The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 120 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. No traffic counts for CR 120 are available at this location. REQUIREMENTS: Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Access Permit: The approved Access Permit number for the Koskie Pit is AP14-00178. The site entrance is to be located on CR 120; the tracking control device will be cattle guards. There will be a 45'-60' turning radius at the entrance. Drainage: Best Management Practices minimize erosion and sediment transport from the site, protecting water resources and adjacent properties. Traffic: Trucks may vary from pick-up size to 15-ton tandems or semi-trucks and trailers at 25 tons. Generally, vehicle weights will fall within 85,000± pounds or less. Haul truck traffic is between 25 and 30 trucks entering/exiting the site multiple times on a gravel haul route day. As this is a temporary use, portable toilets and bottled water are acceptable for sanitary uses. Noise will be restricted to the level allowed in the industrial zone district. Noise can be limited by utilizing white noise backup beepers, equipment located at bottom of pit and a circular mining pattern. The application indicates the portable plant will be located at the bottom of the pit. Dust abatement will consist of watering roads and not mining when there are high winds. Water for dust control will be trucked in. Waste will be placed in covered receptacles which will be taken to Public Works and then to the landfill as needed. The State does not require registration of aboveground fuel storage tanks associated with gravel pits as long as the following requirement is adhered to: "Aboveground storage tanks used to store flammable and combustible liquids at mining facilities and construction and earthmoving projects, including gravel pits, quarries, and borrow pits where, in the opinion of the state inspector of oils, tight control by the owner or contractor and isolation from other structures make it unnecessary to meet the requirements of this article." All fuel tanks shall be contained within a secondary containment berm. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the Air Pollution Control Division, Colorado Department of Health and Environment that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 2 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 9. All potentially hazardous chemicals must be handled in a safe manner, in accordance with product labeling, and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 10.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 11.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 3 Submit by Email Ar Weld County Referral ` vCJy Y. Water Division 1, Water District 1 Dear Ms. Aungst: We have reviewed the above referenced proposal for a site-specific development plan and use by special review for a mineral resource development on approximately 321 acres. The submitted material does not appear to qualify as a "subdivision" as defined in C.R.S. § 30-28- 101(10)(a). Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The proposal is for a gravel mining operation, known as the Koskie Pit, which will be operated under Colorado Division of Reclamation Mining and Safety (DRMS) permit no. M-2014-024. The primary commodities to be mined at the site are sand and gravel for construction projects and road surfacing. The site is proposed to be reclaimed to its current use of non-irrigated cropland upon completion of the mining operation. Comments regarding the reclamation permit were provided to the DRMS in a memo dated May 21, 2014. No groundwater is anticipated to be encountered at the Koskie site; therefore exposure of ground water must not occur during or after mining operations. The site is anticipated to have five or six employees on site, with additional visits by material haul truck drivers and other site users. Bottled drinking water will be provided for employees and visitors, and portable toilets will be located on site. Water for dust control purposes, which is estimated at less than 4,000 gallons per year, is proposed to be provided via truck from County-owned wells permitted for such use. During mining, storm water runoff will generally be contained within the mine pit. Any storm water runoff intercepted by this operation that is not diverted or captured in priority must infiltrate into the ground or be released to the stream system within 72 hours; otherwise a substitute water supply plan or augmentation plan approved by water court must be obtained.
