I do not believe the concerts and music will be able to be kept at a level consistent with Sec. 14-9-30. Standard levels for such activities are well above the maximum allowable limits listed in Sec. 14-9-40 (see attached). The requested aviation related activities, Air Shows and Helicopter Rides, will also create an unacceptable amount of noise. (Further concerns about the aviation activities addressed below). 2: Alcohol. In addition to hosting concerts, will they be serving alcohol? If not will they allow alcohol consumption on the property, and what security measures will be in place with regards to this. 3: Trash and Dust. As many people as are possible on high volume days, there will be a lot of trash. What is the plan to clean up blowing trash from the County Roads and adjoining properties? For the dust, our concern is that the amount of vehicle traffic possible will generate more dust than can be suppressed by watering the dirt roads and parking lots. 4: Traffic Congestion. The County Roads boarding the Hankins Farm are small 2 lane roads that already have quite a bit of congestion. The 4 way stop at County Roads 17 and 54 currently experiences a large number of accidents. We do not feel the roads will be able to accept the traffic during some of the planned activities. Also, the planned parking may not be sufficient during some of the planned activities resulting in parking along the sides of the County Roads. The plan also stated 75% of the traffic will come from the North. Where did this number come from? What study was done to validate this claim, there is no mention of it in the plan. 5: Security. Some of the listed planned activities will not attract only families, and a rise in crime will be inevitable. What are the security plans to prevent issues on adjoining properties? I have been told by more than one Weld County Deputy that their resources are stretched thin as it is, especially at night. 6: Corn, Egg and Pumpkin Cannons. Where a person can build such things for personal use legally, to operate them in a commercial venue and allow others to operate them is quite another story. The ATF should be involved in such classifications as these. (see attached). There is no mention in the plan of how they plan to comply with the ATF. These items have also been known to fire projectiles quite a far distance; Pumpkin Cannons regularly cover distances of over a mile. This relates to possible damage and injuries on adjoining properties. EXHIBIT n D$ 7: Lighting. The plan is not very specific about how the lighting will be diverted from adjoining properties. Excess light will be a standard of living issue. 8: Aviation Activities. There is no mention of FAA approval in the plan. Besides being noisy, Air Shows are inherently dangerous. They are usually held at airports because of the need for proper emergency services. Is the listed Johnstown Fire District able to deal with aircraft accidents, and do they plan to move their resources to the Hankins Farm during such activities? An emergency landing site is needed during Air Shows as well, yet there is no runway shown in the plan map. Federal Aviation Regulation 91.145 deals with Air Shows, how do they intend to comply with the FAA's Regulations? There are 2 close by airports that will be impacted by this type of operation, as well as approach corridors to DIA, how do they intend to address these airspace issues? Helicopter Rides also have no mention of FAA compliance. If the Helicopter is to take off and land from the farm, then that is a Fixed Base of Operation. What is the plan for FAA approval for the FBO. Also, what is the plan to comply with Federal Aviation Regulation 91.147? Or do they plan to operate within part 135 of the regulations? If so what is that plan? Hot Air Balloon Launch Site, again the fore mentioned airspace issues come in to play. What is the plan for Balloon Launches? In conclusion, this request will lower the standard of living for a lot of residents in the area. It does not appear to be well thought out at all, and does not appear to be consistent with the intent of the A (Agricultural) Zone District, nor does it appear compatible with the existing surrounding land uses, nor are there adequate provisions for the protection of the health, safety, and welfare of the people in the area . This adjacent property has fabulous views of the Front Range and the Big Thompson Valley. From the beginning of our ownership, it is our vision, as well as the City of Greeley's expectation, that our property would be developed into a large, residential, estate-home community. Our development will serve as an exquisite doorway for western Greeley. The proposed project, as represented, should not detract from our vision. However, we have two major concerns: While the Hankins project proposes that only All Terrain Vehicles (500-1200 lbs.) will be "used for day-to-day operations around activities area," we remain concerned that the property's use might eventually be expanded to include a motocross or similar ATV racetrack. We strongly object to this type of use because it would cause a severe audible nuisance as well as producing dust and air pollution. Such use would dramatically affect our ability to market our property in addition to reducing the quality of life and diminishing the appeal of this Greeley corridor. Secondly, we are equally concerned that the "outdoor activities" of the proposed project may eventually include a firearm shooting range. We take no objection to use of "paintball guns" or similar air powered rifles, however, the use of firearms is an inherently dangerous and extremely noisy activity. A firearm range would be a direct assault on the peaceful nature of the entire area. Therefore, we support the approval of the proposed project if the