This same Order 407-776 pools all nonconsenting interests in that wclibore unit, treats the unleased nonconsenting owners as the owner of a landowner's royalty equal to 12.5% of such owner's record interest,and allows the consenting owners to recover, out of the nonconsenting owner's proportionate 87.5%share of production,the costs specified in Colo. Rev. Stat. §34-60-1 16(7)(b)—generally,100%of the unleased owner's share of the cost of surface equipment beyond the wellhead connections plus operating costs,as well as 200%of their share of the costs of staking,well site preparation, obtaining rights-of-way, rigging up, drilling, reworking, deepening or plugging back, testing, and completing the well plus equipment in the well, including wellhead connections.
