The proposed Urban Renewal Area is located at the northeast corner of one of Frederick's most important commercial intersections (State Hwy 52 and Weld County Road 13/Colorado Blvd.) and is burdened by significant impediments to development that may be addressed through the actions outlined in the attached Plan. The estimated "Weld County Property Tax Increment" shown in the attached Impact Report was calculated based upon a meeting with the County Commission who pledged verbal support that the Frederick Urban Renewal Authority and Weld County would evenly divide any future tax increment generated through the County's millage rate. Glossary Unless a different meaning is clearly stated,the terms used in this Conditions Survey and Urban Renewal Plan shall have the following meaning: "Act" means the Colorado Urban Renewal Law, Part 1 of Article 25 of Title 31, Colorado Revised Statutes. "Area" means the Eagle Business Park, Lot 1 Urban Renewal Area as depicted and legally described in Attachment 1. See also "Urban Renewal Area." "Authority" means the Frederick Urban Renewal Authority, a body corporate and politic of the State of Colorado. "Board of Trustees" means the Board of Trustees of the Town of Frederick, Colorado. "Comprehensive Plan" means the Town of Frederick Comprehensive Plan—2006. "Plan" and "Urban Renewal Plan" means this document. "Tax Increment Financing" or "TIF" means tax allocation financing described in Section 31-25- 107(9) of the Act. "Town" means the Town of Frederick, Colorado. "Urban Renewal Area" means the Eagle Business Park, Lot 1 Urban Renewal Area as depicted in Attachment 1. 2. Introduction On October 14, 1999, the property known as the Johnson Annexation (158.387 acres) was annexed into the Town of Frederick (Ordinance 540). At the time of annexation, zoning for the property was established as "Planned Unit Development" (PUD) to allow for residential, commercial and open space uses (Ordinance 541). On July 31, 2001,the owners of Miners' Park Town Centre donated a portion (17.43 acres) of the land for Centennial Park/Detention Facility north of the site, and the drainage way that runs south through the site and to the east along its southern boundary. On November 8, 2007,the Town of Frederick entered into a land exchange agreement with the owners of Miners' Park Town Centre primarily for purposes of facilitating the relocation of Main Street generally eastward from the western boundary of the development. March 20, 2014 Page 3 of 11 Miners' Park Town Centre Urban Renewal Plan On January 24, 2012, the Board of Trustees followed the recommendations of the Planning Commission and approved the proposed subdivision. Approval of the final plat also finalized the agreement for land exchange discussed previously. 3. Conditions Survey In order for the Authority to establish an Urban Renewal Area and employ all of the powers authorized by the Act, it must first evaluate the Area and make findings of"blight" as defined by the Act. This objective is accomplished by conducting a "Conditions Survey" whereby the Authority may evaluate a given property against a set of criteria outlined in the Act in order to determine whether or not the property is appropriate for urban renewal activities. Blight Criteria According to the Act, at least four of the twelve blight criteria must be met in the proposed Urban Renewal Area prior to adoption of a plan. The exception to this requirement is if the owner of the property consents to the area being designated as blighted. In such a case only one of the blight criteria must be met. The criteria area as follows: (a) Slum, deteriorated, or deteriorating structures; (b) Predominance of defective or inadequate street layout; (c) Faulty lot layout in relation to size, adequacy, accessibility, or usefulness; (d) Unsanitary or unsafe conditions; (e) Deterioration of site or other improvements; (f) Unusual topography or inadequate public improvements or utilities; (g) Defective or unusual conditions of title rendering the title nonmarketable; (h) The existence of conditions that endanger life or property by fire or other causes; (I) Buildings that are unsafe or unhealthy for persons to live or work in because of building code violations, dilapidation, deterioration, defective design, physical construction, or faulty or inadequate facilities; (j) Environmental contamination of buildings or property; (k.5) The existence of health, safety, or welfare factors requiring high levels of municipal services or substantial physical underutilization or vacancy of sites, buildings, or other improvements; or (I) If there is no objection by the property owner or owners and the tenant or tenants of such owner or owners, if any, to the inclusion of such property in an urban renewal area, "blighted area" also means an area that, in its present conditions and use and, by reason of the presences of any one of the factors specified in paragraphs (a)to (k.5) of Section 31-25-103(2), substantially impairs or arrests the sound growth of the municipality, retards the provision of housing accommodations, or constitutes an economic or social liability, and is a menace to the public health, safety, morals, or welfare. March 20,2014 Page 4 of 11 Miners' Park Town Centre Urban Renewal Plan Survey Findings The "2013 Conditions Survey" (dated December 2013) is attached to and made a part of this Plan as Attachment 2. Town staff has conducted the survey in accordance with the Act, and has determined the Urban Renewal Area to be a "blighted area" as defined in Section 31-25-103(2) of the Act, which provides that, in