HomeMy WebLinkAbout20141802.tiff RESOLUTION RE: ZONING PERMIT FOR A HOME BUSINESS, ZPHB13-0005, FOR A HOME OCCUPATION - CLASS II (FRONT RANGE SEPTIC A SEPTAGE HAULING BUSINESS) IN THE A (AGRICULTURAL) ZONE DISTRICT - KENNETH AND JAMIE STARMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Zoning Permit for a Home Business, ZPHB13-0005, was submitted by Kenneth and Jamie Starman, 33431 County Road 53, Gill, CO 80624, for a Home Occupation - Class II (Front Range Septic a septage hauling business) in the A (Agricultural) Zone District, for property which is located on the following described real estate, to-wit: Lot A of Second Amended Recorded Exemption, 2ndAmRE-2177; located in part of Section 17, Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, a hearing before the Board was held on the 21st day of May, 2014, at which time the Board deemed it advisable to continue said matter to June 16, 2014, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-4-990.B of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-4-990.D.1 thru D.8 of the Weld County Code as follows: A. Section 23-4-990.D.1 -- Compatibility with surrounding area, harmony with the character of the neighborhood and its effects upon the immediate area. The applicants are requesting approval for a Home Occupation Class II Permit for a septage hauling business. There is not a violation case associated with this property, as the applicants approached the Department of Planning Services inquiring about the necessary permits needed for their business. The application states: 1) The business is incidental and secondary to the use of the dwelling; 2) No more than 50% of the dwelling and accessory building are utilized; 3) Hours of operation are 7:00 a.m., to 7:00 p.m., Monday through Friday; 4) No more than two employees; CC/.°PL(—r3-) ,K 4:3 Sanytco...- 2014-1802 14 PL2539 5) During non-business hours the trucks are parked inside the existing shop; 6) No exterior storage of materials, goods, or equipment will occur (tanks to be constructed underground and pump trucks to be located within shop during non-business hours); and 7) Total trips generated by the site will be less than 16 daily trips (one vehicle produces two trips). B. Section 23-4-990.D.2 -- The proposal is consistent with the policies and goals of Chapter 22 of the Weld County Code. 1) Section 22-2-20.G (A.Goal 7) states: "County land use regulations should protect the individual property owner's right to request a land use change." 2) Section 22-2-100.E (C.Goal 5) states: "Minimize the incompatibilities that occur between commercial uses and surrounding properties." 3) Section 22-2-20.G.2 (A.Policy 7.2) states, "Conversion of agricultural land to nonurban residential, commercial, and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region." The applicants have stated that they live on the property and they are requesting approval of a septage hauling business allowed in the A (Agricultural) Zone District through the Home Occupation Class II Zoning Permit. The activities associated with the business occur on and off-site. The applicant stated there will be no outdoor storage of equipment or materials, including the septage storage tanks. The storage tanks have been designed to be placed underground and are located in an area on the property that is screened to the north by an existing tree line, to the east by an irrigation pond and to the south by the applicant's home and large parcel and to the west by a large parcel used as crop land. The pump trucks are kept inside the existing shop during non-business work hours. The applicants have noted that they will have two employees. C. Section 23-4-990.D.3. -- Availability of adequate water and sewage disposal facilities. The property is served by the North Weld County Water District Account #2701000 as a source of public water and has a septic system (permit number SP-9800104). The existing septic system appears to be designed for six (6) people. In addition, the use of portable toilets is allowed when there are two (2) or less full-time employees, or when employees or contractors are on the site for less than two (2) hours a day. D. Section 23-4-990.D.4. -- The general health, safety and welfare of the inhabitants of the area and the county. The requirements of Section 23-1-90 for a Home Occupation - Class II and Conditions of Approval (attached and part of the Home Occupation - Class II Permit - Conditions and Limitations) will ensure that there are adequate provisions for the 2014-1802 PL2539 protection of health, safety, and welfare of the inhabitants of the neighborhood and the County. E. Section 23-4-990.D.5. -- The proposal is consistent with the definition as expressed in Section 23-1-90 of this Chapter. The applicant is requesting a Zoning Permit for a Home Occupation - Class II per the definition in Section 23-1-90. Based on this information, the applicant is eligible for a (ZPHB) Zoning Permit for a Home Occupation - Class II. The approval of the zoning permit may be conditioned or restricted to carry out the intent of Section 23-1-90 