HomeMy WebLinkAbout20142134.tiff RESOLUTION RE: APPROVE HOME SERVICE AGREEMENT AND AUTHORIZE CHAIR TO SIGN-FATHER FLANAGAN'S BOYS' HOME WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Home Service Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Father Flanagan's Boys' Home, commencing July 1, 2014, and ending June 30, 2016, with further terms and conditions being as stated in said agreement, and WHEREAS, after review,the Board deems it advisable to approve said agreement,a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the a Home Service Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Father Flanagan's Boys' Home, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Griego, Director H an Se ices RE: Father Flanagan's Boys' Home Service Agreement Contract D between the Weld County Department of Human Services and Father Flanagan's Boys' Home Enclosed for Board approval is a Child Protection Agreement for Services between the Department and Father Flanagan's Boys' Home. This Child Protection Agreement was reviewed under the Board's Pass-Around Memorandum, in e-mail form, dated July 9, 2014, and approved for placement on the Board's Agenda. We have found a placement for an 8 year old boy under our guardianship. It is out of state and located at Boy's Town,Nebraska, at a rate of$554 per day. Based on the child's history and age, we were not successful in our efforts to place him in the State of Colorado. If you have any questions, please telephone me at extension 6510. 2014-2134 FATHER FLANAGAN'S BOYS'HOME SERVICE AGREEMENT CONTRACT D This Agreement, by and between Weld County Department of Human Services ("Agency') and Father Flanagan's Boys' Home, a tax exempt public benefit (charitable) corporation ("FFBH"), Is for the provision of a continuum of child and family services provided by Boys Town as defined and described below and in any attachments hereto. 1. Scope of Services: FFBH shall render services for and/or on behalf all youths placed in one of the FFBH's Continuum of Children and Family Services. 2. Payment Terms and Conditions: FFBH shall be compensated for services at the following unit rate: $554.00 per day per youth for Residential Treatment Center Services (EAST&WEST/SUDYKA); $291.00 per day per youth for Enhanced Family Home Services; $291.00 per day per youth for Intervention and Assessment Services; and, $236.00 per day per youth for Family Home Services. FFBH shall be compensated for the date of the youth's entry into FFBH's facility or program, but not for the date of youth's discharge from FFBH's facility or program. The Agency shall make payment within thirty (30) days of submission of an invoice. 3. Medical, Dental, Pharmacy and Optometry: FFBH will be fmandally responsible for all medical, dental, psychiatric, pharmacy, optometry, and therapeutic care provided to a youth up to a maximum of$5,000 annually. Any medical, dental, pharmacy or optometry needs that exceed the$5,000 maximum annually will be the finandal responsibility of the Agency. 4. Transportation: FFBH shall be financially responsibility for transportation costs, including those at the time of admission and departure as well as visits for youth, relative or other. 5. Discharge/Transition: FFBH shall participate in discharge planning to assist with youth transition. If FFBH determines the youth cannot continue to be served within its programs, FFBH will give ten (10) working days written notice of its intent to discharge, induding the reasons for discharge. 6. Clothing and Personal Needs: The Agency is responsible to ensure that youth has adequate clothing for the duration of treatment in FFBH's programs. 7. Term: The Initial Term of this Agreement shall be for two (2) years, commencing on July 1, 2014 through June 30, 2016. 8. Termination of Service Agreement: Either party may terminate this Agreement in its entirety by giving the other party at least thirty (30) days written notice prior to the effective date of termination. In the event of termination, FFBH shall be compensated for each day that the youth remains in the FFBH's program. 9. Records Keeping: FFBH shall maintain documentation for all services and charges made to the Agency under this Agreement, and, further, the books, records, and documents of FFBH Insofar as they relate to this Agreement shall be maintained for a period of seven (7) full years from the date of the final payment made hereunder, and, further, the Payor, through an appropriate person designated by it, shall upon the giving of seven (7) days prior notice have the right to inspect same. All records shall be kept confidential and maintained in accordance with applicable standards depending upon their type, The Agency agrees that FFBH may maintain all records pertaining to this contract in electronic file format, and destroy any paper records from which the electronic files may have been created. Assignments: FFBH may assign its duties under this Agreement and enter into a sub-agreement for the services (or any portion thereof) to be performed hereunder without obtaining the Agency's consent. 12. Dispute Resolution: Agency and FFBH agree to cooperate to resolve differences in interpretation of this Agreement or to resolve disputes as to the adequacy of the parties' compliance with their respective obligations under this Agreement. Within ten (10) working days of the execution of this Agreement, each party shall designate one (1) person to act as that Party's representative for dispute resolution purposes and shall notify the other Party of the person's name, business address, telephone number and e-mail address. Within ten (10) working days from delivery of a written request by one Party's representative to the other for dispute resolution, the representatives shall confer to attempt to resolve the disagreement. If the representatives cannot reach such a satisfactory dispute resolution, either representative may refer the dispute to the Chief Executive Officers of the Parties. The Chief Executive Officers shall thereafter confer to attempt to resolve the dispute. Nothing in this Agreement shall preclude either Party from seeking relief from a court of law relating to any differences or disputes arising under this Agreement. The obligations of this paragraph survive termination or expiration of this Agreement. 13. Indemnification: FFBH agrees to indemnify and hold harmless the Agency, its officers, employees and agents for and from any and all claims, demands, losses, or suits in law or equity which may result from any negligent acts or omissions of FFBH in connection with this Agreement. The Agency shall give timely written notice of any such claim, demand, loss or suit to FFBH to allow FFBH to make effective defense against or otherwise resolve same. Agency shall indemnify, defend and hold FFBH and FFBH officers, agents, and employees harmless from all claims, suits, judgments, damages, and attorneys' fees and costs which arise from any acts, actions, negligence or omissions by Agency and Agency's employees or agents and which relate to the performance or operation of this agreement. 