WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 26th day of June, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption number 324 , being the property of Fred Lamutt, being more particularly described as follows : A resubdivision of Lot 5, Vantage Acres Filing No. 2, Weld County, Colorado, being a part of Section 17, Township 1 North, Range 65 West of the 6th P.M. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purpose of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations. Fred Lamutt for a recorded exemption. The ' subject property is described as Lot 5, Vantage Acres, 2nd Filing, a subdivision located in SW$ Section 17, T1N, R65W of the 6th P.M. , Weld County, Colorado. This property is located 21 miles south- ) west of Hudson. The property in question contains approximately 19 acres more or less of Class VI soils. The request is to split the property into parcels of 10. 825 acres and 8. 00 acres. On May 17, 1978 , the Board of County Commissioners approved a request by Mr. Fred Lamutt for a Lot Size Variance so that he could make application for this recorded exemption. At the time they made the decision on that request , the Department of Planning Services Staff submitted a letter of recommendation to the Board. A copy of that letter of recommendation is included in the attached packet. On June 22, 1978, the Weld County Board of Adjustment approved a request by Mr. Fred Lamutt for a variance of 150 feet from the requirement of 180 feet of lot frontage onto a public road as set forth in Section 3. 14 of the Weld County Zoning Resolu- tion and Section 9-4A. (3) of the Weld County Subdivision Regula- tions. Nothing has been received by our office which would change b our recommendation of approval for this request as outlined in the letteo the Board of County Commissioners dated May 17, 1978 . We have owned and lived on this property since 1969 and we now desire to sell part of the property. To do this, we need to divide the property into an eight acre parcel and onealmost eleven acres, as shown on the enclosed plat. In support of this request, we offer the following: 1 . This lot, as all the lots in this half section, was withdrawn from agriculture more than 10 years ago, when it was subdivided and zoned Residential-agricultural. While this category of zoning has been eliminated, the use of the property has not changed from its principal residential use. Nineteen acres is too small a parcel to ever again be effectively used fo commercial agriculture. Dividing the property will not significantly change its use. 2. There are platted subdivisions with lots of 10 acres or less in most of the surrounding sections. Dividing this property will not significantly affect the principal land use in the area. 3. Nineteen acres, while too small to farm effectively, is too large for a country residence. All other lots within Vantage Acres are 10 acres or less. There is considerable demand for homes and building sites of 10 acres or less, but very little demand for sites over 10 acres. 4. Both resulting parcels will have frontage on the existing county road, as shown on the plat. The existing lane will remain part of the back lot. The owner of the front lot will have a permanent access easement on the lane. This will result in adequate access to both parcels without any addition to the county road system. 5. The eight acre parcel has an existing house of approximately '500 square feet. It is anticipated that Vantage Acres 55 a house of similar size and value will be built on the Hudson,Cololrado 80642 303536-4324 other parcel. (6) states : "That the original tract or parcel of land to be divided under this section meets the minimum lot size requirements established by the Weld County Zoning Resolution ; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the Comprehensive Plan area of an existing incor- porated town of Weld County.