of this Chapter or to mitigate impacts or address concerns of referral agencies. Conditions of approval shall be met prior to recording the permit/agreement, and restrictions may be enforced by means of conditions in the permit/agreement. The Conditions of Approval will mitigate impacts and address concerns of the surrounding property owners. F. Section 23-4-990.D.6. -- The application complies with any Homeowners Association (HOA) standards, if applicable. This parcel is not part of an HOA. G. Section 23-4-990.D.7. -- The proposed zoning permit complies with Division 13 of this Article. The applicant has stated that the activities associated with this home business occur both on and off-site and that there will be three commercial vehicles on site. Two commercial vehicles (vacuum trucks) are owned by the applicant and the septage storage tanks will be underground. Therefore, it appears as if this request for a zoning permit complies with Division 13, Home Occupation-Class II Permits. H. Section 23-4-990.D.8. -- An access is or can be made available that provides for safe ingress and egress to a public road. All accesses shall be in accordance with Chapter 12, Article V of this Code, and shall endeavor to achieve the goal of no "net increase" in the number of accesses onto adjacent County roads when accesses already exist. The site has one access point off of County Road 53. Per the referral comments from the Department of Public Works, dated July 25, 2013, and updated October 21, 2013, there are no concerns identified with the access point for this site. County Road 53 is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. There is currently 60 feet or right-of-way. This road is gravel and maintained by Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Kenneth and Jamie Starman for a Home Business, ZPHB13-0005, for a Home Occupation - Class II (Front Range Septic a septage hauling business) in the A (Agricultural) Zone District, be, and hereby is, granted subject to the following conditions: 1. The following conditions must be met at all times throughout the existence of the Home Occupation—Class II permit: 2014-1802 PL2539 A. HOME OCCUPATION: An incidental use of a DWELLING UNIT for gainful employment of the resident therein, where: 1) Whether a CLASS I or CLASS II, a HOME OCCUPATION may utilize up to fifty percent (50%) of a DWELLING UNIT and/or in ACCESSORY BUILDINGS with appropriate building permits. 2) Such USE is clearly incidental and secondary to the USE of the dwelling for dwelling purposes and shall not change the character thereof. 3) Hours of operation for off loading of septage shall be limited between 7:00 a.m. and 7:00 p.m. 4) There is no exterior storage, display or sales of materials, goods, supplies or equipment related to the operation of such HOME OCCUPATION, nor of any highly explosive or combustible materials. 5) Does not create any negative impacts to the public health, safety and general welfare of the adjacent property owners, such as little or no offensive noise, vibration, smoke, dust, odors, lighting, traffic congestion, trash accumulation, heat, glare or electrical interference, or other hazard or nuisance noticeable off the LOT. 6) HOME OCCUPATIONS shall maintain compliance with Health, Building and all other applicable local, state and federal regulations. 7) HOME OCCUPATION — CLASS II: A HOME OCCUPATION - CLASS II shall be conducted by the inhabitants of the DWELLING UNIT plus up to two (2) external employees and comply with all criteria called out in the HOME OCCUPATION definition above. Two (2) associated COMMERCIAL VEHICLES can be included under this application. There shall only be incidental sales of stocks, supplies or products conducted on the premises. Signage: may consist of a maximum of one (1) nonilluminated sign no more than nine (9) square feet in size which must be attached to the face of the DWELLING UNIT. Does not produce traffic volumes exceeding that produced by the DWELLING UNIT by more than sixteen (16) average daily trips, provided adequate off-street parking is provided. Please keep in mind that one (1) vehicle produces two (2) trips, one (1) when arriving and one (1) when leaving. Therefore, an average of only eight (8) cars can come to the property per day. Trips include those produced by the residents for any purpose related to conducting the business, the two (2) employees, clients, deliveries related to the business, etc. Ordinarily, a HOME OCCUPATION — CLASS II shall include uses similar to hair salon, welding shop, tax preparation with customers, etc., provided it meets the criteria set forth. 2014-1802 PL2539 4 8) The applicant shall maintain compliance with Section 23-4-990 (Chapter 23: Zoning, Article IV Supplementary District Regulations and Zoning Permits, Division 13 Home Occupation — Class II Permits) of the Weld County Code at all times. 9) All activity, equipment and structures related to the Home Occupation must occur on the same lot as the principal dwelling. An Amended Recorded Exemption application shall be submitted within 30 days of the issuance of the Home Occupation Permit. 