its present condition and use,the presence of at least four of the following factors in the Area, substantially impairs or arrests the sound growth of the municipality, retards the provision of housing accommodations, or constitutes an economic or social liability, and is a menace to the public health, safety, morals, or welfare: The 2013 Conditions Survey confirmed and identified the presence of 10 blight factors in the Urban Renewal Area as defined in the Act. The following are specific instances of blight observed in the Area (See Attachment 2 for more information): (a) Slum, deteriorated or deteriorating structures; (b) Faulty street layout; (c) Faulty Lots; (d) Unsanitary or unsafe conditions; (h) Deterioration of site or other improvements; (e) Existence of conditions that endanger life or property; (f) Unusual topography or inadequate public improvements or utilities; and (k.5) Existence of health, safety, or welfare factors requiring high levels of municipal services or substantial physical underutilization or vacancy of sites, buildings, or other improvements. By approving and adopting this Plan, Board of Trustees, exercising its legislative powers under the Act,finds and declares that the presence of the statutory factors listed above substantially impairs or arrests the sound growth of the municipality, constitutes an economic or social liability, and is a menace to the public health, safety, morals or welfare, and that the Urban Renewal Plan is in the public interest and necessary to facilitate redevelopment of the Area in order to eliminate or prevent the spread of physically blighted areas. 4. Urban Renewal Activities This Plan will be implemented as part of a comprehensive program to eliminate and prevent blight in the Urban Renewal Area. The Authority and the Town, with the cooperation of private enterprise, will undertake a program to eliminate the conditions of blight identified in the 2013 Conditions Survey while implementing the Comprehensive Plan. Public Improvements and Facilities The Authority may cause,finance or facilitate the design, installation, construction and reconstruction of public improvements in the Area. In order to promote the effective utilization of undeveloped and underdeveloped land in the Area, the Authority may, among other things, March 20,2014 Page 5 of 11 Miners' Park Town Centre Urban Renewal Plan enter into financial or other agreements with the Town of Frederick to provide the Town with financial or other support in order to encourage or cause the Town to invest funds for the improvement of storm drainage, street conditions and other infrastructure deficiencies in the Plan Area. Demolition, Clearance, and Site Preparation The Authority may elect to demolish or to cooperate with others to demolish and clear buildings, structures, and other improvements such as partially paved roads, irrigation ditches, oil and gas facilities and agricultural equipment/structures. Development activities consistent with this document may require such demolition and/or clearance to eliminate unhealthy, unsanitary, and/or unsafe conditions, eliminate obsolete and other uses impeding the public welfare, and otherwise remove and prevent the spread of deterioration. In addition, the Authority may contract with and reimburse owners or developers of property for demolition, clearance, or other site preparation activities, including rough and finishe3d site grading and other site preparation services as part of a comprehensive redevelopment plan. Redevelopment Agreements The Authority may enter into redevelopment agreements with property owners or developers in the Urban Renewal Area to facilitate participation and assistance that the Authority may choose to provide to such owners or developers. These may include provisions regarding project planning, public improvements, financing, design, and any other matters allowed pursuant to the Act. Cooperative Agreements For the purposes of implementing this Plan, the Authority may enter into one or more cooperative agreements with the Town or other public entities. Such agreement may include provisions regarding project financing and implementation; design, location, construction of public improvements; and any other matters required to implement this Plan. Additional Powers The Authority may also employ consultants, agents, and employees; sell, lease, or otherwise transfer real property or any interest in real property; and/or exercise other powers given to it under the Act. 5. Urban Renewal Plan Objectives The purpose of the Plan is to eliminate obstacles to the full development of the currently underutilized in the Area. Specific objectives and potential actions associated with each objective include: 1. Relocate oil and gas wells, tanks, pipelines and other facilities in the Area as necessary for development to occur; March 20,2014 Page 6 of 11 Miners' Park Town Centre Urban Renewal Plan 2. Remove existing deteriorated roadways in the Area; 3. Improve or fully construct roadways that serve the Area; 4. Provide bridge/culvert improvements over drainage way within the Area; 5. Extend wet and dry utilities to serve the Area; 6. Construct trails, sidewalks or landscaping in public ROW; 7. Address inadequate site drainage where needed; 8. Address irregular ground surface unsuitable for construction; 9. Address any soil conditions unsuitable for construction of public and private improvements; 10. Address potential impacts from undermining; 11. Provide necessary utilities; and 12. Construct signage and entryway features for Town and commercial center. The following