HomeMy WebLinkAbout20140717.tiff RESOLUTION RE: APPROVE APPLICATION FOR RIGHT-OF-WAY USE PERMIT TO PLACE AN 18" FRESH WATER PIPELINE WITHIN PORTIONS OF THE COUNTY RIGHT-OF-WAY FOR COUNTY ROADS 14 AND 55 - COLORADO WATER PIPELINES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application for a Right-of-Way Use Permit to place and construct an 18" fresh water pipeline within portions of the County right-of-way for County Roads 14 and 55, from Colorado Water Pipelines, LLC, to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, with terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference, conditional upon the following: 1) The location of the line shall be accurately reflected on the "Land Owner Status" map and submitted for the record, specifically the area south of the Fritzler property - the line should be reflected south of the section line, as represented through testimony from the applicant; 2) 24-48 hour advance notice shall be given to, and permission be granted by, adjacent property owners prior to entering properties (permission necessary only if such permission is not otherwise granted in permanent or temporary easements); 3) Temporary construction easements shall be signed for all segments which will not be within the County's right-of-way; and 4) The applicant shall submit evidence of all signed agreements related to the project. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Application for a Right-of-Way Use Permit to place and construct an 18" fresh water pipeline within the County right-of-way for County Roads 14 and 55, from Colorado Water Pipelines, LLC, to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, be, and hereby is, approved, subject to the conditions listed above. Public Works has followed the same process used for all applications requesting waterlines in the right-of-way, which is as follows: 1) Submit a completed Right-of-Way Use Permit Application and submittals including an alignment map; 2) Make a good faith effort to contact all affected properties owners and provide documentation that contact has been made; 3) If property owner negotiations fail and no other options exist, meet with PW staff to coordinate with the Department's Commissioner Coordinator. 4) All permanent parallel pipelines within the ROW are to be discussed by the BOCC. Since item number two can be somewhat subjective, Public Works does our best to document calls received regarding these applications to ensure adequate communication between the property owners and the applicant are on-going. Following is a list of descriptions of concerns that have been noted for these applications: 1. Applicant inappropriately accessed property owners land without permission, and stated the County had given permission for this. 2. Applicant sent out a letter that indicates these applications have been approved by the County and will be starting within a few weeks. 3. Property owners believe their input will not be taken into account regarding the approval of both the permanent and the temporary pipeline. Due to the amount of public input received on this matter, it may be in the Commissioners best interest to have a public hearing on this application? We have a home on WCR 14 located about .8 miles west of WCR 59, and are on the south side of WCR 14.The actual WCR 14(county maintained) ends .5 miles west of WCR 59.We have built(and maintain) a private lane going on west for.3 miles to access our property (about 12 acres), and the property of Matt Madsen immediately to the south (20 acres). The only portion of WCR 14 from WCR 59 to WCR 55 that is built and maintained by Weld County Public Works is .5 mile west of WCR 59. The concerns I have are as follows: - Installation of the pipeline in Section Line R.O.W. The proposed 18" water pipeline is for private enterprise, not for a municipality or public use. I don't believe the R.O.W. was intended for this type of access, and should not be granted.This is especially the case where there is no County built and maintained road. - Damage to private property. Much property damage can be done during the installation of the pipeline,especially this pipeline due to the 2 phased approach-first above ground and later burial.The most damage will be to roads, private lanes, and driveways. Other damages include fences,trees,grasses, landscaping, and crops. Who will monitor the damages incurred, and enforce immediate repair and restoration? -Access to private property. Easy access must be insured to all properties,especially for large equipment such as tractors, farm equipment, construction equipment, and emergency vehicles. - Maintenance of the exposed pipeline. Who will be responsible for the maintenance of the pipeline, and who will be responsible for the damages done in the case of a pipeline failure?Will there be a Bond required for this project, and who will administer that Bond? - Future burial of the pipeline. What will be the role of Weld County with the second phase of this project(Burial of the pipeline)?Who reviews the plans and enforces a quality installation, both in a County R.O.W. and on a private property R.O.W.? In that letter he included a "Pipeline Right-of-Way and Easement Grant", and stated an exhibit map of the planned project was enclosed, but it was not. In talking to the other owners, several questions arose about the appropriateness for us to enter into an agreement with Colorado Water Pipeline LLC. Among our concerns were: • The fact that we would need to assume all legal fees associated with contacting our lawyer to help guide us concerning our rights, obligations, and impact this may have on the short/long term value of our land • The number of times we have been approached by companies to use our land to help them make money when we benefit very little and have long term resulting risks. These in part are due to access for pipeline construction and maintenance, disruption of crops and land damage with little assurance that damages will quickly and successfully be restored, and the long term legal obligation we take on should there be any issues in the future. • The fact that we must further retain our lawyer to help us fully understand the process by which Public Service Company,to whom we have already granted an easement on the land in question, can "grant" a license to CWP,LLC for the purpose of a permanent pipeline. • The idea that water would be in the same easement as the power lines makes all of us question the intelligence of such a co-location. • The fact that there is no through road way along our west boarder(WCR 55), nor is it likely that there ever will be because of such obstacles as 176 and the railroad crossing. To us, it doesn't make sense for the county to award a right of way where no roadway is ever likely to exist. While we are not unaware of the county's issues related to heavy truck traffic carrying water to fracking sites, it is unfair to land owners to be forced to grant an easement they don't want to grant, with no clear advantage, several very clear disadvantages, and insignificant compensation for the right. The burden of financing the cost of development should clearly be on the company most benefiting from the business enterprise. Please consider our concerns, and realize that this is an unwanted use of our land for the profit of another, as you weigh the pros and cons of the Colorado Water Pipeline, LLC request. Box 758 Greeley, CO 80632 Dear Commissioner Kirkmeyer, I am writing you in regards to the planned water line placement by Colorado Water Pipelines, LLC along Weld County Road 14. My family has owned a quarter section of land in section 35 at the northwest corner of county roads 59 and 14 for many years. This land is titled as Sharp WC Land, LLC. Colorado Water Pipelines approached me recently for a 30 foot permanent and 50 foot temporary easement across the property..We were notable to come to agreeable terms and so the easements were not granted. It is my understanding that Colorado Water Pipelines has applied for and been granted approval to place the pipeline in the County Right of Way on the south edge of the property. Amy Joseph was kind enough to forward to me the Board Resolution and Alignment Map and I am also in receipt of the Meeting Minutes of the public hearing of March 10, 2014. Upon review of this information along with review of the property legal description and attorney consultation it is my contention that Colorado Water Pipeline, LLC is still required to obtain express permission from Sharp WC Land, LLC to place their pipeline on the Sharp WC Land, LLC property within the County Right of Way. This contention is based on the fact that the water pipeline is not a public utility. Rather, the pipeline is a private entity and as such does not derive the benefit of having access to the County Right of Way without also having to obtain legal access from Sharp WC Land, LLC. Without such legal access (easement) in place, Colorado Water Pipeline would be committing a trespass were they to begin the process of installing their pipeline across the Sharp WC Land, LLC property. My sense from discussions with representatives of Colorado Water Pipelines is that they believe that having access to the County Right of Way absolves them of any legal permission from the property owner. I contend that this belief is not valid for the reasons stated above.
