HomeMy WebLinkAbout750407.tiff RESOLUTION WHEREAS, a public hearing was held on January 13, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of the Colorado State Highway Depart- ment, c/o Leo O'Connor, 1420 Second Street, Greeley, Colorado, (Gary Jeffers land) requesting permission to locate a gravel pit operation on the following described property: A parcel of land located in the Northwest Quarter of the North- east Quarter (NWjNE4) of Section Eight (8), Township Five (5) North, Range Sixty-Seven (67) West of the Sixth P. M. , Weld County, Colorado, and more particularly described as follows: Beginning at a point which is the Northeast Corner of Section Eight (8), Township Five (5) North, Range Sixty-Seven (67) West of the Sixth P. M. , thence South 89°25' West along the North line of said Section Eight (8), a distance of 1700 feet; thence South a distance of 420 feet to the true point of begin- ning; thence South 15°45' West a distance of 200 feet; thence South 85°15' West a distance of 845 feet; thence North a dis- tance of 100 feet; thence North 79°50' East a distance of 920 feet, more or less, to the point of beginning, said parcel containing three (3) acres, more or less, and WHEREAS, the Petitioner was present, being represented by Mr. Leo O'Connor of the Colorado Highway Department, and WHEREAS, there was no opposition to the request of Petitioner for the location of said gravel pit operation, and WHEREAS, the said requested gravel pit operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the Petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Colorado State Highway Department, c/o Leo O'Connor (Gary Jeffers land), to locate a gravel pit operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That Petitioner shall proceed with due diligence to effect con- struction of said gravel pit operation and that he shall have up to one year from date hereof to begin the construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. That when gravel extraction is completed said permittee shall immediately notify the Board of County Commissioners and said permit shall automatically be revoked without further action of the Board. 4. That the operation and development of each gravel pit excavation and rehabilitation shall be limited to plans as submitted and in accordance with the rules and regulations for the operation of gravel pits as adopted by Weld County, Colorado. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. DISCUSSION: This soil will be used in the building of the new U.S. 34 and will require an additional three acres to continue the project. Plan to re- move the top six inches of soil .and replace it back on the area when the II material has been removed. None of the slopes will be steeper than eight to one. This will enhance the farmability of the land when done. APPLICANT: Northern Colorado Feeder Pig Coop CASE NUMBER: SUP #265 Tape 557 & 558 SUBJECT: Hog Operation LOCATION: S1/2 S' NE4 SE4 & S1/2 SE4 NW4 SE4 Sec 17 T8 R65 APPEARANCE: Walt Danielson, Lee Carlson and Virgil Ottinger APPEARANCE AGAINST: Steve Weatherford; Sam Williams; Douglas Lesh; Lawrence Hertzke; Mr. Andrejeski DISCUSSION: Mr. Danielson stated this area was further away from any town and felt it was an ideal location. The entrance to this location is about a quarter mile from the corner. Would like to put a trailer house or a home as you come into the area. The farrowing house and the nursery would then be behind that; gestation house would be open. Clear to the west side they have indicated an area for proposed finishing building (this would be in the long range future) . Water is a big point, do have to have good water. Total parcel is 15 acres. At present, the pigs are taken to different places to be finished. Steve Weatherford, owns 20 acres just south of the proposed hog operation. Stated he had originally signed the petition for the operation, but has - talked with different people and now would like to change his mind. Has talked to real estate people and been told that he will have trouble F trying to get financing to build on his property. When he bought his parcel , the land was divided into 20 acre parcels and looked like it would be developed into a residential area. Sam Williams, property is right on the south corner. Wondered how they could buy 15 acres (explained it was split before Senate Bill 35). Douglas Lesh, lives just across the road south. Worried about the draining of the pits, the smell and the devaluation of his property. Stated that there were 10 homes around this property within 3/4 of a mile. Lawrence Hertzke, does not own any land up there, but the school does lease some land that is across the road from the proposed operation. ► The school owns all the buildings on that parcel (the one they lease) . Also afraid of the devaluation of property that might be caused by the • pigs . Mr. Andrejeski , owns the quarter right next to the quarter of subdivided land involved. He would be more or less against it as there are already several livestock operations out there. Has 100 head of dairy cows. Under certain conditions , a hog operation can affect the grading of milk. (Mr. Williams also owns some dairy cows, afraid of the effect on him and his operation. ) Mr. Danielson stated that there was a dairy (Grade A) right across the road from their Pierce operation, and has never had any trouble there. Want to have a clean operation. The waste will probably be carried out and spread on the