actions and others may be required to fully implement plan objectives: Improvements Serving Multiple Properties Within the Area 1. Necessary improvements to Colorado Blvd/CR 13 and Hwy 52 adjacent to the project may be required as determined by Town staff's application of the Town Land Use Code and evaluation of master traffic study for the entirety of Miners' Park Town Centre. Such improvements may include various components such as: a. Widening Colorado Blvd to its ultimate cross-section width of 100'-120' (arterial); b. Widening State Highway 52 to accommodate turning lanes Per CDOT Standards c. Acceleration/deceleration lanes; d. Center turn lane; e. Landscaping; f. Sidewalks or trails; g. Drainage swales; h. Relocating/undergrounding existing overhead power lines; i. Waterline, loop system tie-into system on the west side of Colorado Blvd j. Signalization intersection or round about 2. Maple St must be constructed to its ultimate cross-section width of 75' (collector); 3. Fiber optic must be extended as needed; 4. A regional detention facility must be constructed if required by drainage study; 5. Signage and entryway features for the Town and commercial center must be constructed. Area Improvements 1. 13th St will be constructed in the Area to its ultimate cross-section width of 75' (collector); 2. Main St and 15th St (local streets)will be extended to serve the Area; 3. Culverts will be installed in drainage way to facilitate crossing at 13th St and Main St; 4. An appropriate drainage study and drainage plan will be developed for the Area; 5. Rough and finished grading will be necessary; 6. Construct an on-site detention facility if required by drainage study; 7. Expansive soils will be addressed as necessary according to soils report; 8. Install required landscaping along property abutting public ROW; March 20,2014 Page 7 of 11 Miners' Park Town Centre Urban Renewal Plan 9. Installation of wet utilities (water, sanitary sewer, storm sewer and raw water line) will be necessary; 10. Installation of dry utilities (Electric, Natural Gas, Fiber, Cable,etc.) will be necessary. 6. Urban Renewal Project Financing Any and all financing methods legally available to the Town, the Authority, public body, special district, metropolitan district, private developer, redeveloper, or owner maybe used to finance in whole or in part any and all costs of the Urban Renewal Project. Such methods may be combined to finance all or any part of activities and undertakings throughout the Urban Renewal Area. The majority of the Urban Renewal Project outlined in this plan will be financed initially by the developer of the property using private funds and the Town of Frederick using public funds. However, eligible expenditures made by either party may be reimbursed through the Authority using Tax-Increment Financing (TIF)funds as described below. The Authority is authorized to finance this Urban Renewal Project by any method authorized by the Act or any other applicable law, including without limitation, appropriations, loans or advances from the Town;federal loans and grants; state loans and grants; interest income; pay as you go arrangements; annual appropriation agreements; agreements with public and private parties or entities; sale of securities; property and sales tax increments; loans, advances and grants from any other available source. Any and all financing methods legally available to the Town, the Authority, any private developer, redeveloper or owner may be used to finance in whole or in part any and all costs, including without limitation,the cost of public improvements, described or anticipated in the Plan or in any manner related or incidental to the development of the Area. Such methods may be combined to finance all or any part of the Urban Renewal Project. Any financing method authorized by the Plan or by any applicable law, including without limitation, the Act, may be used to pay the principal of and interest on and to establish reserves for indebtedness (whether funded, refunded, assumed or otherwise) incurred by the Authority or the Town to finance the Urban Renewal Project in whole or in part. The Authority is authorized to issue notes, bonds or any other financing instruments or documents in amounts sufficient to finance all or part of the Urban Renewal Project. The Authority is authorized to borrow funds and to create indebtedness in carrying out this Plan. The principal, interest and any premiums due on or in connection with such indebtedness may be paid from tax increments or any other funds available to the Authority. The Urban Renewal Project may be financed by the Authority under the tax allocation (or TIF) financing provisions of the Act. Under the tax allocation method of financing the Urban Renewal Project, property taxes levied after the effective date of the approval of this Plan upon taxable property in the Area each year by or for the benefit of any public body or all or a portion of municipal sales taxes collected within the Area, or both such taxes, shall be divided March 20, 2014 Page 8 of 11 Miners' Park Town Centre Urban Renewal Plan for a period not to exceed twenty0five (25) years after the effective date of the adoption of this tax allocation provision, as follows: Base Amount That portion of the taxes which are produced by the levy at the rate fixed each year by or for such public body upon the valuation for assessment of taxable property in the Area last certified prior to the effective date of approval of the Plan or, as to an area later added to the Area,the effective date of the modification of the