A public hearing was conducted on October 22, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 18, 2014, and duly published
September 23, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Russell Gurtler, Jr. Family Trust, do Kerr-McGee Oil & Gas Onshore, LP, for a Site
Specific Development Plan and Use by Special Review Permit, USR14-0048, for Mineral
Resource Development Facilities, Oil and Gas Support and Service, including Oil and Gas
Processing Facilities and related equipment, centralized oil stabilization facility, transloading;
and any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the
Commercial or Industrial Zone Districts, provided that the property is not a lot in an approved or
recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations
controlling subdivisions, and more than two (2) cargo (conex) containers in the A (Agricultural)
Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record.
la Kim Ogle, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as
written. He reviewed surrounding land uses, area USRs, and the nearest residences. No

correspondence has been received. He explained what the facility does and showed images of
the site, the existing facility and the design of the stabilization tanks.
Jennifer Petrik, Department of Public Works, provided a brief overview of the
transportation plans and requirements.
e Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions. They can use Central Weld Water or an individual well, either way, they will
put in an engineer-designed septic system, a Dust Abatement Plan was approved, they will
need a spillage retention berm, and an Emergency Action and Safety Plan. Commissioner
Kirkmeyer asked what exactly the facility does.

Kim Cooke gave a presentation on the facility on behalf of Kerr-McGee. She explained
the enhancements of infrastructure for increased efficiency, and the benefits of this type of
facility versus having well tanks at individual well site locations. She explained the process: light
hydrocarbons are separated from the heavier ones which maximize the liquid, and she reviewed
the proposed equipment on the site, noting this will have reduced environmental impact.
e In response to Commissioner Conway, she confirmed this decreases the footprint at
individual well site and reduces truck traffic.
Fi No public testimony was offered concerning this matter.
• Commissioner Kirkmeyer asked about safety concerns at a site with this much oil because
she doesn't know much about this oil stabilization process and stated concern about the
industrialization of Weld County.
El Joe Aucoin, Anadarko Project Manager, explained the process in detail: fizzy oil and flash
gas are some of the common terms and the tanks are 250,000 barrels each. They will possibly
need a second facility at some point. The natural gas liquids go into a pipeline. They are not
monitored by the state and there is no waste leaving the site; there is a little bit of water. In
response to Commissioner Kirkmeyer, he confirmed they got a letter about proceeding with
construction at their own risk on constructing these tanks, they are 800 feet from CR 49, no
truck trips are for hauling, the lifespan of the tanks is 40-70 years, and there is a fire
suppression system on top of the tanks with a foam agent.
Commissioner Conway asked about the tank's structural integrity and how widely
employed these tanks are. Mr. Aucoin said they oversee the construction and there are also
third-party evaluations of the construction which are onsite. He confirmed these tanks are not
new to the industry, there are hundreds in Oklahoma and Texas, and he is not aware of any
spills resulting from the failure of these types of tanks.
.WI Chair Rademacher addressed criteria paragraph #2.A.2, regarding legislation, and
Commissioner Kirkmeyer explained this just states a goal from the Comprehensive Plan.

Mr. Ogle confirmed screening refers to any storage at the site, as there is an adjacent residence
to the north, as well as the need for downcast lighting. Commissioner Kirkmeyer addressed
Condition of Approval #1.E.9; wherein CR 49 is classified as an arterial road but is being
widened to a Parkway (essentially a small highway) with 300 feet of right-of-way, in addition to
70 on either side, a total of 740 at full build-out: "County Road 49 Parkway requires 740 feet of
right-of-way at full build-out, an additional 340 feet shall be delineated on the plat." Mr. Ogle
clarified future setbacks would be measured from this right-of-way. This was done by assent of
the Board. Commissioner Kirkmeyer then referred to Condition of Approval #1.A and asked
what Colorado Interstate Gas Company, LLC wants. Mr. Ogle replied they just want a Surface
Use Agreement; therefore, the word "attempt" to address concerns was added by the Board.
e In response to Chair Rademacher, Mr. Aucoin indicated he has reviewed, and agrees to
abide by, the Conditions of Approval and Development Standards, as amended.
ti Commissioner Garcia moved to approve the request of Russell Gurtler, Jr. Family Trust,
c/o Kerr-McGee Oil & Gas Onshore LP, for a Site Specific Development Plan and Use by
Special Review Permit, USR14-0048, for Mineral Resource Development Facilities, Oil and Gas
Support and Service, including Oil and Gas Processing Facilities and related equipment,
centralized oil stabilization facility, transloading; and any Use permitted as a Use by Right,
Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts,
provided that the property is not a lot in an approved or recorded subdivision plat or part of a
map or plan filed prior to adoption of any regulations controlling subdivisions, and more than
two (2) cargo (conex) containers in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
E Commissioner Kirkmeyer said she feels some consternation as to the size of these tanks
and expressed disappointment that Anadarko did not discuss this facility with the Board prior to
this hearing. She said it may be OK in this area, but putting these things all over the County
isn't desirable. There needs to be some comprehensive planning to address the proliferation of