farm land surrounding the area. They have looked for two or three years for another place, and if they want on a water line, they will have to be near people to a certain extent. Would like to cooperate with the neighbors as much as possible. Mr. Weatherford stated he had heard Pierce did not want them expanding the operation there. Mr. Danielson stated that he felt they could double what they had by Pierce and nobody would ever be able to tell any difference. They would like to expand their operation by Pierce as it would be much cheaper for them. But, rather than do that (against Pierce's feelings) , they would go 1089 further away and ,,,,ate in another place. Mr. Rothe stated that it appears that this operation would be located right in the center of the land that has been subdivided. Mr. Danielson was asked if they were aware of all the landowners surrounding them; answer was yes, sort of. Weld County Planning Commission staff recommends approval for the following reasons: (1 ) The proposed hog operation is in compliance with the Weld County Comprehensive Plan in promoting agricultural industry of a county; (2) The proposed use is compatible with surrounding area. SUBJECT TO: (1 ) Construction beginning within 12 months of approval by the Board of County Commissioners; (2) Buildings and sizes and facilities limited to the size and location as specified on the plot plans; (3) Number of head of live- stock not to exceed the total stated in the application (600 sows and 1800 pigs). Letter from Planning Commission member (Mr. Weigand) who inspected the area. . MOTION: By Mr. Anderson, To take this under advisement. Seconded by Mr. Clark. APPLICANT: Robert Green CASE NUMBER: SUP #266 Tape 557 & 558 SUBJECT: Dog Kennel LOCATION: Lot 10 Leisure Living, 1st Filing APPEARANCE: Mr. Green; Wayne Kaufman, Attorney DISCUSSION: Mr. Kaufman stated that Mr. Green has had these seven dogs on his property for about a year and a half. Has constructed running fences for , -- the dogs; also has outside yard fence surrounding his property. Soils re- port shows soil is compatible to this use. Felt that main objection s r may be the fact that a couple of property owners feel their property will be devalued by having a kennel here. The land is zoned agriculture. Mr. Kaufman submitted a petition in support of the Special Use Permit ap- plication with all but one signature of surrounding property owners. Mr. Kaufman did not feel that it would devalue the property. That was one of the reasons people moved into the country, was to keep animals. Mr. Green is not raising these dogs for sale. He raises them for show and hunting basically. Parcel is 1 .1 acre in size. Mr. Clark is the representative who field checked the area. He talked to Mr. & Mrs. Roesky (main ob- ; jectioners). Area is well kept. Mr. Krutchley, property owner, stated he lived the closest other than Mr. Roesky. He had no basic objection other than the devaluation of his property factor. Dogs are well taken care of. Does not want a kennel license issued. Mrs. Gardner wanted to know if the permit was tied to the piece of ground or to the owner. Legal counsel stated it could be either one or both. That would be the determination of the Board of County Commissioners. Mr. Green has Irish Setters and German Wire Hair Pointers. Mr. Elliott asked how many dogs would be kept there; answer was exactly what he has there now. He does train some dogs to be used in hunting for friends but not on a permanent basis. A couple of Mr. Green' s dogs are several years old and he does not want to get rid of them. Mr. Clark stated that he had informed Mr. Roeske of this meeting. Mr. Anderson asked legal counsel if the recommendation could contain a subject to re- garding that if this permit were approved, it would be for Mr. Green only and could not be transferrable; answer - this Board could specify the number of dogs and the individual who would hold the permit as such. —', General feeling of the Commission was that this was a well run operation. Weld County Planning staff recommends this for denial for the following reasons: (1 ) The activity is not in compliance with the Weld County Zoning Resolution in that the proposed kennel : (a) ' is not compatible 1090 with the resident character of the neighborhoo( . ;b) surrounding property owners in the area have expressed objections to the continuance of the kennel operation; and (c) owners of Lots 11 , 15 and 16 have not expressed written approval of the dog kennel as required by Section 6.1 (10)A of the Weld County Zoning Resolution. (This references the 2,640 foot set back from any place of assembly, and from any E, R, H, MH, T, B or S zone district or subdivision; and at least 660 feet from any ex- isting residence on another lot without the written approval of the fee owner of said residence. ) Mr. Kaufman stated that he got the feeling that Mr. Krutchley had no real objection as long as this did not turn into a licensed kennel (which was not Mr. Green' s intent) . RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of the application subject to no more than seven dogs, and that at such time he sells the property it revert back to its original use. Motion by Mr. Anderson, seconded by Mr. Clark. A vote of "Aye" by Watson, Anderson, Clark; Rothe and Elliott. Motion carried. (Mr. Nix was gone, Mr. Elliott now a voting member. ) LOCATION: SWI4 Sec 2 T5 R66 Tape 558 APPEARANCE: Bob Adams , Planning Office; Ernie Scott, Realtor