Plan, and, subject to the Board of Trustees approval, that portion of municipal sales taxes collected within the boundaries of the Area in the twelve-month period ending on the last day of the month prior to the effective date of the approval of the Plan, or, in the case of municipal sales taxes, both such portions, shall be paid in to the funds of each such public body as are all other taxes collected by or for said public body. Increment Amount That portion of said property taxes in excess of such base amount or, subject to Board of Trustees approval, that portion of said municipal sales taxes in excess of such base amount, or both, shall be allocated to and, when collected, paid into a special fund of the Authority to pay the principal of, the interest on, and any premiums due in connection with the bonds of, loans or advances to, or indebtedness incurred by(whether funded, refunded, assumed or otherwise) the Authority for financing or refinancing, in whole or in part, the Urban Renewal Project described in the Plan. Unless and until the total valuation for assessment of the taxable property in the Area exceeds the base valuation for assessment of the taxable property in the Area, all of the taxes levied upon taxable property in the Area shall be paid into the funds of the respective public bodies. Unless and until all or the relevant part of the municipal sales tax collections in the Area exceed the base year municipal sales tax collections in the Area, all such sales tax collections shall be paid in the funds of the Town. When such bonds, loans, advances and indebtedness, including interest thereon and any premiums due in connection therewith, have been paid, all taxes upon the taxable property in the Area shall be paid into the funds of the respective public bodies and all such municipal sales tax collections in the Area shall be paid into the funds of the Town. The increment portion of the taxes, as described in this Section 6, may be irrevocably pledged by the Authority for the payment of the principal of, the interest on, and any premiums due in connection with such bonds, loans, advances and indebtedness incurred by the Authority to finance the Urban Renewal Project described in the Plan. 7. Local Regulatory Compliance This Urban Renewal Plan currently complies with, or, upon completion of the project, will comply with all of the following local documents: March 20, 2014 Page 9 of 11 Miners' Park Town Centre Urban Renewal Plan • Town of Frederick Comprehensive Plan —2006 • Town of Frederick Land Use Code—2005 • Town of Frederick Design Standards and Construction Specifications—2007 • International Building Code—2012 (adopted by Town with minor revisions) Comprehensive Plan As required by the Act, the Town Planning Commission must confirm that this Urban Renewal Plan not only complies with the Town of Frederick Comprehensive Plan, but that it will serve help implement Comprehensive Plan goals and policies.The Urban Renewal Plan will implement the following goals and policies of the Comprehensive Plan. Goal 2: Create a healthy balance between housing, employment, availability of goods and services, recreation and cultural opportunities within the community. Goal 10: Strive for a diverse, balanced business community that brings economic vitality, while maintaining a balance with population and community character. Policy 10.5: Complete vital sections of the Town's infrastructure where needed. Policy 10.7: Locate economic development in appropriate and viable locations. Goal 11: Encourage the growth of commercial services within the Town while preserving the community character and meeting the needs of the citizens. Policy 11.3: Encourage the development of community and regional commercial sites. Goal 12: Provide the opportunity for the Highway 52 corridor east of Weld County Road 11 to develop as a mixed-use corridor. Goal 14: Provide and maintain a roadway network, which meets Frederick's circulation and access needs in a safe, economical, and efficient manner. Goal 16: Maintain Frederick as a desirable community through the installation of public improvements, providing a high level of service. Land Use Code The Town Land Use Code is comprised of a number of separate articles that regulate different things, all of which future development in the Area must comply with. Article 3 addresses zoning, density and dimensional standards thereby governing the types of land uses that can be conducted in different zoning districts throughout the town, and the manner in which buildings may be oriented on development sites. Other major plan components that will need to meet code include public notice (Article 4), architecture, landscaping, parking,fencing and sidewalks (Article 2). Design Standards and Construction Specifications This document outlines the technical standards by which Town Engineering Staff reviews construction plans for public improvements such as roads, water and sewer lines, and drainage March 20,2014 Page 10 of 11 Miners' Park Town Centre Urban Renewal Plan systems. All required public improvements, such as dry utilities, water, sewer and drainage infrastructure must comply with Town standards upon construction. Building Code The Town is currently in the process of adopting the 2012 International Building Code (IBC) with minor revisions. No structures currently exist on the site, but all future buildings will be required to meet the 2012 IBC. 8. Changes in Approved Plan The Plan may be modified pursuant to the provisions of the Act governing such modifications, including Section 31-25-107, C.R.S. 9. Minor