This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 27 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. CR 64.5 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. The applicant shall delineate or dedicate an additional 10-foot of right-of-way parallel to the CR 64.5 right-of-way for future build-out. CR 27 (Two Rivers Parkway) Alternative Alignment Study — Final report dated February 2007. North segment (option 3-Figure 4) shows a new cul-de-sac north of the railroad crossing with the CR 64.5 and CR 27 intersection northbound being closed. Contact the County Engineer with questions or for assistance. REQUIREMENTS: Access: Show the approved access on the plat and label it with the approved access permit number (AP14- 00232). Turning radii are 45-60' typically at access points. The access/exit shall be placed in such a location to have adequate sign distance in both directions. The exit point is next to the railroad crossing, check with the traffic engineering division on your sign distance triangles for the exit location being next to the railroad crossing 970-356-4000 x 3726. Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Study: The RV storage yard has the storage capacity of up to 300 RV/boats. The site is designed with one retention pond. The drainage swales have a side slope at 3:1 and greater; also the retention pond has design slopes of 3:1. Grading Permit: If more than one acre is to be disturbed, a Weld County Grading Permit will be required prior to the start of construction. Improvements and Road Maintenance Agreement: This document is required for the site. Road Maintenance including dust control, damage repair, and triggers for improvement will be included. At full capacity there may be a maximum of 100 to 150 customers per day. Water will be provided by North Weld County Water District. An on-site waste water treatment system will be utilized for the modular office building. There will be a dump station with an attached vault privy for customers. A vault privy is addressed in Section 30-12-40 of the Weld County Onsite Waste Water Treatment System Regulations. The dust abatement plan states speeds will be reduced to 5 MPH, drive areas will be surfaced with recycled asphalt and water be utilized if necessary. The waste handling plan indicates there will be a trash enclosure and waste will be picked up by Bunting Disposal Inc. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to certificate of occupancy for the caretaker residence: 1. An on-site waste water treatment system (OWTS) is required for the caretaker residence and shall be installed according to the Weld County OWTS Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Onsite Waste Water Treatment Systems. 7. RV dump stations shall be connected to an appropriately engineer designed Onsite Waste Water Treatment System which complies with all provisions of the Weld County Code, pertaining to Onsite Waste Water Treatment Systems. 8. Water Division 1, Water District 3 Dear Ms. Aungst: We have reviewed the above referenced application for a Site Specific Development Plan and Use by Special Review Permit. The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The application is sought to allow an RV and boat storage facility on a 6.67-acre parcel. The site will include a caretaker's residence, an RV dump station, and a water hydrant in addition to providing storage for 300-400 RVs, boats, and/or other recreational-type vehicles and trailers. The facility is anticipated to have 2 full-time employees. The proposed water supply for the property is the North Weld County Water District ("NWCWD"). The applicant has provided a letter, dated May 16, 2014, from the NWCWD stating that the NWCWD is able and intends to provide water service to the property, provided all requirements of the District are satisfied. The NWCWD most recently provided updated supply and demand information via the Tri-Districts on December 18, 2012. The document shows that the NWCWD's firm yield supply of 6,392 acre-feet exceeds its dry year planning demand of 4,702 acre-feet. This office considers the NWCWD to be a reliable water source. This office has no objection to the proposed RV and boat storage facility with the NWCWD as the water supplier.