10) Properly abandon the existing above-ground tanks currently used for storage of septage by removing, cleaning and properly disposing contents, and properly disposing the empty tanks within 90 days of the issuance of this permit. 11) The waste accepted on the site shall be septage only. 12) Tanks and/or vaults must be designed and rated for the storage of septage and permitted by the Weld County Department of Environmental Health in accordance with Section 30 of the Weld County Code. A stamped letter from a licensed engineer certifying the usages of the tanks and or vaults are required. 13) The applicant shall submit a Waste Handling Plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. The plan shall include, at a minimum, the following: a. A list of wastes which are expected to be generated on the site (this should include expected volumes and types of waste generated). b. A list of the type and volume of chemicals expected to be stored on the site. c. The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 14) The underground storage tanks shall be watertight and compatible with the material being stored and the surrounding soil. Metal tanks are prohibited. 15) The applicant shall submit a Spill Containment and Response Plan for the transfer and storage of septage in the permitted tanks on the property. 16) If applicable, the applicant shall submit documentation that floor drain wastes from any vehicle maintenance facility is captured in a watertight vault and hauled off for proper disposal. 2014-1802 PL2539 17) The facility shall be operated in a manner to prevent odors. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented at the request of the Weld County Department of Public Health and Environment in the event odor levels detected off site of the facility meet, or exceed, the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 18) The zoning permit shall not be transferable by the applicant and/or owner to any successor. The zoning permit shall terminate automatically upon conveyance or lease of the property and the existing underground tanks shall be abandoned and removed. 19) There shall be no parking or staging of commercial vehicles on the County roads or rights-of-way. The applicant shall utilize on-site parking only. 20) Provide evidence that the septic trucks are adequately licensed with the Department of Transportation. 21) The manufactured structure cannot be converted to a storage shed and shall be removed from the property, or, approved through a Use by Special Review for a permanent manufactured structure. 22) The existing cargo container must be permitted. 23) A building permit will be required for any new construction, alteration, addition or manufactured structure on the property to be used for the domestic septic business. Any fuel dispensing over 500 gallons require Building Permits and Fire District notification letters, above ground tanks and in ground tank require building permits, exception water tanks less than 5,000 gallons. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following have been adopted by Weld County: 2012 International Codes, 2011 National Electrical Code, and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must be issued prior to the start of construction. B. Timing of Improvements: Permittee shall be required to complete all improvements and/or meet the limitations of the foregoing conditions within 30 days of the issuance of the Permit. C. Violation of Terms: If Permittee does not perform as outlined in this document, such non-performance will constitute a violation of Permittee's Home Occupation - Class II permit granted by County, and County will take whatever remedial measures it deems necessary against Permittee. In addition to any other remedy available to the County in law or equity, a 2014-1802 PL2539 failure to meet the conditions will result in the loss of the permit and in the initiation of legal action against the Permittee. D. Engineering Services: In the event that Permittee is required to complete any improvements or meet any conditions which require the services of an engineer, Permittee shall furnish, at its own expense, all such services. The required engineering services shall be performed by a Professional Engineer and Land Surveyor registered in the State of Colorado, and shall conform to the standards and criteria established by the County for public improvements. The required engineering services shall consist of, but not be limited to, surveys, designs, plans and profiles, estimates, construction supervision, and the submission of necessary documents to the County. E. Successors and Assigns: This Home Occupation - Class II permit may not be delegated, transferred or assigned in whole or in part by Permittee. This Permit shall terminate immediately upon the sale of the Property and or commercial enterprise, the cessation of the commercial enterprise, or the death of the Permittee (if the Permittee is an individual). County's rights and obligations under this Agreement shall automatically