14. Severability: In the event any one or more of the provisions contained in this Agreement or any application thereof shall be found to be invalid, illegal or unenforceable in any respect, validity, legality or enforceability of the remaining provisions of this Agreement and application thereof shall not in any way be affected or impaired thereby. 15. Amendments: This Agreement may not be amended except by written agreement explicitly identifying this Agreement and itself as an amendment that is signed by both parties and dated. 16. Governing Law: This Agreement is executed and entered into in the State of Nebraska. This Agreement shall be construed, performed, and enforced in accordance with Nebraska law, including provisions for conflict of laws. Venue for any action arising from this Agreement shall lie in Douglas County, Nebraska. 17. Entire Agreement: This Agreement constitutes the entire agreement and represents the understanding between the Parties relative to matters addressed in this Agreement. Children and families can begin services at any point and move between levels all within the same treatment model. This unique approach enables us to help more children and families in more ways, with the same expectations for positive results. For children, this means being successful in school, at home and on the job while growing into productive citizens. For families, it means having a safe home, being able to solve problems and staying together. To support the Integrated Continuum, fundamental principles cut across all service levels. These Unifying Elements ensure we're always putting the needs of children and families first in providing consistent, effective care and treatment. Integrated Continuum Service Levels: Residential Treatment Centers (EAST/WEST/SUDYKA) Enhanced Family Homes Intervention and Assessment Services Family Home Program Residential Treatment Centers (EAST/WEST/SUDYKA) Residential Treatment Center The Boys Town Residential Treatment Center is a medically directed program for children with psychiatric disorders. These children's serious behavior issues require that they receive intensive treatment in a short-term residential setting. The program has two environments in which children can receive treatment, depending on their needs. A facility-secure environment is offered for more seriously troubled children who require around-the- clock supervision, intense therapy and numerous other safety and program features. A less-restrictive staff-secure environment allows children to progress toward learning daily living skills and developing appropriate, healthy socialization. The Center is licensed by the Nebraska Department of Health and Human Services as a Mental Health Center and Child Caring Agency. As part of Boys Town National Research Hospital®, the Center is accredited by The Joint Commission. When children no longer require the intensive level of care this program provides, they may step down in our Integrated Continuum of Care® to the Boys Town Family Home Programs"', where professionally trained caregivers help meet their daily needs. Children who need further medically directed treatments receive it from professionally trained therapists in an outpatient setting. Enhanced Family Homes Enhanced Family Homes provide specialized care for up to six boys or girls, usually ages 10 to 18, in a family-style setting. These children have serious behavioral and/or emotional problems and require more attention and individualized care than a community-based foster home can offer. Married couples called Family-Teachers and their assistants meet the children's daily needs while teaching social and independent-living skills that will help them succeed in school, with their families and in the community. Clinical and medical supervision is an integral part of the program and trained professionals are on call for support 24/7. Like all other services and programs in Boys Town's Integrated Continuum of Care, care provided through the Enhanced Family Homes is based on the research-proven Boys Town Model. Intervention and Assessment Services Boys Town's Intervention and Assessment Services provide emergency, short-term, 24-hour care in a residential setting for boys and girls ages 10 to 18. Many have been abused and/or neglected, are runaways, or have come through the Juvenile Justice system. When youth enter these services, professionally trained staff members begin assessing their safety, health, and treatment needs in order to determine and plan for the best permanent care arrangement. The primary goals at this level of service are to remove youth from dangerous situations and/or provide temporary care. Every child receives an immediate behavioral intervention, and may also receive additional clinical assessments based on the child's needs and the desire of the referral source. Staff members also teach youth social skills, ensure that they continue going to school, and work with youth (and when possible, their families) to develop individualized, skill-focused treatment plans that address behavior problem areas. Whenever possible, staff help youth work toward reunification with their family. Like all other services and programs in Boys Town's Integrated Continuum of Care, care provided through Intervention and Assessment Services is based on the research-proven Boys Town Model. Family Home Program At this service level, youth with serious behavioral or emotional problems live in a family-style home and receive care from professionally trained married couples called Family-Teachers. Six to eight boys or girls, usually ages 10 to 18, live in each home. The couple and a full-time Assistant Family-Teacher are responsible for providing structured supervision for youth in their daily living and treatment activities. This includes meeting the educational, medical, psychological, emotional, and behavioral needs of the youth in care. A major focus of this program is teaching youth social, independent-living, and educational skills, and helping them build healthy relationships with others. With a focus on reunification, the Family-Teaching staff works with families to achieve permanency, safety, and child well-being. Like all other services and programs in Boys Town's Integrated Continuum of Care, care provided in the Family Home Program is based on the research-proven Boys Town Model.
