Noble is authorized to withhold payment pending resolution of a title dispute or adverse claim asserted regarding the interest in production claimed herein by the
undersigned. The undersigned agrees to indemnify and reimburse Noble any amount attributable to an interest to which the undersigned is not entitled.
Noble may accrue proceeds until the total amount equals $25.00, or clear ALL payable proceeds annually if said accrued total amount is less than $25.00, or as
required by applicable state statute.

or gas field, $1.00 per acre per year. If the lands are wholly
within the known geologic structure of a producing gas
field,$2.00 per acre per year.

Special Provisions: This Lease was segregated from Base Lease COC-27508
per Decision dated April 28, 2004, issued by the Bureau of
Land Management.
This is a Federal Oil and Gas Lease. It contains numerous

OIL AND GAS LEASE - SURFACE DISTURBANCE STIPULATIONS
1. Notwithstanding any provision of this lease to the contrary, any drilling, construction
or other operation of the leased lands that will disturb the surface thereof or otherwise
affect the environment (hereinafter called "surface disturbing operation") conducted by
lessee shall be subject, as set forth in this stipulation, to the prior approval of such
operation by the District Engineer, Geological Survey, in consultation with the appropriate
surface management agency and to such reasonable conditions, not inconsistent with the
purposes for which this lease is issued, as the Engineer may require to protect the
surface of the leased lands and the environment.
2. Prior to entry upon the land or the disturbance of the surface thereof for drilling or
other purposes, the lessee shall submit for approval two copies of a map and explanation

An environmental analysis will be made by the Geological Survey in consultation with the
appropriate surface management agency for the purpose of insuring proper protection of the
surface, the natural resources, the environment, existing improvements, and for assuring
timely reclamation of disturbed lands.
3. Upon completion of said environmental analysis, the District Engineer, Geological Survey,
shall notify lessee of the conditions, if any, to which the proposed surface disturbing
operations will be subject.
Said conditions may relate to any of the following:
(a) The location of drilling or other exploratory or developmental operations or
the manner in which they are to be conducted;
(b) The types of vehicles that may be used and the areas in which they may be used;
and
(c) The manner or location in which improvements such as roads, buildings, pipelines,
or other improvements are to be constructed.
4. The plan of operation required by item 2 above must assure adequate protection of drainage:
waterbodies, springs, or fish and wildlife habitat, steep slopes or fragile soil. The
lessee agrees that during periods of adverse conditions due to climatic factors such as
thawing, heavy rains, or flooding, all activities creating irreparable or extensive damage;
as determined by the surface managing agency, will be suspended or the plan of operation
modified and agreed upon.
5. Protection of Cultural Resources

1. Engage the services of a qualified professional archeologist (and:a,his-
torian, when appropriate), approved by the Bureau of Land Management, to
conduct a thorough and complete intensive survey of areas to be disturbed
for evidences of archeological or historic sites or materials.
2. Provide the lessor sufficient time to review documentary evidence that a survey
as required by 5 A (1) above, has been performed. This evidence shall be in
the form of a report prepared on behalf of the lessee, certified by the
archeologist, and submitted by the lessee to the lessor, and shall cover at
a minimum: Location of area(s) surveyed, methods of survey employed, report
of findings, conclusions/recommendations.
3. Follow the mitigation requirements set forth by the lessor concerning pro-
tection, preservation, or disposition of any sites of material discovered.
In cases where salvage excavation is necessary, the cost of such excavations
shall be borne by the lessee.
B. The lessee shall immediately bring to the attention of the lessor any and all
antiquities or other objects of historic or scientific interest including but
not limited to historic or prehistoric ruins, fossils, or artifacts discovered
-as a result of operations under this lease and shall leave such discoveries
intact until told to proceed by the lessor.

resources requiring protection and/cr mitigation measures to be undertaken tiU
by the operator.

The operator may, at his discretion and cost, conduct the inventory on the 0 N
lands :o be disturbed. This inventory must be done by ar under the supervision P
of a qualified archeologist approved by the Forest Service. Upon review of the n rr
inventory report, the Forest Service will specify those cultural resources 0 lV
requiring protection and/or mitigation measures to be undertaken by the
tDerator.
(b) The operator shall ihmediately bring to the attention of the Distric: Ranger
any and all antiquities or other objects of historic or scientific interest
including, out net limited to historic or prehistoric ruins, fossils, or
artifacts discovered as a result of operations under Cr approved operating
plan, and shall leave such discoveries intact until authorized to proceed
oy the District Ranger. Protective and/or mitigative measures specified by the
