RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR14-0031, FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY AND OIL
AND GAS STORAGE FACILITY (CRUDE OIL TANK FARM AND CRUDE OIL TRUCK
UNLOADING FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT -
UET MIDSTREAM, LLC
A public hearing was conducted on October 15, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated July 24, 2014, and duly published July 29,
2014, in the Greeley Tribune, a public hearing was conducted to consider the request of
Tallgrass Pony Express Pipeline, Inc. and UET Midstream, LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR14-0031, for an Oil and Gas
Support and Service Facility and Oil and Gas Storage Facility (crude oil tank farm and crude oil
truck unloading facility) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County
Attorney, made this a matter of record.
(Clerk's Note: The Department of Planning Services has advised that the sole owner of the
property under this USR will now be UET Midstream, LLC)
ILE Chair Pro-tem Kirkmeyer advised Joseph Natale, Director of Operations for UET
Midstream, LLC, representing the applicant, that, since Commissioner Rademacher was not
able to be present, he had the option of continuing this matter to a date with the full Board
present. However, if he decides to proceed today, it will require three affirmative votes, or in the
case of a tie vote, Commissioner Rademacher will listen to the record and make the determining
vote. Mr. Natale indicated he would like to proceed.
Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. This will be a 24/7 operation, with 120 truck trips per day, and a total of nine
(9) employees working in shifts. He said there will be a modification to the legal description to

include another 10 acres purchased from Tallgrass Energy (to be addressed later on). He said
this is a rural location with a lot of other oil and gas activity in the vicinity, and showed pictures
of the site.
El Don Carroll, Department of Public Works, stated County Road (CR) 119, a local gravel
road, between CRs 104 and 110, and there is not an ADT at this location. He said that access
points have been assigned, and reviewed staffs requirements. He noted that the traffic will be
reduced to 50 trucks in Phase II (pipeline). He said staff is asking for a proportional share Road
Maintenance and Improvements Agreement. In response to Commissioner Conway, Mr. Carroll
concurred that staff should be asked to look at this road for traffic counts, especially since it is
so heavily used by oil and gas and the proportional sharing of several companies.
la Lauren Light, Department of Public Health and Environment, said there will be a
commercial well and septic, an Air Emissions Permit and a comprehensive Waste Handling
Plan were submitted.
El Tom Elderidge, with Con Company, the Engineer of Record for this facility, gave a brief
overview of the facility. He said the pipelines that will eventually be operational will reduce
traffic on County roads, the facility has 300,000 barrels of storage, and it meets all the Colorado
EPA requirements.
F No public testimony was offered concerning this matter.
El In response to Commissioner Kirkmeyer, Fabrianna Venaducci of James C. Karo and
Associates, representing the applicant, came forward to address the pending Tallgrass USR for
their pipeline. Mr. Natale stated if that pipeline is not approved that would change the logistics
of this faculty from a business perspective, but they would go forward without it, and confirmed
the 120 truck count is based on having no outbound pipeline.
F Mr. Gathman addressed the clarification of the legal description to reflect all of the
properties being discussed, which should read: Lot A of Recorded Exemption RECX14-0048,
located in a portion of the E1/2 SE1/4 and S1/2 NE1/4 of Section 2, Township 9 North, Range
59 West of the 6th P.M., Weld County, Colorado.
El In response to Chair Pro-tem Kirkmeyer, Ms. Venaducci and Mr. Natale, indicated they
have reviewed, and agree to abide by, the Conditions of Approval and Development Standards.
ID Commissioner Freeman moved to approve the request of UET Midstream, LLC, for a Site
Specific Development Plan and Use by Special Review Permit, USR14-0031, for an Oil and
Gas Support and Service Facility and Oil and Gas Storage Facility (crude oil tank farm and
crude oil truck unloading facility) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Garcia, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:19 a.m.