be delegated, transferred or assigned to any municipality which, by and through annexation proceedings, has assumed jurisdiction and maintenance responsibility over the roads affected by this Agreement. F. County Engineer: All references in this Agreement to "County Engineer" shall refer to any individual or individuals appointed by the County Engineer to act on his/her behalf. G. Violation of Terms of Agreement: If in County's opinion, Permittee has violated any of the terms and conditions set forth in this document, County shall notify Permittee of its belief that there have been violation(s) and shall state with specificity the facts and circumstances which County believes constitute the violation(s). Permittee shall have fifteen (15) days within which to either cure the violation or demonstrate compliance. If, after fifteen (15) days have elapsed, County believes in good faith that there has been a violation of the terms of this Agreement, County shall initiate proceedings to revoke the Home Occupation — Class II permit. H. Termination of Permit: A Home Occupation—Class II permit shall terminate upon the earliest of the following events: 1) Cessation of all Permit Related Activities: Termination of the Permit shall occur upon Permittee's complete cessation of all activities permitted under the terms of the Permit. Permittee shall provide written notice to County of a cessation of activity, which County shall then verify. If written notice is not provided to County, termination of the Permit shall occur three (3) years after County observes the cessation of the activities for which the Permit was issued. 2014-1802 PL2539 2) Execution of Replacement "Home Occupation — Class II Agreement": The Agreement shall terminate following County's execution of a new Home Occupation — Class II Agreement with a new Permittee who has purchased or then inhabits the Property, and intends to make use of the rights and privileges available to it through the then existing Home Occupation—Class II permit. 3) Sale or Transfer of Property and/or Commercial Enterprise: The Permit shall immediately terminate upon Permittee's sale or transfer of the property upon which the commercial enterprise is conducted. The Permit shall also terminate immediately upon Permittee's sale or transfer of the commercial enterprise. Governmental Immunity: No term or condition of this agreement shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act, Section24-10-101, et seq., as applicable now or hereafter amended. J. No Third Party Beneficiary Enforcement: It is expressly understood and agreed that the enforcement of the terms and conditions of a Home Occupation — Class II permit, and all rights of action relating to such enforcement, are strictly reserved to the County. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of June, A.D., 2014. I often drive by the Starman's property en route to CO 392 and have never noticed any stench. I see Mr. Starman's trucks maybe once or twice a month. When the trucks leave his property, they turn right and go south two blocks to CO 392. I have never seen them going north past other people's property. They do not create traffic or dust problems. Mr. Starman has always been helpful to all of his neighbors over the years. Judith W. And Mrs . Starman . I will be out of town June 16 or I would be there in person to state my opinions . Starmans have conveyed to me that their reason for requesting this permit was that they were not aware of the requirements but would like their employee to be covered for appropriate benefits and work men ' s compensations . This seems to me to be the right thing to do . They said the aren ' t really changing anything about the business . In regard to some neighbors concerns , I will simply state what I have noticed living closest to them, southeast across the road from them . 1 . No increase in traffic from his hay business . They have been active in keeping the road sprayed in the summer months for the past several years . 2 . I have only noticed any odor once and that for a short time . I wasn ' t certain if it was from the dairy or not as we do live in an agricultural area . Winds and breezes seldom are sent my direction or any other neighbors either , but I am the neighbor that would be downwind the most frequently . 3 . Jake brake use has been greatly reduced since these proceedings have started . 4 . Any spillage that could possibly occur would leak down hill from his home and all other nearby neighbors . 