The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
This project lies north of SH 392 between CR25 and CR27. The parcel number is 080518000036.
The traffic information provided with the submittal states that the site is used by 6 to 12 people seasonally
to get equipment and job assignments to work offsite.
The access is a shared access. Documentation supporting legal use of the shared access is required.
A shared road maintenance agreement is not required but is strongly encouraged for shared accesses to
avoid property owner conflicts in the future.
Please provide a drainage narrative including the following: 1) where the water originates if it flows onto
the property from an offsite source 2) where it flows to as it leaves the property 3) the direction of flow
across the property 4) if there have been previous drainage problems with the property5) The overall site
imperviousness
A water quality calculation was included, however the water quality feature was not shown on the plat. A
Water Quality Feature is required onsite downstream of the business activities such as parking, buildings,
storage areas etc... The area can be an existing low point or excavated area that will capture the
stormwater and contaminants prior to flowing offsite. Please show the water quality feature on the plat
and label as "No Build/Storage Area" and include the required volume.
A Weld County Grading Permit will be required if disturbing more than 1 acre by the planning department.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:

CONDITIONS OF APPROVAL/REQUIREMENTS:
1. Prior to recording the plat:
A. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to
the state highways. Please contact CDOT to verify the access permit or for any additional
requirement that may be needed to obtain or upgrade the permit.
B. The plat shall be amended to delineate the following:

1. Show the approved CDOT accesses on the plat and label with access permit number
if applicable.
2. The applicant shall indicate specifically on the plat the type of right-of-way/easement
and indicate whether it is dedicated, private, or deeded to provide adequate access
to the parcel.
5. Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required
prior to the start of construction.
DEVELOPMENT STANDARDS/NOTES ON THE PLAT
1. Should noxious weeds exist on the property, or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for a use permitted as a
Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or
industrial zone districts (Vehicle and Equipment Parking and Staging for a Landscape
Maintenance Business), provided that the property is not a Lot in an approved or
recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District.
There will be up to 12 seasonal employees accessing the site to pick up and drop off
equipment. According to the application, the employees will only be on site to prepare
for off-site job duties. Site access will be restricted to the owner and employees; no
customers will be accessing the site.
It is the policy of this department that portable toilets are allowed when employees are
on site for less than 2 consecutive hours a day. As personnel will be on site for a short
duration, in accordance with Environmental Health Services policy the use of portable
toilets will be allowed.
The applicant submitted a dust abatement plan which states that the access drive and
business area will be covered in recycled asphalt, vehicle speeds will be reduced and
truck loads will be covered.
The waste handling plan states that a dumpster will be provided for refuse and will be
serviced by Northern Colorado Disposal. Organic materials and lawn debris will be
taken to A-1 Organics.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. In the event washing of vehicles and equipment will occur on site the applicant
shall ensure that any vehicle and equipment washing areas shall capture all
effluent and prevent discharges from the washing of vehicles and equipment in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency. Vehicle or equipment
washing areas should be designated on the plat.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved "waste handling plan", at all times.
4. Any vehicle and equipment washing areas shall capture all effluent and prevent
discharges from washing of vehicles and equipment in accordance with the
Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in
the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the
Weld County Department of Public Health and Environment. Portable toilets

shall be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
8. All pesticides, fertilizer, and other potentially hazardous chemicals must be
handled in a safe manner in accordance with product labeling and in a manner
that minimizes the release of hazardous air pollutants (HAP's) and volatile
organic compounds (VOC's). All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
9. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.