Variations In specific cases, the Town Manager or Board of Trustees may allow minor exceptions or variations from the provisions of the Plan if the Town Manager or Board of Trustees determines that literal compliance or enforcement of the provisions of the Plan would constitute an unreasonable restriction, limitation, or hardship beyond the intent and purpose of the Plan. It responds to the requirements outlined in C.R.S. 31-25-107 (3.5): C.R.S. 31-25-107:APPROVAL OF URBAN RENEWAL PLANS BY THE LOCAL GOVERNING BODY (3.5) "Prior to the approval of an urban renewal plan, the governing body shall submit such plan to the board of county commissioners, which shall include, at a minimum, the following information concerning the impact of such plan: (a) The estimated duration of time to complete the urban renewal project; (b) The estimated annual property tax increment to be generated by the urban renewal project and the portion of such property tax increment to be allocated during this time period to fund the urban renewal project; (c) An estimate of the impact of the urban renewal project on county revenues and on the cost and extent of additional county infrastructure and services required to serve development within the proposed urban renewal area, and the benefit of improvements within the urban renewal area to existing county infrastructure; (d) A statement setting forth the method under which the authority or the municipality will finance, or that agreements are in place to finance, any additional county infrastructure and services required to serve development in the urban renewal area for the period in which all or any portion of the property taxes described in subparagraph (ii) of paragraph (a) of subsection (9)of this section and levied by a county are paid to the authority; and (e) Any other estimated impacts of the urban renewal project on county services or revenues. Summary of Urban Renewal Plan Development Program The proposed development program for the Miners'Park Town Centre Urban Renewal Plan (the Urban Renewal Area) is based on the current property zoning, plans of property owners and prospective developers and is subject to change. The anticipated development program is summarized in Table 1. Table 1: Miners' Park Town Centre Urban Renewal Plan Development Program Land Use Developed SF/Units Retail 389,300 (20-year Build-Out) 1 The Redevelopment program in Table 1 is purely speculative as no development projects are currently proposed for the site. While it is anticipated that development will take place in the Urban Renewal Area, it is impossible to speculate with complete accuracy on the timing, nature, or value of such new construction due to the lack of more specific project information. Development Timing The development timetable for the proposed Urban Renewal Area will be determined by prevailing market conditions at the time of development.The current development plan contemplates a mix of commercial uses such as grocery/discount stores, restaurants, services and small retail. For the purposes of this analysis, aproximately 400,000 square feet is shown as occurring in roughly 20,000 square foot annual increments over a 20 year build-out period. Summary Impacts to Weld County Table 2 provides a summary of property tax revenues that could be generated from new taxable redevelopment within the Urban Renewal Area. These estimates are based on the development program outlined above and reflect the entire 25-year tax increment period. It is anticipated that the entire property tax increment over the 25-year period would be dedicated to the Urban Renewal Project. The Frederick Urban Renewal Authority reached an agreement with Weld County whereby 50%of new property tax revenues generated through Weld County's millage would be allocated to the Authority via Tax- Increment Financing. Property Tax Revenue As shown in Table 2, based on the proposed development program, the Urban Renewal Area would generate approximately$14,153,550 in total incremental property tax revenues over the 25-year analysis period. During the 25-year tax increment period,the County's share of property tax revenue is limited to its share of the property tax base plus 50%of the increment generated through its millage. The County's total share of property tax revenue would be approximately$1,178,387 over the 25-year period. During this same tax increment period, the total amount allocated to the Authority in property tax increment revenues is roughly estimated at$9,000,000.1 After the 25-year tax increment period is completed,the County's share of property tax revenues would RISE TO approximately$192,666 on an annual basis. County Services/Infrastructure Because the entire Urban Renewal Area is located within the Town of Frederick's municipal boundaries, the Town, the Authority, and other public entities, such as special districts,will be responsible for all public improvements including street, water, sewer, and all public utilities. All police, fire, and other services will be provided by entities other than the County.There may be some indirect impact on County services, but these should be offset by increases in property tax base allocation, and an increase in County sales tax collections based on activities stimulated by the Urban Renewal Authority. Infrastructure impacts associated with the proposed development program are assumed to be primarily financed by private development with assistance from the Authority using property tax increment revenue, which has been allocated to the Authority by the provisions of section 31-25-107(9), C.R.S.