5 . What does hours of operation or permit variances or home business classification have to do with us , the neighbors ? My personal opinion is the opposition to this family ' s business is an attempt of one sore loser to even the score . I am not interested in playing those games . It is none of my or anyone else ' s business what the neighbor does on his personal property As Long As it is not devaluing my health , my property or my life style on my property . EXHIBIT Lynn Walter 1A\ ( 2) -ZfN8► 3-- ccwr June 10, 2014 In regards to Kenneth Starman Zoning Permit, Case #ZPHB13-0005 My name is Cynthia Haugen and I am retired and home most of the time . I live about % miles north of Ken Starman . I have never noticed any odor coming from his business. I have seen his truck(s) go by occasionally but have noticed nothing out of line with the drivers. There has been no noise, such as horns, or fake brakes. If you wave at them, they' ll wave back. As far as I can tell from what I know, when it came to Ken's attention that he was out of zoning compliance, he started the process to come into compliance. My experience with Ken has been good . He has been a good neighbor. He knows I live alone and will often do voluntary acts of kindness, such as snow removal so I can get my car out of the garage and onto the road . I also know that if I need help, he will come. An instance of this was when I was working on my automatic waterer and the float blew off and I had water spraying out everywhere. I called and he came up immediately and got the water stopped and the float working properly. When I have visited with him, he always seems concerned about the neighbors and community. Front Range Septic, Inc. operates out of Ken and Jamie Starman's home and farm at 33431 WCR 53. Ken and Jamie have already submitted a home occupancy permit application for the operation and have received comments back the county. These comments require the existing operation to be modified to comply with the home occupancy guidelines. OVERVIEW Front Range Septic operates out of the home and shop at the above referenced address. The operation utilizes two septage hauling vehicles, which are allowed under the home occupancy guidelines. The operation currently relies on two large above ground tanks to hold septage for short periods between visits by McDonanld Farms to take the septage away and properly dispose of it. These tanks are above ground and are not allowed to be a part of the home occupancy as they are considered outside storage. Additionally, the tanks are not located on the parcel that the home occupancy application has been applied for. These two items have been identified as needing to be corrected before the county can finish processing the application SUMMARY The current location of the storage tanks is directly north of the existing property line. Front Range Septic is planning to submit a separate Amended Recorded Exemption application to modify the existing property lines. The Amended RE will allow the proposed underground tanks and access to the tanks to be on the home occupancy parcel. Baseline has prepared plan and profile views of the proposed tank load out area for county review. The plan view shows the proposed new property line being 25' south of the north property line of the adjacent, agricultural parcel, which the Starmans own and operate a farm on . The proposed property line location was selected to: • Protect the above ground and underground farm irrigation facilities and keep them on the agricultural lot • Maintain adequate access along the north property line to access the irrigation facilities. October 14, 2013 The new tank load out area is proposed to remain more or less in the existing location. The underground tanks are shown in plan and profile view to provide reference for county staff in their review of the proposed facility. The new load area was designed to provide the following: • Proper access to the tanks for daily operation, both horizontal and vertical access • Protect the tanks from storm runoff, shallow ground water, and irrigation water in the adjacent irrigation ponds • To maintain exceptional screening from neighbors of the home occupation operations • To utilize double wall fiberglass tanks that are designed to meet or exceed the requirements for wastewater storage Review of the proposed plan and profiles shows that the operation can install underground tanks to eliminate the outside storage condition that is not allowed in conjunction with a home occupancy. The tank load out location has not changed from the historic location due to the exceptional screening provided by the existing wind break directly north of the load out area. CONCLUSION The county has expressed concerns that the existing operations of the septage hauling and storage at this site do not meet the home occupancy guidelines. Following discussions with the county, we have determined that the proposed underground tanks will allow the county to proceed with the home occupancy application. We request that the application continue to be processed and that staff approves or recommends approval to the county commissioners. The molds provide a firm and consistent surface upon which we apply materials to make our tank. The rotating mandrel and the application of the materials are controlled by a computer, custom designed to manufacture underground tanks. As the mandrel rotates; resin, glass and specially treated silica are precisely metered onto the mandrel from above. Tank thickness is determined with an instrument that magnetically senses the metal mold surface through the fiberglass reinforced plastic laminate. This method