HomeMy WebLinkAbout770444.tiff RESOLUTION RE: WELD COUNTY ZONING VIOLATION OF SOUTHERN WELD COUNTY SPORTSMAN ASSOCIATION. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter , are vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it has come to the attention of the Weld County Board of County Commissioners that the Southern Weld County Sports- man Association has been conducting a trapshooting range on A-Agricultural zoned land southwest of Fort Lupton, Colorado, more particularly described as: Part of the Nz of Section 7 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, under the Weld County Zoning Resolution, outdoor shooting ranges are not uses by right in A-Agricultural zoned property, and WHEREAS, under the Weld County Zoning Resolution, in order to continue the outdoor shooting range, the Southern Weld County Sportsman Association must apply for, and be granted a special use permit, and WHEREAS , the Southern Weld County Sportsman Association has scheduled major trapshoots for April 3 , April 24 and May 22 , 1977 , and WHEREAS , there is not sufficient time to proceed through the administrative process, and obtain a special use permit to cover all these dates, and WHEREAS , the Southern Weld County Sportsman Association did not intentionally violate the Weld County Zoning Resolution, and is requesting the Board of County Commissioners to grant temporary permission to operate the trapshooting range. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the Southern Weld County Sportsman Association be granted temporary permission to use the above-described property as an outdoor trapshooting range, pro- vided, however, that the Southern Weld County Sportsman Association 770444 shall use due diligence in seeking a special use permit. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of March, A.D. , 1977. The above and foregoing Resolution was read into the record and signed on the 30th day of March, A.D. , 1977 . The general feeling of understanding which came from the meeting was that the South Weld County Sportsman' s Association would submit an application for a Special Use Permit to comply with the Weld County Zoning Resolution in the operation of the outdoor trapshooting range. On March 28 , 1977, the Weld County Board of County Commissioners granted temporary permission to use the outdoor trapshooting range for three major trapshoots provided, however, that the South Weld County Sportsman ' s Association proceed with due diligence in seeking a Special Use Permit . I would appreciate it if you could contact this office at your earliest convenience to discuss the current status of your application for a Special Use Permit . It is the intention of this office to assist and cooperate with you in whatever way we can to help correct this zoning violation . Rabas : On July 1, 1977 , a letter was sent to you asking you to contact this office to inform us of the current status of the application for a Special Use Permit for the outdoor trapshooting range which the SWCSA plans to use. Receiving no response from you, I contacted Mr. Tom Lenzie by telephone at which time he indicated that a letter was being prepared that would address our request for information . To date we have not received any correspondence on this matter . For the purpose of documentation concerning this matter, I would appreciate it if you would, as President of the SWCSA, draft a letter which addresses the current status of your progress in applying for the Special Use Permit, any problems you are encountering , and the present use of the land on which the trapshooting facilities are located. Cussakkka- Chuck Cunliffe Zoning Inspector CC : sap cc : Kay Norton, Assistant County Attorney ✓Clerk to the Board November 16 , 1977 Chuck Cunlif£e , Planning Department , informed this Office today that after receiving his letter , the Sportsman Association telephoned him to say that they did not have the money with which to apply for a SUP . Todate they have still not made application, however , Mr . Cunliffe assured this Office that the Association is not using their facilities and that he would periodically check on them to insure that they are not in violation of the County regulations . rjk March 22, 1977 Weld County Zoning Administrator Tom Uonn 915-10th Street Greeley, Colorado 80631 Dear Mr. llonn: This letter is in reference to the Southern Weld County Sportsman Association Special Use Permit for a Trap Shooting Range located southwest of Fort Lupton. As an introduction, S.W.C.S.A. is a Colorado non-profit corporation, and a National Rifle Association Senior Club, our by laws and basis of operation call for the pursuit of conservation, restoration, and safe recreational shooting. The organization's membership is open to the general public. At present our membership is 25 to 30 individuals from Fort Lupton, Hudson, Brighton, Dacono, Firestone, Frederick, and Platteville. We have been in existance for 17 months. Our immediate plans call for a trap shooting range which is the money making tool that will support the following projected functions with the Fort Lupton School; firearms familarization and safe-handling, hunter safety, high school trap shooting teams, Jr. & Sr. small-bore shooting teams. Our organization will supply certified instructors, equipment, as financially able, and all technology. We, also, where possible, plan to work with the Colorado Wildlife Division to take on conservation and wildlife restoration projects. Again, all finances are and will be derived from membership dues and proceeds from the trap range. We are covered by $300,000 liability insurance. We do have qualified firearms, hunter safety, and range master personnel with-in our membership and we have the support of the Fort Lupton community leaders including the local law enforcement department. S.W.C.S.A. realizes ignorance is no excuse to the law and with the investment we have, you may be assured every effort within our means will be applied toward securing proper Special Use Permit. We have scheduled major shoots for April 3, April 24, and May 22, 1977. We would appreciate your approval to hold these scheduled shoots in lei of the lengthy and necessary paper work needed in securing the Special Use Permit. The current Trap Range location is set with safety first in mind and we have com- plied with N.R.A. and A.T.A. specifications. We have held previous shoots with Ex- cellent co-operation and success.'
