Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: This site is in a State defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements. Existing and proposed sites must provide an engineered water quality design as part of the planning process. The design and narrative must be stamped and signed by a licensed professional engineer in the State of Colorado. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. This project is adjacent to business highway 34. Email from CDOT dated April 11, 2014 indicated "based upon the information provided, CDOT considers the access to be a legal, grandfathered access. Provided no changes to the volume of traffic using the access is proposed, CDOT has no further comment." CONDITIONS OF APPROVAL: None DEVELOPMENT STANDARDS 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. This site is located in a State Designated, Municipal Separate Storm Sewer System (MS4) Area which may trigger specific water quality requirements or other drainage improvements if the lot develops further. Department of Public Health and Environment CASE NO.: COZ14-0004 NAME: Moran Environmental Health Services has reviewed this proposal to rezone 4.65 acres from the R-1 (Residential) Zone District to the C-3 (Commercial) Zone District. There is an existing residence on the parcel that is served by the City of Greeley for water and an individual septic system (permit G19840161) provides sewer. Once a site plan review is submitted, this Division will require specific items such as; dust and waste handling plans and an air emission permit depending on the land use. The Division recommends that the following should appear as notes on the change of zone plat: 1. Water service shall be obtained from the City of Greeley. 2. This parcel is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. If land development exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 6. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. 7. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. MEMORANDUM rj C " To: Chris Gathman, Planner June 16, 2014 From: Bethany Salzman, Zoning Compliance Officer Subject: COZ14-0004 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV14-00047)was noted. This violation was initiated due to the operation of a commercial business and storage of related equipment without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will make it possible to submit the appropriate land use permits to correct the violation. Annexation E The subject property is contiguous with the City of Greeley. Properties immediately adjacent to the parcel to the north, west, and south are all within city limits. The subject site meets the state's contiguity standard for annexation, and likely would meet all other annexation criteria when a petition for annexation is submitted. As such, it is requested that the subject property annex into the City of Greeley. The property is currently served by City water, although it appears there is no pre- annexation agreement that would require annexation with an expansion of use, as is being sought currently. Nonetheless, continued use of City water services will be better if the property is within city limits. Though it appears to not be contemplated at this time, if sewer service is sought, the property will then be required to annex. Comprehensive Plans ❑ The subject property is within the City of Greeley's Long Range Expected Growth Area (LREGA). The LREGA is the range in which the community anticipates growing within the coming 20+ years. Urban development in this area functions best when it is integrated and consistent with other existing urban development in the region. n Weld County's Comprehensive Plan contains a policy that encourages annexation of this property. The site is within the City's Urban Growth Boundary, as defined by the County, based on the availability of urban and municipal services. Note, in particular, the following goals from Section 22-2-40 of the County Code: Page 1 of 3 UD.Goal 1. Concentrate urban development within existing municipalities, an approved Intergovernmental Agreement urban growth area, the Regional Urbanization Areas, County Urban Growth Boundary Areas, Urban Development Nodes or where urban infrastructure is currently available or reasonably obtainable. UD.Policy 3.3. Inside the County Urban Growth Boundary, urban-type uses and services are planned and supported, and annexation is encouraged. C.Goal 1. Promote the location of commercial uses within municipalities, County Urban Growth Boundary areas, Intergovernmental Agreement urban growth areas, growth management areas as defined in municipal comprehensive plans, the Regional Urbanization Areas, Urban Development Nodes or where adequate services are currently available or reasonably obtainable.