accurately measures the thickness of the laminate using specific points all over the surface of the tank wall and is more exact than the ultrasonic methods used by other manufacturers. The result is a closely controlled process and a very consistent tank wall composition providing uniform integrity. DIFFERENT PROCESS, BETTER RESULTS The inside-out approach to manufacturing tanks is a superior process with unique advantages. Inner Surface: The initial material forming against the steel mold produces an incredibly polished finish, free of surface variations. The smooth inside surface in our process is not exposed to air as it cures thus eliminating air inhibited cure issues. The result is a well cured, high gloss inner surface without the need for interior liners. Other manufacturing methods rely on inferior hand sprayed wax coatings to combat surface cure problems. Outer Surface: Exterior stiffening ribs are applied in optimal locations and constructed of the most efficient reinforcing materials. We can also modify a tank by adding filament winding glass in tension, glass woven roving, glass mat, or any other materials in specific locations on the outside of the tank wall. SINGLE-WALL TANKS The very first fiberglass underground petroleum storage tank was a single-wall design and for 45 years single-wall tanks were installed around the world. As petroleum regulations changed single-wall tanks were phased out and although CSI no longer produces single-wall tanks for fuel storage, the original design is still utilized in other applications like water storage and separators / interceptors. Single-wall tanks use the same manufacturing methods and laminate matrix as our double-wall designs. Functioning legacy single-wall tanks can be upgraded or modified to meet changing standards and storage requirements. TRIPLE-WALL TANKS In 1997, CSI designed the first UL listed triple-wall fiberglass tank for use in environmentally sensitive areas where tertiary containment is required. Triple-wall tanks offer three levels of protection: the proven strength and performance of a primary fiberglass tank, and in the unlikely event that there is a breach, secondary and tertiary walls designed to contain the fuel and prevent any spill into the environment. The applicant has a current septic cleaner license with Weld County, License No . CL-0700022 . The existing residence is served by an individual sewage disposal system (Permit SR 9800104) and North Weld County Water District (Acct. No. 2701000) . The septic system is permitted for 3 bedrooms, or 6 persons . According to the application , there will be a total of 4 people using the site , 2 of which are outside employees. There is an existing shop building on the property. The applicant will need to submit a waste handling plan to include refuse disposal, and any wastes generated from vehicle maintenance, including waste vehicle fluids and scrap parts, such as tires, batteries. If there are floor drains in the maintenance shop, floor drain waste must be captured in a watertight vault and hauled off for proper disposal. The names , addresses and phone numbers of the waste haulers and disposal and recycling facilities shall be provided in the plan . According to the application , septage is brought onto the property to off-load for final disposal to McDonald Farms. The site plan indicates that the off-load area is at least 350 ft. from the County Road . The applicant will need to submit a spill containment and response plan for the transfer and storage of septage in the aboveground tanks on the property. The facility shall be operated in a manner to prevent odors and off site odors must not exceed the threshold level as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. The following conditions are recommended to be part of any approval : 1 . The applicant shall submit a waste handling plan , for approval , to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. We are very confused why we did not receive a letter from Weld County with a "Surrounding Property Owner Notification." After speaking with Tiffane and her explaining the wordage, we understand that we are not within 500 feet of the property description of the business, and that we would not be affected by the on-goings of the business. However, we most definitely are affected. Our address is 33037 WCR 53, Gill CO 80624, and our property line borders on the south east with the Starman's center pivot. Our property is the lowest part of this quarter section that Starman's pivot occupies. All excess runoff from this quarter section runs directly into our property. Thus, if he were to spread the sludge on his pivot just prior to a heavy rain, we would be very concerned about the health safety of our children, animals, and ourselves. The possible odor is another factor of concern. 