inserted into Development Standard
#16, which was done by assent of the Board.
E In response to Chair Rademacher, Ms. Hora indicated she and the applicant have
reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as
amended.
Ei Commissioner Conway moved to approve the request of Timbro Ranch and Cattle CO.,
LLC, c/o Noble Energy, Inc., for a Site Specific Development Plan and Use by Special Review
Permit, USR14-0058, for Mineral Resource Development Facilities, Oil and Gas Support and
Service, including, but not limited to, a Natural Gas Processing Facility for the processing of
natural gas products and related equipment and structures, metering equipment for the custody
transfer of gas, natural gas liquids (NGLS) and condensate; outdoor equipment and materials
storage yard; one (1) 35-foot in height communication tower; a Morgan County REA Substation;
and the transloading of a commodity from one mode of transportation to another including truck
and pipeline without limitation for oil and gas industries, including petroleum products and
storage related to same and related equipment; temporary staging area and lay down yard for
construction materials, construction office trailers, and construction parking and more than one
cargo (conex) container in the A (Agricultural) Zone District, based on the recommendations of
Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as entered into the record and amended. The motion was seconded by
Commissioner Garcia. Commissioner Conway commented on the importance of this type of
facility. There being no further discussion, the motion carried unanimously and the hearing was
completed at 10:52 a.m.
