Staff comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Issues of concern must be resolved with the Public Works Department. Our comments and requirements are as follows: COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 47 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 140-foot right-of-way and the road is maintained by the Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR62 is a local paved road and requires a 60-foot right-of-way. There is presently a 60-foot right-of-way and this road is maintained by Weld County. REQUIREMENTS: Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code Drainage: The historical flow patterns and run-off amounts will be maintained. Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Department of Public Health and Environment CASE NO.: COZ14-0003 NAME: Mile High Investments, LLC and Big Thompson Investment Holdings, LLC Environmental Health Services has reviewed this proposal to rezone 65.3 acres from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District. The City of Greeley will provide water and an individual septic system will provide sewage disposal. The application states water will be provided by the City of Greeley but no information was included in the application from Greeley. The Division recommends a will-serve letter from the City of Greeley is received prior to recording the plat. Once a site plan review is submitted, this Division will require specific items such as; dust and waste handling plans and an air emission permit depending on the land use. If approval is granted, the Division recommends the following conditions: Prior to recording the plat: 1. Submit documentation from the City of Greeley indicating that water service is available. The following should appear as notes on the change of zone and final plats: 1. Water service shall be obtained from the City of Greeley. 2. This parcel is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. 8. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. General ❑ Water Service& Annexation Requirement. The appl i cati on proposes using North Weld County Water District (NWCWD)water services. Community Development staff has inquired with the City Water & Sever Department as to whether North Weld County Water District had yet advised them of a request from the owner/laid use applicant to receive service, per an Intergovernmental (I GA) Water ServiceAgreement between NWCWD and the City of Greeley that stipulates notice to Greeley and Greel ey's right to request to serve a property within the areas wi thi n the City of Gred ey's Long Range Expected Growth Area Boundary. The Water and Sewer Department indicates that they have not received notice to date. However, based on applicant's representation of using the City of Greeley water services and in consideration of water infrastructure conditions in the subject area, the City Water & Sewer Department plans to function as the service provider for water, if contacted. Furthermore, in accordance with the Water and Sewer Board and City Council Joint Resolution No. 66 (1998), the Water& Sever Department will require annexation of the property prior to providing water service(based on an initid assessment that the property meets criteria for annexation, including more than one-sixth contiguity). Water and Sewer ❑ Code. The proposal property is Iocated within the City of Greeley Long Range Expected Growth Area and the regionally-adopted 208 Sewer Service Boundary. With any future laid use appl i cati ons, if there are any proposal structures requesting sanitary sewer servicewithin 400 feet of an existing City of Greeley sanitary sewer man, the City of Greeley will expect to provide sanitary sewer service. (Weld County Code Chapter 30- 2-40.G.3). It is the policy of the Weld County Board of Health and the Weld County Board of County Commissioners to require the use of public sewer systems where and whenever feasible. If the Weld County Department of Public Health and Environment does not permit the septic system proposed as an option for this project, an existing 8" main along the western limits of the property is avai labl e for connection. The property will be required to annex into the City of Greeley prior to service being provided, per Joint Resolution No. 66 (1998). Staff also understands that with construction within the Union Colony Industrial Park that sanitary sewer is being considered for construction adjacent to County Road 47 to serve the associated DFA development. As with the western sewer Iine, prior to connecting the subject property to any sanitary sewer I i ne associated with the Union Colony Industrial Park, should that occur, this subject property will be required to annex into the City of Greeley.