2. We also find it very bizarre that this business has been operating now for several years and just now this is being brought to your attention. After the whole family being awaken nearly every morning from the obnoxious engine breaks that his trucks use right in front of our windows, with amusement seen on either his or his worker's faces each time, it's very evident that their consideration for us as neighbors is far from their minds. After witnessing the spreading of the contents of one of his tank trucks on his property, we are questioning the legality of this action and definitely don't want it to ever happen close to our residence for obvious reasons. There must be some sort of under-lying motive for his applying for this permit after years already in business. 3. Our past experiences with the Starmans have always been the result of some sort of conflict directly instigated by him. Our opinion of his lack of integrity, credibility, and mental instability is of great concern when you associate these traits with the handling of domestic septic sludge. We have been neighbors with the Starmans for 12 years and this is strictly our opinion only. Unfortunately we are somewhat worried for the possible retaliation from him for voicing our opinion, but feel it's necessary to voice our concerns none-the-less. 4. The applicant, in his haste to put up his illegal sewage storage tanks, placed them directly down hill from his irrigation pond . This presents two problems. 1 . The soil out here is a layer of clay 3' - S' deep over a layer of shale, seepage from the irrigation pond is very likely to travel laterally in the layer of clay, on top of shale making the ground unstable for the kind of loads these tanks generate. 2. It is very common for irrigation ponds to breech for one reason or another. Having these storage tanks in the direct down hill path of any kind of pond breech is just poor planning and an accident waiting to happen . Please call or Email question/comments. This business has operated for quite some time under no county guidelines or considerations for any neighbor issues or complaints pertaining to the transportation and storage of raw sewage at the applicant's address. If this was an above board business, it would seem to me that the applicant would have gotten the permit first, and then form a business adhering to the permit guidelines. 2. Non-farm tank stench. The applicant has exhibited no willingness to mitigate real concerns that we, as adjacent neighbors to the North, have in regard to the applicant's continued operation of this business. On some days, when the wind is out of the South, we get a stench that will knock you off your tractor. 3. Dust control. Applicant has gone from 0 non-farm tanker trips per day to 2 trucks making daily routes and dumping to the holding tanks on the applicant's property, with periodic transfers of the holding tanks to semi-trailer tankers (which really seem to cause non-farm odors). 4. Traffic control. Same as above. 5. Noise control. Every trip seems to involve jake brake operation. The hours of operation and number of trips are totally unregulated. 6. Holding tank set -back. Applicant has 3 holding tanks with-in 50 feet of our South property line with no secondary containment. 'Iwo of the tanks are approximately 17,000 gallons and one is roughly 1800 gallons. What is the county's guideline for this type of business? 7. Holding tank contents. Who knows what the applicant is holding in these tanks? Right now it is totally un-regulated. 8. If this permit is approved, who over-sees the applicant's compliance with the terms and rules of the permit? If the applicant decides to spread raw sewage on his property, who is to stop that? 9. If the applicant's permit is approved, how big can his company get? What is the limit of a "home based business" and how is the volume policed by the county? 10. If the applicant's permit is approved, and he sells his business to X Corp.where does that leave all of us neighbors in an AG zoned area? 11 . We did not buy property that was next to a sewer plant/holding facility; if we did, we would have paid a lot less for our property. This permit approval would adversely affect surrounding property values. 12. If the applicant is permitted to operate a non-compliant industrial use of his property (the storing and servicing trucks on the premises), this would not create a huge concern other than items #3,4&5. The storing and transferring of raw sewage is absolutely unacceptable for this location. The delivery of waste should take place at a facility that was built to handle raw sewage. . .not a used oil tank with no foundation. At the very least, permit approval should be contingent upon removal of the storage tanks with a final inspection and sign-off by the county. 13 . In closing, we believe the applicant should conduct his business in a location that does not require a variance. The only issue is convenience. . .if everyone that wished to own and operate a business were allowed to it at their home, zoning would not exist. The applicant should need to follow the existing requirements for operating this business and do it in a location that is currently zoned for this business. The septic waste materials are transferred from enclosed trucks to an enclosed storage tank located on his property.
