SUBJECT: USR14-0053, Equus Farms Water Depot
The Weld County Engineering Development has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
A Traffic Narrative was submitted for review. The TN states that they expect 40 truck trips per day to the
site from the north off US 34 and no trips from the south.
No current traffic counts exist on CR 386.
A Traffic Impact Study can be waived and a detailed traffic narrative submitted if the applicant agrees to
the following triggers:
1. 200 vpd or significant dust as identified by County-Mag-Chloride dust abatement
2. 300 vpd alternative pavement
3. 400 vpd pavement
4. 10 vph during peak hour turning left into the facility-left deceleration lane
5. 25 vph during peak hour turning right into the facility-right deceleration lane
6. 50 vph during peak hour turning right out of the facility-right acceleration lane.
The applicant has indicated they are agreeable to these triggers.
Tracking control is required to prevent tracking from the site onto the County Roadway. Standard tracking
control for accesses onto gravel roads includes double cattle guards at the access point. The site plan
shows two cattle guards end to end. Double cattle guard refers to two cattle guard back to back in the
direction of traffic across the entire entrance.
An Access Permit is required. For new accesses and/or change of use, the fee and photos are required
(see access permit application). For access permit questions contact Public Works.
The application indicates there will be no employees on site during operations. Should the site become
over utilized and trucks begin staging onto CR 386, there will not be anyone available to handle the
situation.
The applicant may provide an analysis of the change in imperviousness for the entire property and the full
drainage report with detention might be waived if the impacts on adjacent properties and roadways can
be shown to be insignificant (rule of thumb is 10% or less overall site imperviousness with no increased
downstream impacts). A water quality narrative and depression could be considered instead of a drainage
report and detention pond.
A drainage narrative and water quality feature design was included in the application materials.
CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. An Improvements and Road Maintenance Agreement is required for this site. Road
maintenance including dust control, damage repair, and triggers for improvements will be
included.
The plat shall be amended to delineate the following:
A. County Road 386 is designated on the Weld County Road Classification Plan as a gravel
collector road, which requires 80 feet of right-of-way at full build out. There is presently 60
feet of right-of-way. An additional 10 feet shall be delineated on the plat as future right-of-
way. All setbacks shall be measured from the edge of future right-of-way. The applicant
shall verify the existing right-of-way and the documents creating the right-of-way and this
information shall be noted on the plat. If the right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County.
B. Show standard double cattle guard back to back for tracking control across entire entrance.
C. Show the approved access on the plat and label with the approved access permit number
(will be provided).
D. The applicant shall label the approved water quality feature on the plat as "Water Quality
Feature, No Build/Storage Area", and label the required volume. (Department of Planning
Services-Engineer)
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction.
B. In the event that 1 or more acres are disturbed, the applicant shall obtain a stormwater
discharge permit from the Water Quality Control Division of the Colorado Department of
Public Health and Environment.

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including an oil and gas support and service facility (water depot) in
the A (Agricultural) zone district.
The application included a well permit which will provide water to the water depot. Well
permit 31618-F is permitted for industrial uses.
The application states up to 20 trucks per day could utilize the site.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
Dust abatement will consist of slow speeds and if necessary water will be utilized.
The application states that no waste will be generated on site. Equus staff will monitor
the site daily and remove any trash and take to the dumpsters at the shop. Waste
Management empties the dumpsters weekly.
We have no objections to the proposal; however, we recommend the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld

County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The fresh water storage and loading system shall be operated in a manner to
minimize spills. Fresh water spills should be captured in above-ground
containment areas for reuse or allowed to infiltrate. There shall be no discharge
from this process to surface waters or through the facility's stormwater
management system, in accordance with the Rules and Regulations of the
Colorado Water Quality Control Commission, and the Environmental Protection
Agency.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

comments:
A electrical permit will be required for generator and associated electrical work, per Section 29-3-10 of
the Weld County Code. All work shall conform to 2011 National Electrical Code and Chapter 29 of the
Weld County Code.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide informal comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided herein
cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a
well permit, or physical availability of water.
The applicant proposes use of a 10.8-acre portion of the 456-acre parcel for a
Mineral Resource Development Facility including an Oil and Gas Support and Service
Facility (water depot) on the property.
The applicant proposes to use well permit no. 31618-FP for irrigation, and water for
oil and gas industry. This well exists on the property and is approved to withdraw 163.9
acre-feet per year from the alluvium for irrigation and industrial uses. The approved uses
are consistent with the applicant's proposed uses.

This will work. If they are agreeing to the trigger below that will work for me. The only thing is that the
numbers for the lanes need to be passenger car equivalents. (One semi = 3 vehicles so 4 trucks in the
peak hour making a left will trigger the left turn.)

Traffic volumes aren't really stated so it's difficult to comment. Our concerns would
be with the WCR 386 intersection with SH 34. Depending on the volumes there
might be a need for highway improvements.