County, and/or applicant, can provide assurances and/or restrictions that prohibit the property's use as a motocross/racetrack as well as any and all use of firearms. Given the applicant's proposal, we do not anticipate that these restrictions should create any controversy. We shall remain involved during this approval process and greatly appreciate any updates or questions regarding our position. Aungst: We are writing to express our concerns and disapproval regarding the above- referenced proposal presently under review by the Weld County Planning Department. We are adjacent property owners , immediately to the south of the subject property to be used for this entertainment venture . None of the proposed activities including pumpkin patch , corn maze , vintage plane flyovers/air shows , disc/frisbee golf, giant jump pillows , laser tag and zip lines , to mention a few, are of an agricultural nature , nor support agriculture and have no place in our agricultural community. Weld County Code, Section 22 -2- 10 B. "The intent of the agricultural Goals is to support all forms of the agricultural industry and , at the same time , to protect the rights of the private property owners to convert their agricultural lands to other appropriate land uses . The County recognizes the importance of maintaining large contiguous parcels of productive agricultural lands in nonurbanizing areas of the County to support the economies of scale required for large agricultural operations ." Weld County Code, Section 22-2-20 B. states, "Goal 2 . Continue the commitment to viable agriculture in Weld County through mitigated protection of established (and potentially expanding) agricultural uses from other proposed new uses that would hinder the operations of the agricultural enterprises ." This is primarily a farming area with large and small farm vehicles and equipment accessing and using the roadways daily. Allowing these activities in this area is inconsistent with the Weld County Code and would hinder the ability E BIT Diana Aungst August 15 , 2014 Page Two of the neighboring farmers to conduct and perform their livelihood . The activities proposed by Hankins Entertainment, LLC in no way promote agriculture in the county. "Drainage Plan - Hankins Review Application 'The parking area sits to the south of the activities area on pasture that slopes to the East, West and South . All excess water drains into the sloughs that run to the south on the property. " This is not true . The sloughs referenced above drain into Parsons Gulch which runs on property owned by the Kautz ' to the west and empty into a pond on the Kautz' property. There is no plan outlined to ensure the wastewater, dirt, mud , trash , and debris from a 1 , 000 people a day will not be washed into the sloughs and in turn into this pond . Our farm has the rights to the water contained in this pond and it is used for watering livestock on our property. Allowing this land use would threaten the safe delivery of uncontaminated water to our property. See Section 22 -2 - 10C of the Weld County Code, which states , "The diversion and application of irrigation waters to farmland in the County has been the main economic driver for the County since the 1860s . Currently, the majority of these waters are used for irrigation . In addition , shallow wells in alluvial areas are also productive sources of irrigation . As the population expands , so does the need for domestic, commercial and industrial supplies . Land use regulations in the County should protect the infrastructure used for the delivery of water to users ." [Emphasis Added] See Also - Weld County Code, Section 22-2-20 D. "A. Goal 4. Promote a quality environment which is free of derelict vehicles, refuse , litter and other unsightly materials ." With regard to excessive/offensive noise levels which would be pervasive for this type of use, "Noise Control Plan - Hankins Review Application ". . . Periodically during operation hours , staff will monitor sound levels from a distance to determine if further action to dampen or redirect sound is needed . " It is suggested that this is a feasible method to monitor the noise level , having "staff' listen and determine if sound levels are acceptable . There are noise Diana Aungst August 15 , 2014 Page Three standards set forth in the Colorado Revised Statutes for residential , commercial and industrial areas and it is advised these levels be measured by a calibrated instrument and not by someone listening , and in their opinion determining if it is too loud or offensive . The activities which are proposed which will present problems for noise are not activities consistent with permitted uses as allowed in the Weld County Code. Part of the enjoyment of living in the country is the quiet solitude, especially while sitting outside in the evenings . We have just presented a few of our concerns , but there are many more . The waste management and dust abatement plans are not adequate . What is the plan for security on site , other than coverage by the Johnstown Police Department? Having 1 , 000 people a day coming into this area brings a wide variety of people into our community who would not otherwise be there . This use would most definitely bring with it an increase in crime . In summary, this use by special review is NOT consistent with Weld County Code, Chapter 22. As stated in the Weld County' s Right to Farm Statement, "Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area." The above statement says it all . We would welcome a phone call from you , one of the staff in your department or even the commissioners to discuss this matter in more detail , but wanted to make sure , as property owners who will be directly impacted by this plan , that you know we are strongly against it.
