This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: An Access Permit is required. For new accesses and/or change of use, the fee and photos are required (see access permit application). For access permit questions contact Public Works. Tracking control is required to prevent tracking from the site onto the public roadways. Standard tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet of pavement plus double cattle guards. Alternatives such as recycled AC, recycled concrete, or gravel may be considered with lighter traffic impact projects. The traffic information provided with the submittal states that the site will develop approx. 1000-18 wheel trucks annually shipping product offsite. (Peak Traffic is between March 1 and July 1 with approx. 40 trucks/week. Normal truck traffic is between 5 and 20 trucks/week.) Other truck traffic estimates 15 trucks/week. Total numbers of employees at one time is 15. A right of way permit is required for any work within the County right of way. A special transport permit is required for over length, width, height, or weight vehicles. Contact Public Works. Improvements/Road Maintenance Agreement: A draft of the agreement will be provided to the applicant after approval of the application at the BOCC hearing. Collateral is required to ensure the improvements are made. o Road Maintenance will be included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. Weld County will defer to the State for all drainage requirements. A stamped Drainage Report was submitted. A Weld County Grading Permit will be required if disturbing more than 1 acre by the planning department. A Construction Stormwater Permit is required with the State for disturbing more than 1 acre. An Improvements Agreement between the Applicant and the County will be required for this project. CONDITIONS OF APPROVAL: Prior to recording the plat: A. An Improvements Agreement and Road Maintenance Agreement is required for this site. Road maintenance including dust control, damage repair, and triggers for improvements will be included. B. An accepted Final Drainage Report stamped and signed by a Professional Engineer registered in the State of Colorado is required. The plat shall be amended to delineate the following: A. County Road 78 is designated on the Weld County Road Classification Plan as a paved local road which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of- way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. B. Show the approved access(es) on the plat and label with the approved access permit number(will be provided). C. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. B. Right of way permit is required for any work within the public right of way. C. Special transport permit is required for any over size or over weight vehicles. Prior to Operation: A. Accepted construction drawings and construction of the offsite roadway improvements are required prior to operation. DEVELOPMENT STANDARDS 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. The right-of-way or easement shall be graded and drained to provide an all-weather access. The site is served by an existing septic system and is serviced by North County Water District. An Engineering Design and Operations Plan (EDOP) was submitted and the CDPHE conducted a "technical review" of the EDOP. The Final EDOP was submitted May 2014 and WCDPHE considers this the "approved EDOP". A contingency plan was submitted as part of the EDOP. The contingency plan includes procedures that will be employed to control dust, flies, odor, noise, and litter. Additionally, the applicant submitted an approved dust abatement plan and waste management plan. The dust abatement plan stipulates that vehicle speeds will be limited to 10 mph, truck loads will be covered, and water will be utilized to suppress dust. The waste management plan indicates that waste generated from operations will be disposed of off-site at a permitted facility. The applicant provided Weld County with an Aboveground Storage Tank (AST) registration form from the Colorado Department of Labor and Employment (CDLE), Division of Oil and Public Safety (OPS) and a Spill Prevention, Control, and Countermeasure (SPCC) Plan for the regulated Oil Storage Tank Located onsite. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval. We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility at all times shall operate in accordance with the approved Engineering Design and Operations Plan dated May 2014. If during the operational activities of this facility information is revealed that changes the currently held concept of the site, the Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment may request modifications to the Engineering Design and Operations Plan. In addition, regulatory changes that the Colorado Department of Public Health and Environment may implement in the future may also become binding and necessitate modifications to the Engineering Design and Operations Plan. 2. Composting Operations will not extend past CD boundaries of the property. 3. All EDOP-required reports and EDOP-required recordkeeping information will be submitted to the WCDPHE upon request and maintained at the facility. 4. The applicant shall notify the CDPHE Air Pollution Control Division (APCD) and obtain the appropriate APCD permits for the facility, as necessary. 5. The applicant shall notify the CDPHE Water Quality Control Division (WQCD) and obtain the appropriate WQCD permits and update the storm water permit for the facility, as necessary. 6. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and/or removed for final disposal in a manner that protects against surface and groundwater contamination. 7. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended, or those wastes being composted in accordance with the approved Engineering Design and Operations Plan. 8. The facility shall receive and process only those materials that are described in the submitted application materials and Engineering Design and Operations Plan (EDOP) dated May 20142014 and materials as approved in accordance with the Waste Characterization Plan included in the EDOP. 9. Dead animals (mortalities) shall be considered a Special Waste, consistent with the approved EDOP-Waste Management Plan, and written approval shall be obtained from the CDPHE and WCDPHE prior to accepting mortalities for composting. 10.Wastes which could otherwise be considered hazardous (or could contain constituents of concern) should the waste not qualify for a categorical exemption (e.g. remediation wastes, petroleum contaminated waste, and exploration/production wastes) shall be considered a Special Waste, consistent 2 with the approved EDOP Waste Management Plan, and written approval shall be obtained from the CDPHE and WCDPHE prior to acceptance. 11.Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved EDOP-Contingency Plan at all times. 12.Facility will have a written Standard Operating Procedure (SOP) for each composting procedure utilized. Standard operating procedures and a detailed description of processing units and processing requirements shall be kept onsite and provided to the Weld County Health Department for review and approval/modification, upon request. The description shall include literature and other examples that demonstrate the unit is an effective composting process, as necessary. 13.Generator Waste Profiles, as specified in the approved-EDOP, will be available for all Type Ill feedstock and Special Wastes in accordance with the Waste Characterization Plan. The facility will discontinue acceptance of Type III feedstock and Special Waste feedstock approved by A-1/A-1 Representative upon request from the CDPHE or WCDPHE. 14.The facility shall comply with all provisions of the CDLE OPS Storage Tank Regulations. All CDLE OPS records, including but not limited to monthly and annual visual inspection records, will be provided to WCDPHE upon request. 15.Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall operate in accordance with the approved EDOP Contingency Plan, at all times. 16.This facility shall adhere to the maximum permissible noise levels allowed in the non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 17.Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 18.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants and volatile organic compounds. All chemicals must be stored in accordance with manufacturer's recommendations. 19.The facility shall be operated in a manner to control pests and flies. The facility shall be operated in accordance, at all times, with the approved EDOP Contingency Plan. Additional fly control measures shall be implemented at the 3 request of the Weld County Department of Public Health and Environment in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition requiring abatement. 20.The facility shall be operated in a manner to prevent odors and in accordance with their approved EDOP Contingency Plan. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Case Number: USR14-0030 Parcel Number: 070735200014-R2048203 After reviewing the application and documents submitted the Building Department has the following comments: A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any new structures ,additions or renovation to any structures. A building permit application must be completed and two complete sets of engineered plans. A Code Analysis prepared by a design professional, licensed bin the Ste of Colorado shall be submitted with permit application. MSDS sheets for all materials stored shall be submitted with building permit applications. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code.