SUBJECT: Lawrence Hertzke property DISCUSSION: Mr. Adams explained that a sort of problem had come up on the above mentioned property. Apparently there is an option where the Hertzke Bothers agreed to sell the entire farm, but in several parcels (all under 35 acres) back in 1971 . District 6 has already annexed their 15 acres to the City of Greeley. (Scott Realty has obtained title as trustee) . The balance of these parcels are more or less scheduled for annexation also. Mr. Scott explained that the problem they have gotten into is that in 1971 Webhan signed a contract with Hertzke on a rolling basis. He has agreed that he will buy this piece of property, but for him to get an option to buy an additional piece, he must buy this one, and when he buys this one, he has the right to buy this one and so forth. There are six separate parcels. On the records, they have conveyed a parcel less than 35 acres, which is in violation of Senate Bill 35. How can they go back, and because of the new law, reconstruct the contract? It was more or less the feeling that the Bill had no affect on the origi- nal contract. Mr. Fortner explained that the problem they are getting into is that as the options are taken, they are creating parcels under 35 • acres, and each time an option is taken, it' s recorded on a deed and it's under 35 acres. Webhan has actually bought the entire 130 acres subject to certain conditions. The problem arises as he takes each option and has each parcel recorded on separate deeds. Since the City will probably • annex this property anyway, the County has no jurisdiction as such. How- ever, this problem could arise at another time somewhere else in the County where the property wouldn't be annexed to a city and could possibly be resold as separate parcels, then the violation of Senate Bill 35 would be there. Need legal counsel for a decision. APPLICANT: Northern Colorado Feeder Pig Coop Tape 558 RESOLUTION: Be it therefore recommended to the Board of County Commissioners that this application be denied, because of the evidence submitted today. The reasons being surrounding property owners objections (the Board feels they have the responsibility of protecting those owners rights too) , and that the parcel was too small for a hog operation. Motion by Mr. Clark, seconded by Mr. Rothe. A vote of "Aye" by Watson, Anderson, Clark, Rothe and Elliott. DISCUSSION: Mr. Fortner stated that there were letters from the Health Dept. and the Extension Office saying that this parcel would be sufficient. Mr. 1091 Anderson felt th rea had originally been planne or residential uses rather than agricultural uses (such as feedlots, etc. ) . The land was split legally. We are requesting permission to remove approximately 40,000 cubic yards of soil (borrow material) from an area which we previously removed material. This borrow area lies on the south slope of a dry wash and was poor farm land due to the roughness and steepness of the slopes. We have removed approximately 175,000 cubic yards of material from this area for use on`a previous project. The removal of this 175,000 cubic yards of material resulted in a level irri- gable field. The additional 40,000 cubic yards of material, we are requesting at this time, will come from an area adjacent to and south of our previous excavation. We will remove the top six inches of top soil and stockpile it until the excavation of the borrow is completed. The top soil will then be spread uniformly over the borrow area. Any back slopes will be left at approximately 8:1. The borrow material will probably be removed by front end loader and hauled to the project in dump trucks. From our knowledge of the area, it appears that the bedrock in that location is the Pierre Transition Zone. This means that the bedrock material could be either sandstone or shale. In the event that it is shale, or the soils derived from primarily shale, the major constraints for the Borrow Pit would be slope instability caused by oversteepening and changes in hydrology and erosion caused by the removal of vegetation. Both of these potential problems can be easily controlled through sound grading practice, drainage control, and revegetation following the operation. For this reason, we see no reason why this application should be denied, as long as the Highway Department controls the above mentioned factors. After the Department has completed its removal operations, it will leave the premises in a neat condition. This Agreement is for removal of material for use on Department projects and maintenance only, and removal by any other persons including the Department's contractor or contractors for any purpose other than as herein provided, shall be under a separate agreement with the Owner and only with written approval of the Department. It is understood and agreed that, upon the letting of a contract by the Depart- ment to a contractor for the construction, improvement and maintenance of highways, the Department shall assign to the contractor all its right, title and interest under this instrument, insofar as the same shall be applicable to the projects let to the contractor, and the contractor may reassign such option to subcontractors working on said projects. If the option is exercised by the contractor or any subcontractor, said contractor or subcontractor shall have a right to extract all material needed for_the projects covered by the contract let by the Department, sub- ject to all the terms of the Option.
