It's my understanding that after December 31, 2008 non-commercial Class II injection disposal wells are supposed to
obtain land use permits. This Department attended a pre-application meeting at the Planning Department and provided
information to EOG regarding expected environmental related land use conditions. It would be helpful if the applicant
provided photos of the current site and operations in the application. It appears the main issues to address would be
the truck unloading pad and the containment for the tanks associated with the injection well. The following expected
environmental health related conditions should be relayed to EOG for their use as a "punch list":
Prior To Recording the Plat:
The applicant shall file an Air Pollution Emissions Notice (APEN)with the Air Pollution Control Division, Colorado
Department of Public Health and Environment. Evidence of such shall be submitted in writing to the Weld County
Department of Planning Services.
A Ground Water Monitoring Plan shall be submitted to the Weld County Health Department of Public Health and
Environment for review and approval. Evidence of such shall be submitted in writing to the Weld County Department
of Planning Services.
If appropriate, a Storm Water Discharge Permit coverage shall be obtained from the Colorado Department of Public
Health and Environment, Water Quality Control Division for construction activities. Evidence of such shall be
submitted in writing..
Prior to Release of Building Permits:
Detailed plans for the concrete secondary containment structure for all storage and processing tanks shall be
submitted. Secondary containment volume shall provide containment for the entire contents of the largest single tank
plus sufficient freeboard to allow for precipitation. The Weld County Department of Public Health and Environment
will consider structures other than concrete, provided a Colorado Registered Profession Engineer provides a
certification indicating that the proposed structure meets or exceeds the expected function of a concrete structure in
regards to containment, spills, and unintended releases.
A detailed design for a concrete truck unloading pad shall be submitted to the Weld County Department of Public
health and Environment for review and approval. The design shall demonstrate how all spilled wastes, stormwater,
and pad wash down water will be contained within the receiving area and concrete pad and sump. The design shall
also include the method in which seems will be sealed to prevent leakage through the concrete pad. A leak detection
system shall be designed and installed beneath the concrete unloading pad. The concrete unloading pad shall be
constructed and operated in accordance with the approved design. Written evidence of the Department of the Weld
County Department of Public Health and Environment approval of the concrete unloading pad and leak detection
design shall be provided to the Department of Planning Services.
A Detailed Closure Plan shall be submitted to the Weld County Department of Public Health and Environment and the
Colorado Oil and Gas Conservation Commission. The Closure Plan shall include a description of the manner in which
the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No
structures or equipment associated with the facility shall remain on the property following closure.

The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a
third-party closure of the facility, including the plugging and abandonment of the well, in accordance with industry
standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its
original grade. The facility shall submit evidence to the WCDPHE that the appropriate financial assurance has been
obtained.
Prior to Operation:
The applicant shall submit evidence to the Weld County Department of Public Health and Environment, Weld County
Department of Planning Services, and the Colorado Oil and gas Conservation Commission that the facility was
constructed in accordance with application materials.
Development Standards:
The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur.
No disposal of waste, other than produced water piped from nearby wells operated by the injection well operator is
permitted. Any changes from this approved use would require an amendment to this Special Use Permit.
Recovered crude/condensate loadout operations shall be conducted in a manner, which prevents leakage or
discharge onto the ground outside the concrete containment area. Spill prevention measures shall be employed
when making connections and during loadout operations. Portable containment, such as drip pans, shall be
utilized when working outside the containment area.
Spill Prevention Control and Countermeasures Plan (SPCC) shall be prepared and maintained on site pr 40 CFR 112.
Fugitive dust and fugitive particulate emissions shall be controlled on this site.
All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's
recommendations.
The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the
CDPHE Air Pollution Control Division.
Analytical data on wastes and environmental monitoring data shall be made available to WCDPHE, who reserves the
right to require additional more extensive monitoring.
All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall
be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater
contamination.
Any contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules
and regulations.
The facility shall comply with the approved groundwater monitoring plan.
All storm water, which has come into contact with waste materials on the site, shall be confined on the site.
Portable toilets may be utilized and shall be maintained in a sanitary condition.
The operation shall comply with all applicable rules and regulations of the Colorado Oil & Gas Conservation
Commission, other State and Federal agencies, and the Weld County Code.

Building Department Review Comments

Parcel:
Dear Sir/Madam,
The Weld County Building Department has reviewed the history and investigated any complaints or violations that
accompany the parcel. The findings are as followed:
The proposed business and structures will occupy a non-improved lot. No structures are currently located on this
parcel.
An Oil and Gas building permit will be required for all structures,foundations,electrical, plumbing and mechanical
systems covered in the 2012 I-Codes.
A MFG permit will be required for all construction trailers that will be onsite prior to them being setup on the site.
On the back of this permit you will find the necessary items that must be submitted with the application.
The submittal must be complete with all the documents before it can be accepted.
In addition this building will require the following.
Engineered drawings for all structural work and architectural drawings that show the floor plan,elevations,ect.
Also,a life safety plan showing occupancy and building type,egress routes,emergency lights/exist,frontages,and
travel distance must be submitted.
A ComCheck for the building envelope,mechanical,and electrical must be submitted showing that the building will
comply with the 2006 International Energy Code for all occupied buildings with heat that will maintain a
temperature of 68 degs.
Bathroom plans with details must be submitted to show accessibility. Also an overall accessibility plan must be
submitted.
Mechanical,plumbing and electrical drawings with a one line and fault current calculations are required.
The building must comply with the requirements set forth by local fire jurisdiction.
A letter of notification stating that they have received the drawings and that they are ok with the release of the
building permit must be submitted to our office with the application.
Currently we are under the 2006 IECC,2011 NEC and the 2012 IBC, IRC, IFGC, IMC and IPC.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to
county planning directors, this office will only perform a cursory review of the referral information and
provide informal comments. The comments do not address the adequacy of the water supply plan for
this project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply plan or
infrastructure, the issuance of a well permit, or physical availability of water.
The applicant is seeking a Site Specific Development Plan and Use by Special Review permit for
mineral resource development including an oil and gas support facility (Class II oilfield waste disposal
facility—saltwater injection facility and associated facilities). There is no proposed water supply for the
project. Therefore, this office has no comment on the proposal.
